RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2004-087 , APPROVING the initiation of a General Plan Amendment, Local Coastal Program Amendment and Zone Code Amendment to allow
large format retail uses, with the approval of a conditional use permit, in commercial and industrial
land use designations and zones.
ITEM EXPLANATION:
On January 21, 2004, the City Council conducted a workshop to consider alternatives to provide
more opportunities for large format retail (LFR) uses (Le. Lowes, Home Depot, Fry’s Electronics, etc.)
within the city. Staff presented a map with several sites where a LFR use could potentially be
located. Based on City Council discussion and comments, staff concluded that a majority of the
Council was interested in considering ways to provide more opportunities for LFR uses within the city.
In addition, there were some Council members who expressed a willingness to consider allowing
such uses on a broad range of sites (such as along the Palomar Airport Road corridor east of El
Camino Real) vs. one particular site.
Based on Council’s discussion and comments during the workshop, staff has prepared a resolution
of intention to initiate the process to amend City policies to allow more opportunities for the location
of LFR uses within the city. Below is a summary of three alternatives that the Council may wish to
consider, with Alternative 1 and location criteria “A being staffs recommendation. Exhibit 2
(attached) provides more information and analysis of each alternative.
Alternative 1: Amend General Plan, zoning and local coastal program policies and regulations to
allow LFR uses, with the approval of a conditional use permit (CUP), in commercial and industrial
designations/zones (excluding the T-R - TraveVRecreation Commercial land use designation and
C-T - Commercial Tourist zone).
If directed to pursue this alternative, staff would analyze potential design/development standards,
such as minimum/maximum floor area, for a LFR use. With regard to location criteria, staff has
identified the following location criteria options (staff recommends option “A):
A. The location of LFR uses could be limited to commercial and industrial zones with no
specified location criteria (i.e. no specified distance from a freeway or arterial).
B. The location of LFR uses could be limited to commercial and industrial zones located within
one mile of the intersection of a freeway and a prime or major arterial roadway.

4lternative 2: A second alternative would be to amend the General Plan to create a “general
:ommercial” land use designation where LFR uses would be permitted. The City currently has a
‘general commercial” zone (C-2), which permits a broad range of commercial uses, including LFR
jses; however, the City does not have a “general commercial” land use designation in the General
’Ian.

This alternative would provide opportunities for LFR uses through City initiated or property owner
initiated land use and zone changes on individual properties to establish a “general commercial” land
use designation (if created) and C-2 zone.
Alternative 3: The third alternative consists of identifying specific sites determined by the Council as
potentially desirable for a LFR use and direct staff to do all analysis (Le. environmental, traffic, etc.)
necessary to determine if the site is appropriate for such a use. This alternative would be very time
consuming and costly up-front, due to the amount and type of analysis involved.
ENVIRONMENTAL:
Adoption of the Resolution of Intention will direct staff to process a General Plan, Local Coastal
Program and Zoning Ordinance Amendment. The processing of a project (data collection, research,
resource analysis, etc.), which leads to an action not yet approved by a public agency is exempt from
environmental review pursuant to CEQA Guidelines Section 15306.
FISCAL IMPACT:
Other than staff time, there will be no fiscal impact to the City to prepare a General Plan, Local
Coastal Program and Zone Code Amendment for consideration of “Alternatives 1 or 2”. If Council
directs staff to pursue “Alternative 3”, additional funding would be necessary for technical studies and
possible contracting with outside sources in an amount as yet undetermined.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DECLARING ITS INTENTION TO
CONSIDER A GENERAL PLAN, LOCAL COASTAL PROGRAM
AND ZONE CODE AMENDMENT TO ESTABLISH PROVISIONS
THAT WOULD ALLOW LARGE FORMAT RETAIL USES, WITH
THE APPROVAL OF A CONDITIONAL USE PERMIT, IN
COMMERCIAL AND INDUSTRIAL LAND USE DESIGNATIONS
AND ZONES.
The City Council of the City of Carlsbad, California, does hereby resolve as
Pursuant to Chapter 21.52 of the Carlsbad Municipal Code, the City Council of
the City of Carlsbad hereby declares its intention to consider an amendment of the General
Plan, Local Coastal Program and Title 21 of the Carlsbad Municipal Code (Zoning Ordinance)
to:

Establish provisions that would allow “large format retail” uses in
commercial and industrial land use designations and zones, with the
approval of a conditional use permit.
The Planning Director is directed to study said amendment and after appropriate
study set the matter for public hearing before the Planning Commission and this City Council.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council
of the City of Carlsbad, California, on the 16th day of March 2004, by the
following vote, to wit:

To: Ann Kulchin and all other City Council members
I read with dismay that you are in favor of allowing Big Box Stores like Walmart to build their monstrosities in our lovely city. I, and the majority of citizens of Carlsbad I have spoken to, are very much opposed to this. Letting them in will not only detract
from the beauty of our city but will add greatly to the creasing traffic problems we now face because you have allowed so
much new construction to go forward. You should realize from the recent San Marcos incident that people do not want Walmarts
in our town.
Please reconsider this very important decision.
