CITY OF CARLSBAD - AGENDA BILL
TITLE: AUTHORIZE STAFF TO EXECUTE ALL
NECESSARY FORMS FOR THE
CALIFORNIA BEVERAGE CONTAINER RECYCLING
AND LITTER REDUCTION ACT PROGRAM
RECOMMENDED ACTION:
Adopt Resolution No. 2004-137 authorizing the City Manager or designee to execute, in the name of the City of Carlsbad, all necessary forms for the purpose of securing payments and to implement and carry out the purposes specified in Section 14581 (a)(4)(A) of the California
Beverage Container Recycling and Litter Reduction Act and to appropriate prior receipts.
ITEM EXPLANATION:
Pursuant to Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter
Reduction Act, the Department of Conservation is distributing a total of $10,500,000 to eligible cities
and counties specifically for beverage container recycling and litter cleanup activities. Each city is eligible to receive a minimum of $5,000 or an amount calculated by the State, per capita based,
which ever is greater.
The per capita amount calculated by the State is based upon the population, as of January 1, 2000,
in incorporated areas of a city, as stated in the Annual Demographic Report submitted to the
Governor by the Department of Finance. The City of Carlsbad is eligible to receive $25,051 for this
program in 2004-05.
Staff submitted a funding request form to the State that describes the recycling activities for which
the funds mentioned above will be expended. Staff is requesting the funds focus on promotional and
advertising programs, educational programs and the purchase and installation of recycling
containers in the downtown area and the seawall. Staff is working with Redevelopment and Public Works General Services to determine the locations, types of containers and number for the
downtown area and seawall. The promotional and advertising programs will utilize utility bill inserts,
newsletters, print media and brochures to disseminate information to the public on recycling
programs available within the City of Carlsbad.
ENVIRONMENTAL REVIEW:
The approval of this grant application is not considered a project under the California Environmental
Quality Act and, therefore, is not required to go through environmental review.
FISCAL IMPACT:
The City will be allocated $25,051 for 2004-05 to administer the aforementioned programs within the
City of Carlsbad. The City receives these funds on an annual basis for different Initiatives. No matching funds are required.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE CITY MANGER
OR DESIGNEE, TO EXECUTE IN THE NAME OF THE CITY OF
CARLSBADALLNECESSARYFORMSFORTHE PURPOSEOF
SECURING PAYMENTS AND TO IMPLEMENT AND CARRY OUT
THE PURPOSES SPECIFIED IN SECTION 14581 (a)(4)(A) OF
THE CALIFORNIA BEVERAGE CONTAINER RECYCLING AND
LITTER REDUCTION ACT AND APPROPRIATE PRIOR
RECEl PTS.
WHEREAS, the people of the State of California have enacted the California Beverage
Zontainer Recycling and Litter Reduction Act that provides funds to cities and counties for
Deverage container recycling and litter cleanup activities; and
WHEREAS, the California Department of Conservation’s Division of Recycling has been
jelegated the responsibility for the administration of the program within the State, setting up
7ecessary procedures for cities and counties or their designees under the program; and
WHEREAS, per Section 14581 (a)(4)(A) of the California Beverage Container Recycling
and Litter Reduction Act (Division 12.1 of the Public Resources Code, Section 14500 etseq.), the
sligible participant must submit the funding request form by the due date and time in order to
request funds from the Department of Conservation’s Division of Recycling; and
WHEREAS, the City is entitled to an allocation of $25,051 for fiscal year 2004-2005;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

The number of brochures, posters and utility bill inserts distributed will measure the outreach component. The new
downtown beverage container-recycling program will be measured by the use of the containers through a monthly
recycling report generated by the designated hauler. The report shows the amount of recyclables collected for this
