TITLE ADOPTION OF A RESOLUTION AUTHORIZING THE DEPT. HD.
PLANNING DIRECTOR TO EXPEND UP TO $50,000 FOR
TELECOMMUNICATION CONSULTANTS TO ASSIST IN THE CITY ATTY.
STUDY OF PLACEMENT OF WIRELESS COMMUNICATION
FACILITIES IN THE PUBLIC RIGHT OF WAY. CITY MGR.
RECOMMENDED ACTION:
Adopt Resolution No. 2003-351 authorizing the Planning Director to expend up to
$50,000 for telecommunication consultants to assist in the study of placement of wireless
communication facilities in the public right of way.
ITEM EXPLANATION:
At the City Council meeting of December 9, 2003, the Council adopted an urgency
ordinance prohibiting the issuance of permits for the placement of wireless communication
facilities in the public right of way and adopted a resolution directing the Planning Director
and staff to conduct a study and make recommendations regarding siting of wireless
communication facilities in the public right of way. The accompanying agenda bill also
requested that authorization be made to expend an amount not to exceed $50,000 for the
assistance of outside counsel and engineering experts specializing in telecommunications
facilities. That authorization was inadvertently deleted from Resolution No. 2003-321, which
authorized the study.
The attached resolution for Council’s consideration authorizes those expenditures.
FISCAL IMPACT:
In drafting the proposed zone code amendments and policy regulations staff will require the
assistance of outside counsel and outside engineering consultants with expertise in the field
of telecommunications at an unknown cost. Staff is requesting authorization to make the
necessary expenditures, in an amount not to exceed $50,000.

The adoption of this resolution is statutorily exempt from environmental review at this time
per section 15262 of the California Environmental Quality Act.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AUTHORIZING
EXPENDITURES FOR TELECOMMUNICATION
CONSULTANTS TO ASSIST IN THE STUDY OF
PLACEMENT OF WIRELESS COMMUNICATION FACILITIES IN THE PUBLIC RIGHT OF WAY
WHEREAS, the City Council has adopted Urgency Ordinance No.
VS-684 on December 9, 2003 pursuant to Government Code sections 65858 and
36937, prohibiting the issuance of permits for the placement of wireless
2ommunication facilities in the public right of way; and
WHEREAS, the City Council simultaneously adopted Resolution of
ntention No. 2003-321 directing the Planning Director and staff to study and make
.ecomrnendations regarding the siting of wireless communication facilities in the
iublic right of way; and
WHEREAS, staff was previously requesting at the hearing on
lecember 9, 2003 authorization to expend amounts not to exceed $50,000 for
elecommunications outside counsel and outside engineering consultants, which
iuthorization was inadvertently omitted from Resolution No. 2003-321,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
3ty of Carlsbad, California, as follows:

That the above recitations are true and correct;
That $50,000 be transferred from the Council contingency account to
account 001 9003741 0 and expenditures authorized as necessary,
upon approval by the City Attorney, to support the study and
recommendations approved in Resolution No. 2003-321 as
referenced above.
