ENG RECOMMENDED ACTION: TITLE: ACCEPTING BIDS, INCREASE APPROPRIATION FOR EL CAMINO REAL SEWER, AWARDING CONSTRUCTION CONTRACT, AND TAMARACK AVENUE TO CHESTNUT AVENUE, PROJECT NO. 3891 CITY MGR. Adopt Resolution No. 2003-331 accepting bids, awarding a contract, and increasing the appropriation for the construction of the El Camino Real Sewer, Tamarack Avenue to Chestnut Avenue, Project No. 3891. ITEM EXPLANATION: There are twenty (20) parcels of land located along El Camino Real between Tamarack Avenue and Chestnut Avenue that presently do not have access to a public sewer. Existing residences in this area use private on-site septic tanklleach fields for wastewater disposal. To provide a public sewer to these twenty parcels, the City Council approved a $420,000 appropriation from the Sewer Replacement Fund for the El Camino Real Sewer Pipeline from Tamarack Avenue to Chestnut Avenue (Project No. 3891). Project No. 3891 includes construction of an 8-inch diameter sewer pipeline beginning at an existing sewer pipeline at Tamarack Avenue and extending northerly approximately 4,350-feet towards Chestnut Avenue as shown in Exhibit 1. Project No. 3891 includes 11 access holes, a service lateral for each of the 20-parcels, and 524-feet of 6-inch diameter pipeline within a private utility easement serving 5 of the 20 parcels described above. The project plans require that construction be performed between the hours of 8:30 a.m. to 3:30 p.m., within El Camino Real, to reduce impacts to traffic at peak-hour periods. On August 12, 2003, the City Council authorized the advertisement for bids for the construction of this project. The Engineer’s Estimate for construction was $420,000. On October 8, 2003, nine sealed bids were received as follows: All bid documents provided by the lowest responsible bidder, Beador Construction, are in order. Therefore, staff recommends that the City Council award this project construction contract to Beador Construction. The construction bids submitted have resulted in the project appropriation of $420,000 being exceeded. As a result, to award the construction project an increased appropriation of $30,000 is required, as described below. ENVIRONMENTAL REVIEW: A Negative Declaration was prepared for Project No. 3891. The City of Carlsbad’s Planning Director approved the Negative Declaration for this project on December 30, 2001. Page 2 of Agenda Bill No, 171 413 FISCAL IMPACT: Funding for Project No. 3891 is provided from the Sewer Replacement Fund and $420,000 was appropriated on January 22, 2002 by Resolution Number 2002-037. The estimated cost associated with this project are summarized in the following table: If the City Council awards this contract to Beador Construction, consistent with the table above, the El Camino Real Sewer Pipeline, Project No. 3891 , will require an additional appropriation of $30,000 from the Sewer Replacement Fund. Based on an evaluation of the bids received, it is not expected that rebidding the project will result in a lower construction cost. The cost of the project to each benefiting property owner was established by prorating the total estimated construction cost using a ratio of the total number of equivalent dwelling units (EDU's) allowed on each parcel in relation to the total number of EDU's estimated for the benefiting service area. The total number of EDU's per parcel was determined based on existing land use zoning, with the exception that parcels having an existing residence was assumed at one EDU rather than the possible number of EDU's allowed under current zoning. The resulting reimbursement connection fee of $15,000 per EDU, established in January 2002, was determined by dividing the estimated project cost at that time ($420,000) by 28 EDU's. Recently, a ten (IO) lot Planned Residential Development (PRD) has been proposed in the benefit area which increases the number of EDU's from 28 to 30. In addition, the proposed 10 lot PRD will result in the reduction of 300 feet of 8-inch diameter sewer and four service laterals from Project 3891 through conditions requiring the developer to extend the sewer, at his cost, to each of the 10 lots. This condition is addressed in a separate agreement. The reduction in the length of the sewer is estimated to lower the construction cost from $428,300 to $404,900. Staff recommends that the cost per EDU be based on final actual costs divided by 30 EDU's. Based on 30 EDU's, and using the recommended appropriation of $450,000, the sewer connection fee would remain at $15,00O/EDU. If final project costs are lower, then the reimbursement sewer connection fee will be correspondingly adjusted lower. If additional funds are needed for unforeseen expenses, the final cost .per EDU may be higher. If additional EDU's are connected above the estimated 30 EDU's, then the resulting cost share for each property owner shall be recalculated based on actual EDU's connected and any cost reduction will be reimbursed to those property owners who already paid the sewer reimbursement fee. WHEREAS, on August 12, 2003, the City Council of the City of Carlsbad, California, approved plans and specifications for construction of the El Camino Real Sewer, Tamarack Avenue to Chestnut Avenue, Project No. 3891 ; and WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable, and in the public interest to construct the El Camino Real Sewer, Tamarack Avenue to Chestnut Avenue, Project No. 3891 ; and WHEREAS, nine sealed bids were received on October 8,2003 by the City of Carlsbad for the construction of El Camino Real Sewer, Tamarack Avenue to Chestnut Avenue, Project No. 3891 ; and WHEREAS, the lowest responsive and responsible bid received to construct Project No. 3891 was submitted by Beador Construction in the amount of $428,300; and WHEREAS, funding for Project 3891 is provided from the Sewer Replacement Fund and $420,000 was appropriated on January 22,2002 by Resolution Number 2002-037; and WHEREAS, to make up the difference between the previously appropriated amount of $420,000 and the estimated project construction cost, the appropriation for Project 3891 shall be increased by $30,000 to a total amount of $450,000. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the above recitations are true and correct. That an additional $30,000 shall be appropriated from the Sewer Replacement Fund for the project increasing the total appropriation to $450,000. 4. That the City Manager is hereby authorized to approve construction change orders up to $6,400 for Project No. 3891. 5. That the award of this contract is contingent upon Beador Construction executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) calendar days of adoption of this resolution. The City Manager may grant reasonable extensions of time. 6. That the final sewer reimbursement connection fee shall be based on the final actual project cost divided by 30 EDU's, using the distribution method shown in Table A, attached hereto and incorporated by this reference. 7. That if additional EDU's are connected above the estimated 30 EDU's, then the resulting cost share per EDU shall be recalculated based on actual EDU's connected and any resulting cost reduction will be reimbursed to those property owners who already paid the higher sewer reimbursement connection fee amount.
