ENG CITY OF CARLSBAD - AGENDA BILL TITLE: ESTABLISH A PRIMA FACIE SPEED LIMIT UPON PASEO ACAMPO DEPT. HD. CITY ATTY. RECOMMENDED ACTION: Introduce Ordinance No. NS-698 hour speed limit from Rancho Bravado to Paseo Hermosa. to establish upon Paseo Acampo a prima facie 25 mile per ITEM EXPLANATION: This item was initiated by a local resident. Paseo Acampo is a short, public street serving single-family and multi-family dwelling units in the Rancho Carrillo development near Palomar Airport Road. At its intersection with Paseo Hermosa, Paseo Acampo continues northerly as a private street into the Serrano apartment complex. Paseo Acampo is 40 feet wide and the public street portion is about 423 feet in length. Parking is allowed on both sides of the street. The street has been constructed with curb and gutter, sidewalks, and street lights to meet City of Carlsbad Engineering Design Standards. In December 2003, a traffic count recorded a 24-hour two-way volume of 2,138 vehicles. A speed survey conducted on Paseo Acampo on December 10, 2003 found the 85'h percentile speed, commonly called the critical speed, to be 29 miles per hour. The critical speed is the speed at which 85 percent of the vehicles are traveling at or below. Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on January 5, 2004, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon Paseo Acampo. The Commission recommended by a 3-1 vote that a 25 mile per hour prima facie speed limit be established upon Paseo Acampo from Rancho Bravado to Paseo Hermosa. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. FISCAL IMPACT: Installing two speed limit signs upon Paseo Acampo will cost about $250. EXHIBITS: 1. Location Map. 2. NS-698 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF SECTION 10.44.730 TO ESTABLISH UPON PASEO ACAMPO A PRIMA FACIE 25 MILE PER HOUR SPEED LIMIT FROM RANCHO BRAVADO TO ITS INTERSECTION WITH PASEO HERMOSA. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended ~y the addition of Section 10.44.730 to read as follows: “1 0.44.730 Paseo Acampo. Upon Paseo Acampo from Rancho Bravado to its intersection with Paseo Hermosa, the prima facie speed limit shall be twenty-five miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (1 5) days after its adoption.
