RECOMMENDED ACTION:
Adopt Ordinance No. NS-700 extending the Interim Plan for Agua Hedionda Lagoon.
ITEM EXPLANATION:
Ordinance No. NS-700 was introduced and first read at the City Council meeting held on
March 9, 2004. The second reading allows the City Council to adopt the ordinance, which
would then become effective in thirty days. The City Clerk will have the ordinance published
within fifteen days, if adopted.

ORDINANCE NO. NS-700
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING CHAPTER 11.24 OF
THE CARLSBAD MUNICIPAL CODE TO EXTEND THE INTERIM
PLAN FOR AGUA HEDIONDA LAGOON.
WHEREAS, portions of Agua Hedionda Lagoon have been infested with
Caulerpa faxifolia, an invasive marine seaweed; and
WHEREAS, the Southern California Caulerpa Action Team (SCCAT) has been
coordinating with the City to eradicate Caulerpa while also allowing for recreational use of the
lagoon via the Interim Management Plan as amended by the City Council on May 13,2003; and
WHEREAS, the current provisions of Chapter 11.24, which regulates Agua
Hedionda Lagoon and effect the Interim Plan, are set to expire on June 30, 2004; and
WHEREAS, SCCAT is recommending that the City Council amend the
appropriate sections of Chapter 11.24 that will effectively extend the Interim Plan and its
provisions until June 30, 2005.
NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as
follows:
SECTION 1. That Section 11.24.055(6) of the Carlsbad Municipal Code be
amended to read as follows:
“1 1.24.055 Fishing.
(b) This section shall become operative on July 1, 2005, unless amended or
repealed by further action of the city council.”
SECTION 2. That Section 11.24.056(d) of the Carlsbad Municipal Code be
amended to read as follows:
“1 1.24.056 No fishinq or anchoring in posted areas.
(d) This section shall be operative until June 30, 2005, at which time it shall

EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a publication of general circulation in the City of Carlsbad within
fifteen days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City
Council on the 9th day of March 2004, and thereafter.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Carlsbad on the 16th day of March 2004, by the following vote, to wit:
