ENG RECOMMENDED ACTION: - TITLE: AUTHORIZE THE APPROPRIATION OF ADDITIONAL FUNDS FOR THE COASTAL RAIL TRAIL PROJECT NO. 3455 Adopt Resolution No. 2004-100 Coastal Rail Trail, Project No. 3455. authorizing the appropriation of additional funds for the ITEM EXP LAN AT10 N : The Coastal Rail Trail is a multi-modal trail extending from San Luis Ray River in Oceanside to the Santa Fe Depot in San Diego. The trail is located within the railroad right-of-way and on City streets. North County Transit District (NCTD) owns the railroad right-of-way in Carlsbad. NCTD felt it was important to establish Design Guidelines that would assist their staff in determining the best location for the rail trail within their right-of-way. San Diego Association of Governments (SANDAG) identified funds separate from those allocated for design and construction of the trail to cover the costs of the development of the Design Guidelines. SANDAG requested that Carlsbad continue to act as Lead Agency for the development of these guidelines. SANDAG has requested and CALTRANS has authorized a reimbursement grant for the development of the guidelines. During the development of the Design Guidelines, staff broke the trail into two phases. The first phase is either on City streets or more than fifty feet from the centerline of the existing tracks. The second phase is within NCTD right-of-way and has segments where the trail is closer than fifty feet from the centerline of the tracks. Staff has moved forward with the design of Phase 1. It was determined that additional funds were required to continue the design of the now two-phase project. CALTRANS has authorized a reimbursement grant to cover the cost of the additional design work. Therefore, staff is requesting authorization for appropriation of additional funds for both the costs of developing Design Guidelines and the cost for design of Phase II of the project all of which is reimbursable once the work is completed and paid for by the City. ENVIRONMENTAL REVIEW: On April 17, 2001, the City Council approved a Mitigated Negative Declaration for the project. The Mitigated Negative Declaration was prepared in accordance with California Environmental Quality Act (CEQA) guidelines and it covers the project from the San Luis Rey River in Oceanside to the southern boundary of Del Mar. The City of San Diego chose to not be a part of the Mitigated Negative Declaration. As a result of the federal funding for the project, a National Environmental Protection Act (NEPA) federal environmental document is needed. CALTRANS prepared and processed the Categorical Exclusion in conformance with NEPA guidelines. The Federal Highway Administration approved the Categorical Exclusion on August 1, 2001. Page 2 of Agenda Bill No. 17,566 FISCAL IMPACT: Table 1 shows the costs for design (Phases I and 11) and construction (Phase I) of Carlsbad's portion of the Coastal Rail Trail. TABLE 1 Table 2 shows the funding breakdown for those costs. TABLE 2 The total cost for design and Phase I construction is estimated at $4.7 million. To date, $1.7 million has been approved and appropriated. The Federal and State funds are drawn on a reimbursement basis; the TransNet matching funds were received in advance of the expenditures. Staff is requesting an additional appropriation of $851,434 of Federal TEA funds. This includes approved amounts of $747,833 for trail design and $103,601 for NCTD guidelines. An Amendment Modification approving these funds was received from the California Department of Transportation (the Federal pass-through agency). The Federal and TransNet funds to be appropriated in the future are estimates; no formal approval has been received for these funds. In addition, the City is eligible for a County Air Pollution Control District grant which will be used to offset the Phase I construction cost. These funding sources, along with costs for future construction phases, will be reviewed in the 2004-05 Capital Improvement Plan budget. EXHIBITS: 1. Location Map. 2. WHEREAS, the City Council of the City of Carlsbad, California, has determined it is necessary and in the public interest to develop the multi-modal pathway located partially in North County Transit District (NCTD) right-of-way; and WHEREAS, in 1992, the San Diego Association of Governments (SANDAG) Bicycle Facilities Coordinating Committee sponsored an lntermodal Surface Transportation Enhancement Act (ISTEA) grant for the development of a feasibility study; and WHEREAS, on April 17, 2001, the City Council approved the Coastal Rail Trail Project Study Report and adopted a Mitigated Negative Declaration; and WHEREAS, on September 18, 2001, The City Council authorized entering into an agreement with Dokken Engineering to perform design engineering services; and WHEREAS, NCTD requires the development of Design Guidelines that affected portions of the Coastal Rail trail as approved in the Project Study Report; and WHEREAS; CALTRANS has authorized additional Federal TEA funds totaling $851,434 for the Design Guidelines and the additional design engineering for Phase II of the project; and WHEREAS, the funds authorized by the California Department of Transportation are a reimbursement grant requiring the City to appropriate funds and invoice for reimbursement; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1.
