RECOMMENDED ACTION:
That the Council INTRODUCE Ordinance No. NS-678 , APPROVING Zone Change ZC
03-07, and ADOPT Resolution No. 2004-026 ADOPTING a Negative Declaration, and
APPROVING Zone Change ZC 03-07 and Local Coastal Program Amendment LCPA 03-08, based
on the findings and subject to the conditions contained therein.
ITEM EXPLANATION:
The current zoning designation on the site is a holding zone, Limited Control (L-C), which is
intended to undergo a zone change once development planning is initiated. While the site currently
has Water District uses, this project will replace the L-C zone with a Single Family Residential zone
(R-1). Public uses and buildings, such as those that exist and are proposed for the site, may be
approved in R-1 zones with the approval of a conditional use permit. In addition, the zone change to
R-1 is consistent with the provisions of the area’s Zone 20 Specific Plan which outlined the need to
change the Limited Control zone to an R-1 zone for this property, with CUP approval for its public
uses.
The zone change, therefore, is consistent with the area’s specific plan and does not conflict with any
General Plan designations, zoning ordinance requirements or other City policies or regulations. The
City’s Water District, acting as the property’s owner, requested the zone change and local coastal
program amendment to allow for the improvements entitled by CUP 03-1 5 and CDP 03-23.
While Planning Commission action is final for CUP 03-15 and CDP 03-23, those approvals are not
effective until the City Council takes action to approve the related zone change and LCP
amendment requests (ZC 03-07 and LCPA 03-08) and until the Coastal Commission takes action to

approve LCPA 03-08 after City Council action. The Planning Commission vote of October 1, 2003
was 4-0 (three Commissioners absent) to approve CUP 03-15 and CDP 03-23 and to recommend
approval of ZC 03-07 and LCPA 03-08. The LCPA will be submitted to Coastal Commission staff for
processing after Council consideration of the zone change and LCP amendment.
ENVIRONMENTAL:
Based on an environmental impact assessment conducted by staff, the Planning Director prepared
a Negative Declaration which was recommended for adoption on October 1, 2003. No written
comments were received during the 30-day public review period.
FISCAL IMPACT:
No fiscal impacts are associated with this zone change or local coastal program amendment request
since it corrects the land use designation for this site, which already accommodates Water District
infrastructure and uses. The future work related to CUP 03-15 and the recycled water pump station
is already budgeted within Public Works, so adverse fiscal impacts will not be incurred by the City.

SECTION 11: That the findings and conditions of the Planning Commission as
set forth in Planning Commission Resolution 5470 constitute the findings and conditions of the
City Council.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a publication of general circulation in the City of Carlsbad within
fifteen days after its adoption. (Not withstanding the preceding, this ordinance shall not be
effective within the City’s Coastal Zone until LCPA 03-08 is approved by the California Coastal

PROJECT DESCRIPTION: Recycled Water Pump Station (under 800 square feet with 17
foot height) plus related equipment and features and inclusion of the existing Water District tanks
and facilities into one Conditional Use Permit (CUP 03-15).
PROPOSED DETERMINATION: The City of Carlsbad has conducted an environmental
review of the above described project pursuant to the Guidelines for Implementation of the
California Environmental Quality Act and the Environmental Protection Ordinance of the City of
Carlsbad. As a result of said review, the initial study (EM Part 2) did not identify any potentially
significant impacts on the environment. Therefore, a Negative Declaration will be
recommended for adoption by the City of Carlsbad City Council.
A copy of the initial study (EM Part 2) documenting reasons to support the proposed Negative
Declaration are on file in the Planning Department, 1635 Faraday Avenue, Carlsbad, California
92008. Comments fkom the public are invited. Please submit comments in writing to the

I find that although the proposed project could have a significant effect on the environment, there will not
be a significant effect in this case because the mitigation measures described on an attached sheet have been
added to the project. A MITIGATED NEGATIVE DECLARATION will be prepared.
I find that the proposed project MAY have a significant effect on the environment, and an
ENVIRONMENTAL IMPACT REPORT is required.
I find that the proposed project MAY have “potentially significant impact(s)” on the environment, but at

