ITEM EXPLANATION:
The 2003/04 Street Sealing Project, which is part of the City’s ongoing Pavement Management Program, will provide the necessary maintenance to extend the life of various roadways throughout the City. The roadways to be sealed were selected based on the age and existing condition of the roadway surface. The majority of the roadways included in the project will be sealed with a rubberized
slurry seal. The application of rubberized slurry seal rejuvenates and protects the roadway surface
from the harmful effects of sunlight while at the same time protecting the underlying base material
from the damaging effects of water penetration. The project also includes the application of an
Asphalt Rubberized Aggregate Membrane (ARAM) with a slurry seal top coat on some of the older
streets included in the project. In addition to sealing the roadway surface this application, which is referred to as a Cape Seal, provides protection against cracking which typically occurs as roadways get older and more brittle.
In addition to roadway surface maintenance, the project includes concrete repairs to sidewalks,
driveway aprons, and curbs. These concrete repairs will occur along roadways that are receiving seal
applications throughout the project area.
By completing these items of work at the same time, the public right-of-way will be improved by a
single construction project which will reduce the construction impacts on the adjacent residents.
The construction is projected to occur in the summer of 2004.
The engineer’s construction cost estimate for this project was $957,000. On April 22, 2004,
three sealed bids were received for the construction of this project as shown on the following table.
With a bid of $907,282.09, Bond Blacktop, Inc., is the lowest responsive and responsible bidder.
All bid documents submitted by Bond Blacktop, Inc., have been reviewed by staff and found to be in
order.
ENVIRONMENTAL COMPLIANCE:
This project is categorically exempt from the environmental review process under Section 15301
Class 1 (C) of the California Environmental Quality Act.

FISCAL IMPACT:
The estimated construction costs associated with this project are summarized in the following table.
The available Gas Tax Funds shown above represent the current available funds minus $600,000 to
be used for another pavement management project approved by the City Council on April 27,2004.

RESOLUTION NO. 2004-159
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE 2003104
STREET SEALING PROJECT NO. 3667-8.
WHEREAS, on March 2,2004, the City Council of the City of Carlsbad approved plans for
the construction of the 2003104 Street Sealing Project No. 3667-8; and
WHEREAS, three (3) sealed bids were received on April 22, 2004 by the City of Carlsbad
for the construction of said project; and
WHEREAS, the lowest responsive and responsible bid to construct said project was
submitted by Bond Blacktop, Inc., in the amount of $907,282.09; and
WHEREAS, there are sufficient funds available to complete the project; and
WHEREAS, subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the
City Manager to approve change orders in the amount equal to the contingency set at the time of
bid opening.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

That the above recitations are true and correct.
That the low bid of $907,282.09 submitted by Bond Blacktop, Inc., for the
construction of the 2003104 Street Sealing Project No. 3667-8 is accepted and the Mayor is
hereby authorized to execute a contract with Bond Blacktop, Inc., for Project No. 3667-8.
3. That the City Manager is hereby authorized to approve construction change orders

4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
