RECOMMENDED ACTION:
City Council Adopt Resolution No. 2004 037 accepting a $800 TourWest grant from the
Western States Arts Federation (WESTAF).
ITEM EXPLANATION:
The TourWest Grant provides matching funding which allows the Arts Office to present multi-
instrumentalist Todd Green, a musician who performs on many ethnic instruments and one-
of-a-kind custom built instruments, for the purpose of community education. Mr. Green will
present school assemblies, including a workshop for students in the Deaf and Hard of
Hearing Program, and will perform at a free public concert on Wednesday, March loth, 2004
which will kick off the annual Multicultural Arts Festival.
FISCAL IMPACT:
The total cost to present Todd Green is $2,000. The TourWest grant from WESTAF is $800.
The remaining match ($1 ,ZOO), is available in the Cultural Arts Office’s budget in the General Fund.
Staff requests the Finance Director be authorized to appropriate the $800 grant in the Cultural
Arts Office’s accounts.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY vF CARLSBi D,
CALIFORNIA, ACCEPTING A TOURWEST GRANT IN THE AMOUNT OF
$800 FROM WESTERN STATES ARTS FEDERATION (WESTAF).
WHEREAS, City Council goals include, “to develop programs that support life-long
learning and citizen engagement and to implement the delivery of City services through
public/private partnerships;” and
WHEREAS, the Carlsbad Arts Office has been awarded a TourWest grant in the amount
of $800 to present several free performances by multi-instrumentalist Todd Green; and
WHEREAS, the total costs to present Todd Green are $2,000; and
WHEREAS, matching funds in the amount of $1,200 are available in the Cultural Arts
Office’s General Fund.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as
follows:

That the above recitations are true and correct.
That the $800 TourWest grant from the Western States Arts Federation
(WESTAF) is hereby accepted.
That the Finance Director is hereby authorized to appropriate $800 the funds into
the Cultural Arts Office’s accounts in the General Fund.

The Western States Arts Federation (WESTAF) shall assign the grant award amount for the
presenter listed above following the return of a signed copy of this contract within 30 days of the
date on the attached cover letter. Failure to return a signed copy of this contract in accordance
with the schedule shall result in the forfeiture of the grant award. WESTAF shall pay the
presenter 100% of the award amount listed above following the timely return of a completed
2003-2004 TourWest Final Report within 60 days following the engagement and these items: a
copy of the performance program, a current season brochure, published press releases, feature
stories, and/or reviews.
If any dates, fees, and/or activities change at any time from those listed above, the presenter
must notify WESTAF within 30 days of the change. NOTE: Changes in plans may affect award
amounts and must meet the goals and review criteria of the TourWest program.
The above artistic fees shall be paid directly to the artisVcompany (or designated
representative) by the presenter as per the artist-presenter contract.
All TourWest supported engagements must include at least (1) public performance. A public
performance is defined as a full-length performance for which promotion and marketing to the
general public have been provided and the audience for which is a cross-section of the
community (e.g. not primarily school-aged children during regular school hours.)
All information and conditions contained in the 2003-2004 TourWest guidelines are incorporated
herein. By signing this contract, the presenter agrees to comply with Title VI of the Civil Rights
Act of 1964, as amended (42 U.S.C. 2000d et seq.); Section 504 of the Rehabilitation Act of
1973 (29 U.S.C. 794) and the Americans with Disabilities Act of 1990 ("ADA") (42 U.S.C. 121 01 -
12213); the Age Discrimination Act of 1975 (42 U.S.C. 6101 et seq.); Title IX of the Education Amendments of 1972 (20 U.S.C. 1681 et seq.); and The Drug-Free Workplace Act of 1988 (41
U.S.C. 701 et seq. And 45 C.F.R. pt. 1154); as well as all regulations of the National
Endowment for the Arts issued pursuant to these statutes; and the applicant thereby gives
assurance to immediately take any measures necessary to comply.
Grantees must clearly acknowledge support from the National Endowment for the Arts and
WESTAF in their programs and related promotional materials. Acknowledgement should be
given in text and graphically by using the NEA and WESTAF logos. Copies of both the WESTAF
and NEA logos may be found on the WESTAF website. Please point your browser to

electronic mail by calling 303-629-1 166. Acknowledgement of the Endowment and WESTAF's
support can be phrased in a variety of ways-for example:
Funding for the Commission and its programs is provided by the Western States Arts

This project received support from the Washington State Arts Commission; WESTAF,
the Western States Arts Federation; and the National Endowment for the Arts.

Compliance is mandatory with all requirements, paperwork, and related timelines as described
herein; failure to do so mav ieooardize current and/or future fundina from WESTAF.
TourWest is made possible through support from the National Endowment for the Arts, the
Western States Arts Federation (WESTAF), and its participating state arts agencies. Support
through TourWest is contingent on available funds.

PERFORMANCE CONTRACT
This contfact is made and entered into this 13th day of June, 2003, by and between Todd Green,
hereinafter rekd to as PERFORMER, and City of Csrlsbad CulturaJ Arts Office,
herehifkr ref& to as PRESENTER.
PRESENTER agrees to pay $1,900.00 at the conclusion of the perfofinance directly to
PERFORMER for a performance lasting from 7:OO p.m. to 900 p.m., on Wednesday, March 10,
2004 at Carlsbad Cultural Arts Center. As part of this contract, PERFORMER will conduct four
(4) educational assemblies at Carlsbad High School for students from Valley Middle School,
Magnolia Elemeatary, Buena Vista Elementary, and Jefferson Elementary Schools, as well as
two (2) more specialized programs for the high school and middle schuoJ music students and the
65 DHH students in the district on the two preceding days. The exact schedule for these shd be
finalized with PERFORMFX'S manager no later than September 29,2003.
PERFORMER will provide his own PA system for the concetf performance. PRESENTER will
provide assistance with unlaading and reloading PERFORMER'S instruments 90 minutes before
the first educational clinic of the day educational clinic and five (5) hours prior to the concert,
and give PERFOFMER unhindered access to the stage at that time. PRESENTER shall provide a
sound person to assist in a sound check two (2) hours before the concert.
Check will be made out to Todd Green, SS# 137-46-7563. PERFORhdER shall be responsible for
paying appropriate booking and artist management fees.
All promotion of the above events shall be the responsibility of PRESENTER.
PRESENTER shall include a city map (or directions to performance sites) when returning the
fInal contract.
