CITY ATTY. CONFERENCE WITH LEGAL COUNSEL REGARDING
ACQUISITION OF REAL PROPERTY
TITLE:
That the City Council, by motion, authorize a closed session as follows:
I move that the City Council hold a closed session pursuant to
Government Code section 54956.8 to instruct its negotiators (Sandra
Holder, Community Development Director; Michael Holzmiller, Planning
Director; Cynthia Haas, Economic Development Manager) regarding
price, terms of payment or both for the acquisition or potential acquisition
of real property generally located and generally identified as:
Property Owner: Corky McMillan Companies
Address: Calavera Hills Village H
Negotiator: Brian Milich
APN: 203-1 73-08
If circumstances necessitate the absence of a specified designated representative,
an agent or designee may participate in place of the absent representative so long
as the name of the agent or designee is announced at an open session held prior to
the closed session.

Mayor Lewis and Council Members
As you consider today in your closed session whether to direct Staff toward acquiring the
property in question on Village H, we urge you to remember how much the community
wants this land left alone and preserved in perpetuity.
We don’t want you to forget the many meetings we’ve had with you and Staff, the loo+
letters and phone calls and emails that were sent in, nor the significant vocal support
expressed at more than one Council meeting. We’ve done everything we can to follow
your direction in this process and not just be complainers.
Those of us who voted for Prop C despite some of its elements did so because it included
funding for open space. This-Village H property is a prime example of how those funds
can be used, as well as meeting the principles set forth in the “Community, Place, and
Spirit” conference last year. Acquiring this land will send a strong message that the
Council truly supports natural open space in its communities.
We realize a number of you have apprehensions about this move. If you do, please at the
very least put this property on hold to be considered with the others following the HMP.
We have been in discussion with Preserve Calavera and the North County Open Space
Coalition and they fully support Village H as a target acquisition for its habitat,
environmental, and community value.
Simply put, please either (a) direct Staff as necessary toward acquiring Village H in and
of its own process, or (b) hold it however necessary to include with other upcoming
acquisitions.