ENVIRONMENTAL IMPACTS
STATE CEQA GUIDELINES, Chapter 3, Article 5, Section 15063 requires that the City conduct an
Environmental Impact Assessment to determine if a project may have a significant effect on the
environment. The Environmental Impact Assessment appears in the following pages in the form of a
checklist. This checklist identifies any physical, biological and human factors that might be impacted by
the proposed project and provides the City with information to use as the basis for deciding whether to
prepare an Environmental Impact Report (EIR), Negative Declaration, or to rely on a previously
approved EIR or Negative Declaration.
e A brief explanation is required for all answers except “No Impact” answers that are adequately
supported by an information source cited in the parentheses following each question. A “No
Impact” answer is adequately supported if the referenced information sources show that the
impact simply does not apply to projects like the one involved. A “No Impact” answer should be
explained when there is no source document to refer to, or it is based on project-specific factors
as well as general standards.
e “Less Than Significant Impact” applies where there is supporting evidence that the potential
impact is not significantly adverse, and the impact does not exceed adopted general standards
and policies.
e “Potentially Significant Unless Mitigation Incorporated” applies where the incorporatiop of
mitigation measures has reduced an effect from “Potentially Significant Impact” to a “Less Than
Significant Impact.” The developer must agree to the mitigation, and the City must describe the
mitigation measures, and briefly explain how they reduce the effect to a less than significant
level.
e “Potentially Significant Impact” is appropriate if there is substantial evidence that an effect is
significantly adverse.
Based on an “EM-Part 11”, if a proposed project could. have a potentially significant adverse
effect on the environment, but 3 potentially, significant adverse effects (a) have been analyzed
adequately in an earlier EIR or Mitigated Negative Declaration pursuant to applicable standards
and (b) have been avoided or mitigated pursuant to that earlier EIR or Mitigated Negative
Declaration, including revisions or mitigation measures that are imposed upon the proposed
project, and none of the circumstances requiring a supplement to or supplemental EIR are present
and all the mitigation measures required by the prior environmental document have been
incorporated into this project, then no additional environmental document is required.
e When “Potentially Significant Impact” is checked the project is not necessarily required to
prepare an EIR if the significant adverse effect has been analyzed adequately in an earlier EIR
pursuant to applicable standards and the effect will be mitigated, or a “Statement of Overriding
Considerations” has been made pursuant to that earlier EIR.
0 A Negative Declaration may be prepared if the City perceives no substantial evidence that the
project or any of its aspects may cause a significant adverse effect on the environment.
e If there are one or more potentially significant adverse effects, the City may avoid preparing an

DISCUSSION OF ENVIRONMENTAL EVALUATION
AESTHETICS
The project involves a 17-foot high structure with about 800 square feet of floor area to house the
proposed reclaimed water pump. The pump station structure will be architecturally designed and will be
located over 105 feet from the Black Rail public roadway. It will be located between two of the existing
onsite water tanks, which measure over 50 feet in height, The proposed project, therefore, will not create
any significant aesthetic impacts.
AGRICULTURAL RESOURCES
The site has been used as a public facility site for the City’s Water District for over 20 years. No
agricultural resources are located on-site. However, historically the site was farmed and must pay an
agricultural conversion fee for the property’s acreage prior to building permit issuance. The fee will be
based on the Council approved agricultural conversion fee per the current Fee Schedule at time of
building issuance. This provision will be condition of approval for the project’s conditional use and
coastal development permits
AIR QUALITY-Would the project:
a) Conflict with or obstruct implementation of the applicable air quality plan?
No Impact. The project site is located in the San Diego Air Basin which is a federal and state non-
attainment area for ozone (03), and a state non-attainment area for particulate matter less than or equd to
10 microns in diameter (PMlo). The periodic violations of national Ambient Air Quality Standards
(AAQS) in the San Diego Air Basin (SDAB), particularly for ozone in inland foothill areas, requires that
a plan be developed outlining the pollution controls that will be undertaken to improve air quality. In
San Diego County, this attainment planning process is embodied in the Regional Air Quality Strategies
(RAQS) developed jointly by the Air Pollution Control District (APCD) and the San Diego Association
of Governments (SANDAG).
A plan to meet the federal standard for ozone was developed in 1994 during the process of updating the
1991 state-mandated plan. This local plan was combined with plans from all other California non-
attainment areas having serious ozone problems and used to create the California State Implementation
Plan (SIP). The SIP was adopted by the Air Resources Board (ARB) after public hearings on November
9th through 10th in 1994, and was forwarded to the Environmental Protection Agency (EPA) for
approval. After considerable analysis and debate, particularly regarding airsheds with the worst smog
problems, EPA approved the SIP in mid-1996.
The proposed project relates to the SIP and/or R4QS through the land use and growth assumptions that
are incorporated into the air quality planning document. These growth assumptions are based on each
city’s and the County’s general plan. If a proposed project is consistent with its applicable General Plan,
then the project presumably has been anticipated with the regional air quality planning process. Such
consistency would ensure that the project would not have an adverse regional air quality impact.
Section 15 125(B) of the State of California Environment Quality Act (CEQA) Guidelines contains
specific reference to the need to evaluate any inconsistencies between the proposed project and the
applicable air quality management plan. Transportation Control Measures (TCMs) are part of the RAQS.
The R4QS and TCM plan set forth the steps needed to accomplish attainment of state and federal
ambient air quality standards. The California Air Resources Board provides criteria for determining
whether a project conforms with the RAQS which include the following:
Is a regional air quality plan being implemented in the project area?

Is the project consistent with the growth assumptions in the regional air quality plan?
The project area is located in the San Diego Air Basin, and as such, is located in an area where a RAQS
is being implemented. The project is consistent with the growth assumptions of the City’s General Plan
and the RAQS. Therefore, the project is consistent with the regional air quality plan and will in no way
conflict or obstruct implementation of the regional plan.
a) Violate any air quality standard or contribute substantially to an existing or projected
air quality violation?
Less Than Significant Impact. The closest air quality monitoring station to the project site is in the
City of Oceanside. Data available for this monitoring site through April, 2002 indicate that the most
recent air quality violations recorded were for the state one hour standard for ozone (one day in both
2000 and 200 1) and one day in 2001 for the federal 8-hour average for ozone and one day for the 24-hour
state standard for suspended particulates in 1996. No violations of any other air quality standards have
been recorded recently. (Add the following text addressing short-term emissions, if there is grading
associated with the project.) The project would involve minimal short-term emissions associated with
grading and construction. Such emissions would be minimized through standard construction measures
such as the use of properly tuned equipment and watering the site for dust control. Long-term emissions
associated with travel to and from the project will be minimal. Although air pollutant emissions would
be associated with the project, they would neither result in the violation of any air quality standard
(comprising only an incremental contribution to overall air basin quality readings), nor contribute
substantially to an existing or projected air quality violation. Any impact is assessed as less than
significant.
b) Result in a cumulatively considerable net increase of any criteria pollutant for which
the project region is non-attainment under an applicable federal or state ambient air
quality standard?
Less Than Significant Impact. The Air Basin is currently in a non-attainment zone for ozone and
suspended fine particulates. The proposed project would represent a contribution to a cumulatively
considerable potential net increase in emissions throughout the air basin. As described above, however,
emissions associated with the proposed project would be minimal. Given the limited emissions
potentially associated with the proposed project, air quality would be essentially the same whether or not
the proposed project is implemented. According to the CEQA Guidelines Section 15130 (a)(4), the
proposed project’s contribution to the cumulative impact is considered de wzini~nnus. Any impact is
assessed as less than significant.
c) Expose sensitive receptors to substantial pollutant concentrations?
No Impact. As noted above, the proposed project would not result in substantial pollutant emissions or
concentrations. In addition, there are no sensitive receptors (e.g., schools or hospitals) located in the
vicinity of the project. No impact is assessed.
d) Create objectionable odors affecting a substantial number of people?
No Impact. The construction of the proposed project could generate fumes from the operation of
construction equipment, which may be considered objectionable by some people. Such exposure would
be short-term or transient. In addition, the number of people exposed to such transient impacts is not
considered substantial.

