ENG TITLE: SUMMARILY VACATING A PORTION OF ROOSEVELT STREET (STV 03-01) AND APPROVING THE FINAL MAP FOR CT 01 -1 3, LAGUNA POINT CONDOMINIUMS, AND AUTHORIZING THE CITY CLERK TO PROCESS THE MAP FOR RECORDATION CITY ATTY@ CITY MGRXD RECOMMENDED ACTION: Adopt Resolution No. 2004-090 approving the final map for CT 01-13, Laguna Point Condominiums, and authorizing the City Clerk to process the map for recordation. Adopt Resolution No. 2004-091 public street right-of-way at the southwest corner of Laguna Drive and Roosevelt Street. summarily vacating approximately 247 square feet of ITEM EXPLANATION: Engineering staff has completed checking the final map of CT 01-13, known as Laguna Point Condominiums. This subdivision is within Local Facilities Management Plan (LFMP) Zone #1 and is I generally located at the southeast corner of Laguna Drive and State Street. The project proposes one lot. The lot is comprised of 21 condominium units. The final map conforms substantially with the tentative map as approved by Housing and Redevelopment Commission on April 9,2002 per HRC Resolution No. 352 as recommended by the Design Review Board per DRB Resolution No. 282. The final map also conforms to the General Plan, all the applicable requirements of the Municipal Code, City Standards, and Growth Management Plan. The applicant, William Canepa, President of Wave Crest Resorts 11, LLC, is requesting the recordation of said final map. The subdivision boundary of the project is encumbered by the right-of-way dedicated to the Countyof San Diego prior to the annexation of the area into the City of Carlsbad. The original alignment of Roosevelt Street was dedicated per map of Seaside Lands San Diego County recorded July 28, 1921. Per this map, Roosevelt Street was constructed and right-of-way was dedicated to intersect with Laguna Drive at a skewed angle (approximately 125-degrees along the property frontage). In 1994, the City realigned Roosevelt Street to intersect Laguna Drive at a 90-degree angle creating approximately 247 square feet of excess right-of-way at the southwest corner of the intersection. The developer has filed applications requesting said vacation as required per the project conditions of approval. Staff has concluded that the excess right-of-way is not required for present of future street purposes. The vacation would not affect vehicular or non-motorized traffic circulation or the availability of street parking. The street vacation is considered to be minor and is consistent with previously approved street vacations in the same general location. All utility companies have been notified and no objections have been received. FISCAL IMPACT: The developer pays a plancheck fee to cover the expense of planchecking and processing the final map for recording. All appropriate fees will be paid if and when building permits are issued for this project. Approval of the street vacation will result in approximately 247 square feet of land to be returned to the tax roll. While no detailed economic analysis was conducted, there will be an increase in tax revenue resulting from the vacation and any subsequent development that may benefit from said vacation. FOR CT 01-13, LAGUNA POINT CONDOMINIUMS, AND WHEREAS, William Canepa, President of Wave Crest Resorts II, LLC, has submitted a final map known as CT 01-13, Laguna Point Condominiums, to the City of Carlsbad for approval; and WHEREAS, the tentative map of CT 01-13 with conditions, was recommended for approval by the Design Review Board on February 25, 2002 per DRB Resolution Nos. 282 and was approved by the Housing and Redevelopment Commission on April 9, 2002 per HRC Resolution No. 352; and WHEREAS, the City Engineer has determined that said map substantially conforms to said conditionally approved tentative map; and WHEREAS, the conditions of approval for said final map have been completed or secured; and WHEREAS, the developer has offered public easements for dedication to the City of Carlsbad; and WHEREAS, the final map conforms to the City of Carlsbad General Plan and all requirements of City Codes and Standards; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. WHEREAS, a request has been made to-vacate a portion of public right-of-way at the southwest corner of Laguna Drive and Roosevelt Street: and WHEREAS, the centerline of Roosevelt Street was realigned to a position east of the original road alignment creating an excess area of right-of-way; and WHEREAS, the City Engineer has determined that the excess right-of-way is not required for present or future street purposes; and WHEREAS, the excess right-of-way provides no public street purpose and would not be useful as a non-motorized transportation facility; and WHEREAS, the proposed vacation is consistent with the General Plan of the City; and WHEREAS, the vacation of this excess right-of-way will result in approximately 247 square feet of land being returned to the tax rolls; and WHEREAS, none of the utility companies have facilities within the area to be vacated and therefore have no objection to this vacation. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the above recitations are true and correct. That pursuant to Division 9, Part 3, Chapter 4 of the California Street and Highways Code, said excess right-of-way more particularly described in Exhibit A, and shown for the sake of clarity in Exhibit B, be summarily vacated. 3.
