ESTABLISH A PRIMA FACIE SPEED LIMIT
UPON TAMARACK AVENUE FROM HARWICH DRIVE
TO COLLEGE BOULEVARD

ITEM EXPLANATION:
Tamarack Avenue serves as a residential collector road in the Calavera Hills area. With the
current single-family home development under construction, Tamarack Avenue was extended
from Harwich Drive easterly to College Boulevard. The portion of Tamarack Avenue from
Carlsbad Village Drive to Harwich Drive has a previously established speed limit of 35 miles per hour.
The subject portion of Tamarack Avenue follows a curvilinear alignment and has centerline grades up to 12%. The road has one traffic lane in each direction separated by double yellow centerline
striping with a bicycle lane striped on both sides of the road. Tamarack Avenue has a curb-to-curb
width of 40 feet with sidewalks and street lights constructed on each side. A recent traffic count on
Tamarack Avenue found a 24-hour two-way average daily traffic (ADT) volume of 492 vehicles near Harwich Drive and 1,144 vehicles near Colleq,e Boulevard. A speed survey conducted on the
subject portion of Tamarack Avenue found the 85 percentile speed, commonly called the critical
speed, to be 35 miles per hour. The critical speed is the speed at which 85 percent of the vehicles
are traveling at or below.
Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a
prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight
distance, and conditions that may not be readily apparent to the driver.
At their meeting on May 3, 2004, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon Tamarack Avenue. The Commission recommended by a 5-0 vote that a 35 mile per hour prima facie speed limit be
established upon Tamarack Avenue from Harwich Drive to its intersection with College Boulevard,
thereby extending the existing 35 mile per hour speed zone on Tamarack Avenue.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
FISCAL IMPACT:
Installing two speed limit signs upon Tamarack Avenue will cost about $250.

ORDINANCE NO. NS-706
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF SECTION 10.44.300 TO ESTABLISH UPON TAMARACK AVENUE A PRIMA FACIE 35 MILE PER HOUR SPEED LIMIT FROM HARWICH DRIVE TO ITS INTERSECTION WITH COLLEGE BOULEVARD.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
3y the revision of Section 10.44.300 to read as follows:
“1 0.44.300 Tamarack Avenue.
(d) Upon Tamarack Avenue from Carlsbad Village Drive to its intersection with College Boulevard, the prima facie speed limit shall be thirty-five miles per hour.”
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
(1 5) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
1st day of June ,2004, and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the day of ,2004 by the following vote, to wit:
