TITLE : REJECT BIDS FOR CONSTRUCTION OF
LARWIN COMMUNITY PARK AND DIRECT STAFF TO
SEEK COUNCIL APPROVAL TO REBID CITY MGR~
CONSTRUCTION FOR THE PROJECT IN 2004
Adopt Resolution No. 2003-283 to reject bids received for the construction of Larwin
Community Park, City Project No. 38561 and direct staff to return to City Council for approval
to rebid the construction of the project in 2004.

On June 24 2003, The City Council adopted Resolution No. 2003-1 60 approving the plans and
specifications and authorizing the advertisement for bids for the construction of Latwin Park. The
project was advertised for construction bids and on September 18, 2003, the Purchasing
Department received and opened five (5) sealed bids. The table below lists the bidders and the
corresponding bids received for the project.

On April 2, 2003, CUP 02-231HDP 02 was approved by the Planning Commission (6-1). Within
the Conditional Use Permit for the project was a condition restricting construction activities
during the California Gnatcatcher breeding season (February 1 st to September 15th). Due to
unforeseen delays during the process of evaluating and reviewing the bids received for the
project, the project grading and construction operations cannot reasonably be completed within
the remaining restricted timeframe outlined in the project’s Conditions of Approval.
Staff recommends that the City Council reject all bids received for Latwin Park and direct staff
to re-bid the project in 2004 to allow sufficient time to bid, award, begin construction and
complete grading operations outside of the California Gnatcather breeding and nesting season
in compliance with the Conditions of Approval for the project. The City Courlcil, in its discretion,
may reject any bids presented. (Public Contract Code Section 22038).
ENVIRONMENTAL REVIEW:
A Mitigated Negative Declaration and a Mitigation Monitoring Program was prepared for the
Project by the Planning Department and the Planning Commission approved a Conditional Use
Permit (C.U.P. 02-23/HDP) on April 2,2003 for the Latwin Park.

FISCAL IMPACT:
The FY2003-04 CIP Budget has appropriated funds in the amount of $1,340,000 for
construction of the park. The cost to reject bids, make minor revisions to the contract
documents (to be done in-house), and re-advertise for bids is insignificant.

2003-283 RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, REJECTING THE CONSTRUCTION BIDS FOR LARWIN
COMMUNITY PARK, CITY PROJECT NO. 38561, AND DIRECTING STAFF
TO SEEK COUNCIL APPROVAL TO REBID THE PROJECT IN 2004.
WHEREAS, the City Council has previously adopted the Fiscal Year 2003 - 2004 Capital
Improvement Program Budget which includes funding for the aforementioned project; and
WHEREAS, the City Council of the City of Carlsbad, California, has previously adopted
Resolution No. 2003-160 approving the plans and specifications and authorizing the advertisement for
bids for the construction of Larwin Community Park; and
WHEREAS, bids were received and opened by the City on September 18, 2003 for the
construction of Larwin Community Park, City Project No. 38561; and
WHEREAS, the City Council does hereby find it necessary, desirable, and in the public interest
to reject said construction bids and direct staff to return to City Council for approval to re-bid the
aforementioned project in 2004;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the bids received and opened by the City on September 18, 2003 for the construction of
Larwin Community Park, City Project No. 38561, are hereby rejected.
3. That the City Council does hereby direct staff to return to City Council seeking approval to
re-bid for the construction of Larwin Community Park, City Project 38561, in 2004.
'PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held
on the 28th day of October , 2003 by the following vote, to wit:
