CITY MGR. IEPT. ENG RECOMMENDED ACTION: Adopt Resolution No. 2004-109 approving the 2004 five-year Regional Transportation Improvement Program (RTIP) for Carlsbad. ITEM EXPLANATION: The 2004 Regional Transportation Improvement Program (Regional TIP or RTIP) for fiscal years 2004/05 through 2008/09 is a program of proposed major highway, arterial, transit and bikeway projects. The San Diego Association of Governments (SANDAG) is required by State and Federal laws to develop and adopt a Regional TIP every two years. The 2004 RTlP is due to the State by August 1,2004. Most major transportation projects must be included in the approved RTlP prior to receiving certain categories of State and Federal funding and Federal project approvals. In addition, the “Proposition A (TransNet): San Diego Transportation Improvement Program - Ordinance and Expenditure Plan” requires that proposed TransNet funded projects be included in the RTIP. The Federal Metropolitan Planning and Air Quality Conformity Regulations also require inclusion of all regionally significant capacity increasing road projects for air quality emissions analysis. Each City in the region must adopt a recommended local streets and roads project list following a public hearing process. The public hearing must allow citizens an opportunity to comment on the City’s RTlP list. The public hearing will be held at the April 6, 2004 City Council meeting, which was set and noticed in the local papers for the required ten, or more, days. A local streets and roads RTlP list must be adopted biennially by each participating SANDAG agency that desires to expend TransNet and/or certain Federal and State funds. The proposed Carlsbad RTlP list includes projects with the following funding types: . Federal High Priority (DEMO) SANDAG TransNet Local (L) . SANDAG TransNet Highway (H) Federal Regional Surface Transportation Program (RSTP) Federal Highway Bridge Rehabilitation and Replacement (HBRR) Program Regionally Significant Capacity Increasing Projects Regardless of Funding Source The complete RTlP list of projects for Carlsbad identifying the funding source(s), project cost and funding year is attached as Exhibit 2. The RTlP list contains program-funding requests for several projects, which have already received, or will soon receive, Federal funds including Rancho Santa Fe Road, Melrose Drive, Cannon Road, El Camino Real and the Pavement Management Program. Each of these continuing projects has been updated to reflect current cost estimates and construction scheduling. The remaining projects on the Carlsbad RTlP list are new capacity increasing road projects located along regionally significant arterials. The list includes the construction of missing segments of Cannon Road, College Boulevard, Faraday Avenue, Melrose Drive and Poinsettia Lane. Page 2 of Agenda Bill No. 17,574 The ECR Improvement Project and the Pavement Management Program are the only two projects that require programming of new TransNet funds over the next RTlP period. The amount of TransNet funds requested for these two projects is $1.45 and $1 1.67 million, respectively. Staff is proposing a TransNet funding allocation of approximately $2.6 million for each of the next four years to fund the pavement management needs of our City streets. El Camino Real is programmed to receive $493,000 in FY 2004105 to complete the northbound lane widening from two to three lanes between Rancho Carlsbad Drive to Sunny Creek Road already in progress, and approximately 250 linear feet of widening north of Cougar Drive. In FY 2006/07, another $959,000 is programmed for the southbound lane widening from two to three lanes between Lisa Street and Crestview Drive. Although the 2004 RTlP programming cycle is for the next five years, TransNet funds are scheduled to expire in 2008 and are, therefore, programmed through the next four years. ENVIRONMENTAL REVIEW: The action to approve this RTlP project list has been found to be exempt from the CEQA process by the Planning Director pursuant to Section 15276 of the CEQA Guidelines, which states that CEQA does not apply to the adoption of regional transportation improvement programs. It should be noted that individual projects developed pursuant to the RTlP are subject to CEQA. FISCAL IMPACT: Approving the RTlP is a requirement under State law for receiving TransNet, Federal and State funds. Approval of the RTlP ensures eligibility for funding and programs the funding so that positive cash flow is maintained. Inclusion in the RTIP, however, is not necessarily a guarantee that projects will receive the stated funding. The amounts shown are the best available estimates of anticipated funding. In the event that funding falls short or is not available, the City Council is not obligated to proceed with a project just because it is included in the RTIP. EXHIBITS: 1. 2. 3. CARLSBAD, CALIFORNIA, APPROVING THE FIVE-YEAR 2004 WHEREAS, on November 3, 1987, the voters of San Diego County approved the San Diego Transportation Improvement Program Ordinance and Expenditure Plan; and WHEREAS, the Ordinance provides that the SANDAG Commission shall approve a multi-year program of projects submitted by local jurisdictions identifying those transportation projects eligible to use transportation sales tax (TransNet) funds; and WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local street and road revenues for Fiscal Years 2005 through 2009; and WHEREAS, the City of Carlsbad has held a public hearing in accordance with Section 5(A) of the Ordinance; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the above recitations are true and correct. That the 2004-09 Regional Transportation Improvement Program (RTIP) of Projects for Carlsbad attached to the Agenda Bill as Exhibit 2, is hereby approved. 3. That pursuant to Section 9 of the TransNet Ordinance, the City of Carlsbad certifies that the TransNet funds programmed in the 2004-09 RTIP for Carlsbad do not replace private developer funding which has been or will be committed for any project. 4. That pursuant to Section 16 of the TransNet Ordinance, the City of Carlsbad certifies that each project of $250,000 or more will be clearly designated during construction with TransNet project funding identification signs. 5. That the City of Carlsbad does hereby certify that all other applicable provisions of the TransNet Ordinance have been met.
