RECOMMENDED ACTION:
Introduce Ordinance No. NS-680
Carlsbad Village Drive from Tamarack Avenue to College Boulevard.
to establish a prima facie 40 mile per hour speed limit upon
ITEM EXPLANATION:
Carlsbad Village Drive is designated as a secondary arterial on the Circulation Element of the
General Plan east of Interstate Highway 5. However, portions of this road have not been built to its
full secondary arterial standard at this time.
The segment of Carlsbad Village Drive from Tamarack Avenue to Glasgow Drive was constructed
a number of years ago. The easterly extension of Carlsbad Village Drive from Glasgow Drive to
College Boulevard was completed in 2000. There has not been a prima facie speed limit
established on Carlsbad Village Drive from Tamarack Avenue to College Boulevard. On the
segment of Carlsbad Village Drive from Highland Drive to Tamarack Avenue, a 40 mile per hour
prima facie speed limit is established and posted.
Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a
prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic
volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight
distance, and conditions that may not be readily apparent to the driver.
At their meeting on May 5, 2003, the Traffic Safety Commission considered the results of
the Engineering and Traffic Survey to establish a prima facie speed limit upon a portion of
Carlsbad Village Drive. The Commission recommended by a 4-0 vote to establish a 40 mile
per hour prima facie speed limit upon Carlsbad Village Drive from Tamarack Avenue to
College Boulevard.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
FISCAL IMPACT:
Installing two speed limit signs on Carlsbad
College Boulevard will cost about $250.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 10.44.080 TO ESTABLISH A PRIMA
FACIE 40 MILE PER HOUR SPEED LIMIT UPON CARLSBAD
VILLAGE DRIVE FROM HIGHLAND DRIVE TO ITS
INTERSECTION WITH COLLEGE BOULEVARD.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
3y the revision of Section 10.44.080 to read as follows:
“1 0.44.080 Carlsbad Villaqe Drive:
(a) Highland Drive, the prima facie speed limit shall be thirty-five miles per hour.
(b) College Boulevard, the prima facie speed limit shall be forty miles per hour.”
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
he City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
iublished at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
15) days after its adoption.
