RECOMMENDED ACTION: Introduce Ordinance No. NS-694 hour speed limit from Glasgow Drive to its intersection with Woodstock Street. to establish upon Middleton Drive a prima facie 25 mile per ITEM EXPLANATION: Middleton Drive is a short, curvilinear, low volume street in the residential development called The Cape at Calavera Hills. The Homeowner's Association asked that speed limit signs be installed. Before the signs can be installed, a prima facie speed limit must first be established. Middleton Drive is 0.18 miles in length and serves residential units located on streets that intersect with Middleton Drive. Although located in a residential area, Middleton Drive does not qualify as a residence district. Therefore, the prima facie speed limit must be established based upon the results of an Engineering and Traffic Survey. Middleton Drive has a curb-to-curb width of 32 feet with parking allowed on the southerly side only. Six private streets intersect Middleton Drive and the two-way, 24-hour average daily traffic (ADT) volume on Middleton Drive is 668 vehicles based upon a traffic count conducted on November 5, 2003. No traffic collisions have been reported on Middleton Drive for the two-year period ending December 31,2003. Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on December 1, 2003, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon Middleton Drive. The Commission recommended by a 4-0 vote that a 25 mile per hour prima facie speed limit be established upon Middleton Drive from Glasgow Drive to Woodstock Street. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. FISCAL IMPACT: Installing two speed limit signs upon Middleton Drive will cost about $250. EXHIBITS: 1. Location Map. 2. NS-694 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.720 TO ESTABLISH UPON MIDDLETON DRIVE A PRIMA FACIE 25 MILE PER HOUR SPEED LIMIT FROM GLASGOW DRIVE TO ITS INTERSECTION WITH WOODSTOCK STREET. The City Council of the City of Carlsbad, California, hereby ordains as follows: , SECTION 1 : That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by the addition of Section 10.44.720 to read as follows: "1 0.44.720 Middleton Drive. Upon Middleton Drive from Glasgow I Drive to its intersection with Woodstock Street, the prima facie speed limit shall be twenty-five miles per hour." 11 12 13 ' 14 15 16 17 18 19 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (1 5) days after its adoption.
