E CITY MGR3 TITLE: APPROPRIATION OF FUNDS AND AUTHORIZATION OF REIMBURSEMENT TO DEVELOPER FOR THE CONSTRUCTION OF A TRAFFIC SIGNAL AT COLLEGE BOULEVARD AND TAMARACK AVENUE (SOUTH) DEPT. HD. CITY ATTY. E RECOMMENDED ACTION: Adopt Resolution No. 2004-136 appropriating $188,178 from the Public Facilities Fee (PFF) fund and authorizing the Finance Director to reimburse Cypress Valley, LLC $1 86,678 for the installation of a traffic signal at the southerly intersection of College Boulevard and Tamarack Avenue, and pay GVP Consultants $1,500 for reimbursable auditing expenses. ITEM EXPLANATION: Condition of Approval No. 32(m) of Calavera Hills Village Q (CT 83-32/PUD-62) per Planning Commission Resolution No. 2292 requires the construction of a traffic signal at the southerly intersection of College Boulevard and Tamarack Avenue. This traffic signal is included in the City’s Capital Improvement Program (CIP). Therefore, Cypress Valley, LLC is eligible for reimbursement for the construction costs. On May 14, 2002, HMS Construction, Inc., was awarded a contract by Corky McMillin Construction Services, Inc., in the amount of $111,850 for the construction of a traffic signal at the southerly College Boulevard and Tamarack Avenue intersection. That contract was amended with a change order for $53,015 on September 24, 2002 based on changes to the plans. HMS Construction completed the work on October 11, 2002. Cypress Valley, LLC has submitted a request for $192,678 of reimbursable expenses for the design and construction of the traffic signal. The City CIP has budgeted $150,000 of Public Facility Fee (PFF) funds in 2006 for the installation of this traffic signal, so no funds have yet been appropriated. A qualified auditing engineer, GVP Consultants, was retained by the Engineering Department to review and analyze the submitted expenses. The audit report provided by GVP Consultants indicates that the $186,678 of the submitted expenses are adequately documented reimbursable expenses. Engineering staff concurs with the report and recommends that Cypress Valley, LLC be reimbursed $186,678 for the installation of the traffic signal at the southerly intersection of College Boulevard and Tamarack Avenue, and that GVP Consultants be paid $1,500 for reimbursable auditing expenses. FISCAL IMPACT: A summary of the final project cost is as follows: Page 2 of Agenda Bill No. 17,605 The Capital Improvement Program indicates a budget of $150,000 in PFF funds for the installation of a traffic signal at the southerly intersection of College Boulevard and Tamarack Avenue, but no funds have been appropriated. To reimburse Cypress Valley, LLC, PFF funds would have to be appropriated in the amount of $1 88,178. Changes in the City standard specifications have led to increased costs for traffic signals since the budget amount was established. ENVIRONMENTAL REVIEW: The Planning Commission approved a Negative Declaration for CT 83-32 on May 7, 1984. The traffic signal was installed pursuant to the conditions of approval for CT 83-32. WHEREAS, installation of a traffic signal at the southerly intersection of College Boulevard and Tamarack Avenue was a condition of approval of Calavera Hills Village Q (CT 83-321 PUD-62); and WHEREAS, the traffic signal is included in the City Capital Improvement Program (CIP); and WHEREAS, Cypress Valley, LLC installed said traffic signal; and WHEREAS, Cypress Valley requests reimbursement in the amount of $192,678 for the installation of said traffic signal; and WHEREAS, an audit was conducted and the Public Works Director approves reimbursement in the amount of $1 86,678; and WHEREAS, Public Facilities Fee (PFF) funds have been budgeted but not appropriated; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the above recitations are true and correct; That Finance Director appropriate Public Facility Fee (PFF) funds in the amount of one hundred eighty-eight thousand, one hundred seventy-eight dollars ($1 88,178) to reimburse Cypress Valley, LLC for the installation of a traffic signal at the Carlsbad Village Drivemamarack Avenue intersection. 3. That City Council authorize the City’s Finance Director to pay the auditing engineer, GVP Consultants the amount of one thousand five hundred dollars ($1,500) for reimbursable auditing costs in connection with the traffic signal at the southerly intersection of College Boulevard and Tamarack Avenue.