BIOLOGICAL RESOURCES / CULTURAL RESOURCES
Since the site is already in a developed state with a pre-graded pad for a future water tank, the proposed
project including the location of the recycled water pump station and related features and equipment will
not impact any sensitive biological resources; likewise, no cultural resources exist on this developed site.
GEOLOGY/SOILS
Given the existing uses on the property (over 10 million gallons of water could be stored onsite between
the three existing tanks, no geologic instability or soils issues exist.
HAZARDSlHAZARDOUS MATERIALS \
A Hazardous Waste and Substances Statement was submitted and signed by Public Works that the
operation will not the use of any materials on the Hazardous Wastes and Substances Sites list complied
by the California Environmental Protection Agency pursuant to Government Code Section 65962.5.
Given the Statement and the proposed project to construct recycled water facilities, there will not be any
significant impacts to the environment from hazards or hazardous materials.
HYDROLOGYDVATER QUALITY
The site is pre-graded and designed to meet current City Engineering standards. There are no significant
watercourses, drainage flow, creeks or underground water tables that could be adversely impacted by the
proposed project.
LAND USE PLANNING
The Limited Control prohibits development without a zone change to a zoning district that would be
consistent with the underlying General Plan designation. This project proposes to do that via Zone
Change 03-07 to replace the LC zone with the R-1 zone. The R-1 zone is consistent with the underlying
RLM General Plan designation and allows public buildings via the approval of a conditional use permit
(CUP 03-15). The proposed project will not have a significant impact on land use planning efforts in the
area
MINERAL RESOURCES
No mineral resources area located onsite and the project does not propose the use of mineral resources.
NOISE
The pump station will not be a loud nois.: generating use and no sensitive noise receptors (single family
houses) are located within 200+ feet.
POPULATION AND HOUSING
Despite the proposed R-1 zoning and underlying RLM General Plan designation of the site, population
and housing impacts will not occur since the site has long been recognized as a Water District facility
that will not generate any residential uses. This is reiterated in the Zone 20 Specific Plan which covers
this site.
PUBLIC SERVICES / UTILITIES AND SERVICE SYSTEMS
Development of this project will assist the City in providing public services compliant with the Growth
Management Ordinance so there will not be any adverse impacts to Public Services.

RECREATION
No recreational opportunities exist onsite or are intended by the Zone 20 Specific Plan, or onsite land use
designations. No impacts to recreational resources will be created by this project.
TRANSPORTATION/TRAFFIC-Would the project:
a) Cause an increase in traffic that is substantial in relation to the existing traffic load and
capacity of the street system?
Less Than Significant Impact. The project will generate less than 500 Average Daily Trips (ADT).
Black Rail Road is designed to accommodate the existing traffic volume and the design capacity
respectively. While the increase in traffic from the proposed project may be slightly noticeable, the street
system has been designed and sized to accommodate traffic from the project and cumulative development
in the City of Carlsbad. The proposed project would not, therefore, cause an increase in traffic that is
substantial in relation to the existing traffic load and capacity of the street system. The impacts from the
proposed project are, therefore, less than significant.

the county congestion management agency for designated roads or highways?
Less Than Significant Impact. SANDAG acting as the County Congestion Management Agency has
designated three roads (Rancho Santa Fe Rd., El Camino Real and Palomar Airport Rd.) and two
highway segments in Carlsbad as part of the regional circulation system. The Existing and Buildout

The Congestion Management Program’s (CMP) acceptable Level of Service (LOS) standard is “E”, or
LOS “F” if that was the LOS in the 1990 base year (e.g., SR 78 in Carlsbad was LOS “F” in 1990).
Accordingly, all designated roads and highways are currently operating at or better than the acceptable
standard LOS.
Note that the buildout ADT projections are based on the full implementation of the region’s general and
community plans. The proposed project is consistent with the general plan and, therefore, its traffic was

of the Mello I1 segment of the Carlsbad Local Coastal Program not being amended by
this amendment, in that the zone change to R-1 will bring the site into consistency
between General Plan, LCP and zoning designations. The zone change will not
create any coastal resource or shoreline access issues since the site is not in close
proximity to the ocean or a lagoon.
2. That the proposed amendment to the Mello I1 segment of the Carlsbad Local Coastal
Program is required to bring it into consistency with the City’s General Plan.
3. The site is in the Agricultural Overlay Zone since the property historically had
agricultural uses and is on the City map for properties that are required to pay an
agricultural conversion fee. This project will be conditioned in the CUP resolution
to pay this fee prior to the issuance of any building or grading permit.

generally located south of Poinsettia Lane, on the east side of Black Rail Road, in
the Coastal Zone, within Local Facilities Management Zone 20 and the southwest
quadrant .
I. RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolution No. 5475
RECOMMENDING ADOPTION of a Negative Declaration, and ADOPT Planning
Commission Resolutions No. 5470, 5471 , 5443 and 5444 RECOMMENDING APPROVAL
ZC 03-07 and LCPA 03-08, and APPROVING CUP 03-15 and CDP 03-23, respectively, based
on the findings and subject to the conditions contained therein.
11. INTRODUCTION
The Carlsbad Municipal Water District currently owns and maintains a 4.4-acre reservoir site
with two 1.25 million gallon (MG) tanks, one 8.5 MG tank with a graded pad to accommodate
one more 8.5 MG tank in the future, a chlorine storage and injection facility, and a pressure
reducing station. The large tank holds potable water and the two smaller tanks (known as Twin
D) contain recycled, or reclaimed water. The site is currently fenced and secured, and is shown
on the Location Map (Attachment 6).
The proposal involves the construction, operation and maintenance of a recycled water pump
station on the site, related piping and a surge tank. The pump station will facilitate recycled
water services within the city. This facility will allow recycled water to be pumped to upper
pressure zones and high elevation sites within the City, as well as allow the reduction of pressure
from higher pressure zones for recycled water use in lower pressure zones.
Existing zoning on the site is Limited Control (LC) which does not allow for any development
unless a zone change is proposed consistent with the underlying General Plan designation. The
General Plan Land Use designation for the project site is Residential Low to Medium Density

(RLM). The L-C zone will be replaced with R-1 (Single-Family Residential) zoning, which
allows for public facilities with a conditional use permit approval.
Because a Zone Change (ZC) is required to remove the L-C zoning, a corresponding Local
Coastal Program Amendment (LCPA) is needed due to the project site’s location in the coastal
zone. A Conditional Use Permit (CUP) is required for the project as well as a Coastal
Development Permit (CDP). Planning Commission has final action on the Conditional Use and
Coastal Developments while the Zone Change and Local Coastal Program Amendment will be
considered by City Council. The project is depicted on Exhibits “A” - “F’ dated October 1,
2003.
111. PROJECT DESCRIPTION AND BACKGROUND
The proposed recycled water pump station structure is approximately 17.5 feet in height with a
total area of approximately 792 square feet. The structure will be architecturally treated with
colored and split face block masonry walls, and a limestone coping roof trim. The proposed
location onsite sets it back over 100 feet from Black Rail Road. Existing and proposed
landscaping will adequately screen the pump station from public views. The pump station will
house pumping units and related electrical and mechanical equipment. The pump station will be
capable of assisting with the supply of recycled water to various areas of the city with a pumping
capacity of 4,500 gallons per minute.
A surge tank is also proposed for a location between the existing recycled water and potable
water reservoir tanks, as shown on the project exhibits. The 20-foot long cylindrical tank will
have a 7,500-gallon capacity with an 8-foot diameter. The frontage of the property is currently
unimproved; a condition of the project will be the construction of street improvements along the
Black Rail Road frontage.
The existing facilities onsite that will be included with this CUP include:
two recycled water reservoir tanks each with a 1.25 million gallon (MG) capacity;
one potable water reservoir tank with a capacity of 8.5 MG; and
one prefabricated chlorine building and scrubber facility.
The project is subject to the following:

IV. ANALYSIS
The staff recommendation for approval was developed by analyzing the proposal’s consistency
with applicable policies and regulations. Compliance is summarized below. 313

A. Zoning Ordinance
The site’s zoning designation is L-C which is inconsistent with existing General Plan and LCP
designation of RLM. The L-C zone is designed to be an interim holding zone until planning for
the area has been completed. The Zone 20 Specific Plan notes that this site has L-C zoning
despite the fact that it has accommodated water storage and service facilities for over 20 years.
Zone Change 03-07 will designate the site as R-1 and therefore will achieve consistency with
existing General Plan and LCP designations as well as implement the Zone 20 Specific Plan
provisions applicable to this site and its uses.
B. General Plan / Local Coastal Program
The site’s General Plan and Local Coastal Plan designation is Residential Low Medium (RLM),
however, the 4.4-acre site has been a City reservoir site for over 20 years. A CUP allows the
proposed facilities on R-1 zoned properties. Since the primary function of the site is the delivery
of water services, it is vital for the development and well being of the community and the City in
general. The project is consistent with the City’s General Plan and Local Coastal Program
designations assuming the Zone Change (ZC 03-07) proposal is also approved. The Local
Coastal Plan (LCP) zoning designation is also L-C, so to implement the R-1 designation, a
corresponding Local Coastal Program Amendment (LCPA 03-08) is required to adjust the site’s
zoning designation.
C. Conditional Uses
A CUP is required for the proposed water pump station and all of the required findings for a CUP
can be made. Below is a summary of the required findings as contained in Planning Commission
Resolution No. 5443.
The requested use is necessary and desirable for the development of the community in that it will
enhance the City’s infrastructure in supplying reclaimed water for future needs. This will
augment potable water supplies and infrastructure. In addition, the use is consistent with the
General Plan, including Coastal Zone provisions, and will not impact existing or future permitted
uses in the area since the site is already accommodating three large water reservoir tanks and is
secured from public access or trespassing. All the uses on the existing reservoir site will now be
covered by this CUP.
The existing uses onsite have performed a necessary function for the City by providing storage
capacity for over 10 million gallons of water onsite for more than 20 years. This site, with
existing and proposed facilities, will continue to be necessary and desirable for the development
of the community.
The site is adequate in size and shape to accommodate the proposed use without impacting other
existing or future planned improvements to the site. There will not be any visual impacts since
the pump station will be enclosed in a building with design features as depicted on Exhibit “D.”
The building will have three split faced block wall colors including white, white with pumice, 44

and terracotta. An aluminum tenacotta colored sunscreen awning will be located on the west and
south elevations, and a mocha creme limestone coping will run along the structures base and roof
line. Landscaping will be provided and the site allows for the placement of the pump station
over 100’ away from the public street.
All of the yards, setbacks, walls, landscaping and other features necessary to adjust this use to
existing future permitted uses in the area will be provided and maintained, such as the
landscaping and access to the site (limited to City staff). The use will be adequately screened
from pubic views and operated by City staff that already maintains the site.
The Black Rail Road street system, with the frontage improvements required of this project, will
be adequate to handle the traffic generated by this project since only City staff will access the
site; general public use or access is not needed nor proposed.
B. D. Coastal Development Permit
Since the site is located in the City’s Coastal Zone and the proposed project constitutes
development in the coastal zone, a CDP is required. However, given the site’s location away
from any sensitive coastal resources or vegetation, no coastal resource issues exist. There are no
steep slopes with native vegetation proposed for development. In addition, the project site
location precludes any shoreline access opportunities. Drainage of the site will continue to be
controlled by the City’s stormwater permit requirements, standard City construction practices,
monitoring and inspections.
The property is required to pay an agricultural mitigation fee for the retroactive conversion from
historic farming uses to the public infrastructure uses currently onsite. A condition within the
CUP resolution requires this payment to maintain compliance with the provisions of the City’s
Coastal Agriculture Overlay Zone (2 1.202 of the zoning ordinance).
This project will not impact coastal resources or shoreline access and is recommended for
approval by staff as being in compliance with the City’s coastal development permit and Local
Coastal Program provisions based upon the approval of LCPA 03-08 which accompanies this
project .
V. ENVIRONMENTAL REVIEW
The project will not create any significant environmental impacts since the site is already
developed with long-standing Water District facilities and water tanks. The Planning Director
issued a Notice of Intent to Adopt a Negative Declaration in conjunction with this project on
August 28,2003. A thirty-day public review commenced and no comments were received.

3. ZC 03-07/CLPA 03-08/CUP 03-IMCDP 03-23 - TWIN D RECYCLED WATER PUMP STATION -
Request for a recommendation of approval of a Negative Declaration, Zone Change and Local
Coastal Program Amendment from Limited Control (LC) to Single-Family Residential (R-1 ), and
approval of a Conditional Use Permit and Coastal Development Permit to construct and operate a
recycled water pump station, and to formalize existing water storage and service facilities, on an
existing 4.4-acre Water District reservoir site on property generally located south of Poinsettia
Lane, on the east side of Black Rail Road, in the Coastal Zone, within Local Facilities
Management Zone 20 and the southwest quadrant.
Mr. Neu introduced Item 3 and stated that Senior Planner, Eric Munoz, would make the presentation assisted by Associate Engineer, Frank Jimeno.
Chairperson Baker asked Mr. Munoz if he wished to continue with only four Commissioners present. He
stated that the Public Works Department would like to proceed. Chairperson Baker opened the public
hearing on Item 3.
Senior Planner, Eric Munoz, presented the Staff Report stating that the Twin D Recycled Water Pump
Station and related entitlements pertained to a project site on the east side of Black Rail Road, south of
Poinsettia Lane. The site currently accommodates three tanks, two 1.25 MG tanks, and one 8.5 MG tank
of potable water. The two smaller tanks contain recycled water. The site has a large graded circular pad
in the southeast corner to accommodate a large water tank in the future. This proposal is to consolidate
all of the existing Water District uses into one Conditional Use Permit. There is not a CUP existing
currently for the site. The specific project that triggered this action was the recycled water pump station. It would house the pump for the recycled water pump station, piping, a surge tank, and underground
pipes that go offsite. The project requires a CUP to formalize the existing Water District uses on the site.
It is also in the Coastal Zone, so requires a Coastal Development Permit. All the findings for those
permits can be made. The zoning on the site, however, does require a change from the current Limited
Control Zone to R-1 Zone. The Zone 20 Specific Plan acknowledges this site as a Water District site and
recommends that a Zone Change be made from the Limited Control Zone to an R-1 Zone, not to allow
residential development, but rather to allow a Conditional Use Permit so that the site can be permitted for
the public infrastructure uses that it provides. The Zone Change also needs to go through the Coastal
Commission, so this project does have a Zone Change and a Local Coastal Program Amendment, both
to go onto the City Council if the Planning Commission recommends approval. The Conditional Use
Permit and Coastal Development Permit will have the final approval at the Planning Commission,
however, those entitlements will be based on the ultimate approval by the City Council.
Commissioner Heineman asked if it would be terribly expensive to put stucco on the outside of the ugly
blocks. Mr. Munoz stated that it would be possible and stated that the pump station was designed with
the intent of providing aesthetic beauty to the area. The materials used include three split-face block wall
colors in combination to provide architectural design to the building. The location of the building’s
footprint from Black Rail Road is about 107 ft. There is a narrow window looking into the site. The view
from Black Rail Road is fairly limited. With the existing landscaping and the existing cell tower that
protrudes and dominates the site visually, there are no plans to further enhance the building.
Chairperson Baker asked if Carlsbad had a zone for public utilities. Mr. Munoz stated it did. Chairperson
Baker asked why this property was being zoned R-1 instead of public utilities. Mr. Munoz replied that it
was primarily because the governing Zone 20 Specific Plan identified it as a public use site and
recommended that it become R-1 . So, changing it to R-1 would be consistent with the existing governing Specific Plan for this area and specifically for this property. Chairperson Baker asked if this property was
zoned public utilities, if it would need a Conditional Use Permit. Mr. Munoz said no, it would possibly
need a Specific Plan Amendment. Another issue with the public utility zone was that the power plant has
Public Utility zoning and required a precise development plan, and he didn’t think that there had ever
been such a plan filed in the City for that zone and that use. The precise development plan is very
detailed and perhaps beyond the scale of the improvements for this site.
Chairperson Baker asked if it was in a public utility zone if the CUP would need to be renewed
periodically. Mr. Munoz answered no, that it would be a permitted use in that zone.

