INSTALL NEW PLAYGROUND EQUIPMENT
UPGRADES AT VARIOUS PARK SITES
RECOMMENDED ACTION:
Adopt Resolution No. 2004-093 accepting the work in accordance with Contract No.
PKS 02-05, as complete, and direct the City Clerk to have the Notice of Completion recorded
and to release the bonds thirty-five (35) days after recordation.
ITEM EXPLANATION:
The City Council awarded a contract to Park Specialties (Contract PKS 02-05) for improvements at tot lots at six park sites throughout the City. The improvements include
playground equipment that meets all Americans with Disabilities Act (ADA) standards, as well as state legislation regarding safety compliance. In addition, over 8,500 square feet of
cushioned rubberized surfacing was installed to provide access to the playground equipment
at eight park sites. Listed below were the park sites for these improvements. In addition,
attached as Exhibit 2 are “before and after” pictures of the improvements.

The original contract awarded was $261,446. There were three change orders for this
contract totaling $19,137, which is 7.5% of the original contract cost. The change orders
were for an additional 1 ,I IO square feet of rubberized surfacing to provide for a better fall
protection coverage, and a new toddler swing set was installed at Stagecoach Park. The total
cost for this project is $280,583; a retention of $21,021 remains to be paid to the contractor.
Appropriations for these improvements were split among various account numbers. Total
appropriations are sufficient to complete the work.
FISCAL IMPACT:
The total cost for this project is $280,583. The General Capital Construction fund, the
Infrastructure Replacement fund and the General Fund provided funding for this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, ACCEPTING THE WORK AS COMPLETE, AND
DIRECTING THE RECORDATION OF THE NOTICE OF COMPLETION
FOR FURNISHING AND INSTALLING NEW PLAYGROUND EQUIPMENT UPGRADES AT VARIOUS PARK SITES PKS 02-05
WHEREAS, the City Council of the City of Carlsbad has previously appropriated General
Capital Construction, Infrastructure Replacement and General Fund Capital Outlay funds for
furnishing and installing new playground equipment at various park sites, hereinafter referred to
as the “Project;” and
WHEREAS, the City Council has previously awarded a contract for the Project; and
WHEREAS, the Project work has been satisfactory completed; and
WHEREAS, a Notice of Completion has been prepared for the Project; and
WHEREAS, the total funds appropriated are sufficient for all project costs; and
WHEREAS, a final retention of $21,021 is due from the General Fund portion of the
project; and
WHEREAS, it is in the public interest to accept the completed work for furnishing and
installing new playground equipment upgrades at various park sites.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad as
follows:
1. That the above recitations are true and correct.

2. That the completed work is hereby accepted and the City Clerk is directed to record
the Notice of Completion and to release the bonds thirty-five days after recordation for said
Project.
