ENG TITLE: AWARD OF CONTRACT FOR JEFFERSON STREET SIDEWALK PROJECT, PROJECT NO. 3883 RECOMMENDED ACTION: Adopt Resolution No. 2004-147 project, Project No. 3883. awarding the contract for the Jefferson Street Sidewalk ITEM EXPLANATION: The Jefferson Street sidewalk project includes the reconstruction of existing sidewalk segments and the construction of new sidewalk segments along Jefferson Street from Magnolia Avenue to Citrus Place. The segments that will be improved are: 0 The entire east side of Jefferson Street between Magnolia Avenue and Carol Place; 0 A 100-foot segment on the west side of Jefferson Street between Magnolia Avenue and . AnchorWay; 0 The west side of Jefferson Street from Tamarack Avenue south to its intersection with Citrus Place. The project also includes roadway widening and the conversion of overhead service drops to underground systems. This design will allow for planting in the parkway, as well as adequate handicap accessibility. Temporary privacy fencing, noise and dust control devices will be installed to reduce construction impacts to existing residents. At the conclusion of the project, Jefferson Street between Magnolia Avenue and Tamarack Avenue will be improved to local street standards. On January 20, 2004, the City Council approved the plans and specifications for the Jefferson Street project and directed the City Clerk to advertise for construction bids. On March 24, 2004, three (3) bids were received. The lowest responsive bidder was TB Penick and Sons. Each of the bids received had errors. Staff reviewed the bid documents to determine whether the errors could: 0 0 0 0 0 Provide an advantage to any of the bidders; Be a vehicle for favoritism; Affect the amount of the bid; Influence potential bidders to refrain from bidding; or Affect the ability to make bid comparisons. The bid errors did require staff to make adjustments to the submitted bid amounts. All adjustments were made in accordance with the project specifications and the public contract code. The errors and resulting adjustments have been determined to be immaterial for the purposes of awarding the contract. Staff recommends that Council make the determination to award the contract to TB Pennick & Sons for the Jefferson Street Sidewalk project as the lowest responsive and responsible bidder. Testina. and Construction Manaaement 17.5%) ENVIRONMENTAL REVIEW: $64,589 $32.294 The new construction of small structures, including street improvements, is exempt from environmental review pursuant to Section 15303 (d) of the State California Environmental Quality Act (CEQA) Guidelines. The replacement or reconstruction of existing facilities is exempt from environmental review pursuant to 15302(c) of the State CEQA Guidelines. A Notice of Exemption was filed June 24, 2002. FISCAL IMPACT: The funds needed for this project are $527,473. DEPARTMENT CONTACT: Sherri Howard, (760) 602-2756, showa8ci.carlsbad.ca.us 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2004-147 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT FOR THE JEFFERSON STREET SIDEWALK PROJECT, PROJECT NO. 3883 WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable, and in the public interest to construct new sidewalks and reconstruct existing sidewalks and associated improvements on segments of Jefferson Street between Magnolia Avenue and Citrus Place; and WHEREAS, the plans and specifications have been approved by the City Council of the City of Carlsbad, California on January 20, 2004 and are on file in the Engineering Department of the City of Carlsbad and are incorporated by reference herein; and WHEREAS, three (3) sealed bids were received on March 24, 2004, for the project; and WHEREAS, the lowest responsive, responsible bid for the project was submitted by TB Penick & Sons, Inc. in the amount of $430,590.31 ; and WHEREAS, said project was included in the 200212003 Capital Improvement Program; and WHEREAS, the General Capital Construction fund includes sufficient funds to construct this project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the above recitations are true and correct. That the low bid submitted by TB Penick & Sons, Inc., in the amount of $430,590.31 is hereby accepted and the Mayor is hereby authorized to execute the contract on behalf of the City for the construction of the Jefferson Street Sidewalk Project. That the award of this contract is contingent upon the bidder submitting the lowest responsive bid executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable extensions of time.