Commissioner Whitton asked if there were any other areas in Carlsbad such as this that haven’t yet been
zoned properly and that the Planning Commission should address. Mr. Munoz said that there was a
cluster of them. Another example was the County Animal Shelter which has the LC zone. There are still
a few patches of property in the City that have the Limited Control zoning.
Chairperson Baker asked if the other sites in Carlsbad that had water tanks, Skyline for example, were
zoned residential. Mr. Munoz stated that most of them did have a residential General Plan designation as
well as zoning, but the Conditional Use Permit process allowed those uses on those residential
designated properties. Most of those water tanks are under CUPS.
Commissioner Heineman asked Chris Muehlbacher from the City of Carlsbad Water District what would
be involved in improving the appearance of the pump station. Mr. Muehlbacher stated that what was
presented was conceptually aesthetically pleasing for the site, but they would be willing to change the
appearance. Commission Heineman stated that even with the trees, the station was highly visible from
Black Rail Road, where a new development is being built. Mr. Neu stated that some preliminary projects
had been submitted for west of Black Rail Road. He added that the building materials for a pump station needed to be quite durable and stucco was not as durable as the split-face block. Mr. Munoz stated that
Staff would be open to suggestions, and that they would let Public Works decide if they wanted to accept
them. Commissioner Heineman stated that he would like to see something done to it to make it more
attractive as he thought that of the other pump stations in Carlsbad, this was one of the worst looking.
Commissioner White stated that she had no objections to the appearance. Commissioner Whitton stated
that he thought it looked fine. Chairperson Baker stated that the appearance didn’t bother her, either.
Ms. Mobaldi clarified that there was no expiration on this CUP.
Chairperson Baker opened public testimony and invited those who would like to speak to the podium.
Porta McKesson, 6610 Citeo Cedrella, Carlsbad, stated that she lived right below this site on the first CUI-
de-sac. She asked what the increase in the noise factor would be, as they already hear when the water
is filled in the tanks day or night.
Mr. Munoz stated that this project was submitted by Public Works and did not have a noise study
included, but would be compliant with the City’s noise policy. Mr. Muehlbacher stated that there would be three vertical turbine pumps in the station enclosed inside the masonry structure. The structure was
being designed to be in compliance with the noise ordinance.
Chairperson Baker asked if the pumps would be heard running 100 ft away, 10 ft away, 200 ft away. Mr.
Muehlbacher stated that there would be more noise from the street than you would expect from the pump
station. There are two exhaust fans on top of the structure and from 100 ft away it would not likely be
heard. Chairperson Baker asked if they could be heard turning on and off. Mr. Muehlbacher stated that
they did cycle, but that that could not be heard.
Commissioner Whitton asked if only one pump would be working at a time. Mr. Muehlbacher stated that
there were three total and, depending on the demand, one or all could be working.
Chairperson Baker asked when during the day the pumps would likely be running. Mr. Muehlbacher
replied that the usage of recycled water was in the evening hours, so the majority of the flows would
occur during the day transferring water to the upper reservoirs, and that zone would typically be fed by gravity. There might be operational conditions where the pumps need to be running at the same time in
the evening, but more typically it would be in the daytime.
Commissioner Whitton asked how much noise would be generated if all three pumps were working at the
same time. Mr. Muehlbacher stated that that sound should not be able to be heard beyond the street 107
ft away. It would be about 140 ft to the property line.
Chairperson Baker closed the public hearing and asked for a motion.

Commission adopt Planning Commission Resolution No. 5475 recommending

03-08, and approving CUP 03-15 and CDP 03-23, respectively, based upon the
findings and subject to the conditions contained therein.
