ENG CITY OF CARLSBAD -AGENDA BILL TITLE: ACCEPTING BIDS AND AWARDING A CONTRACT FOR THE CONSTRUCTION OF THE TRAFFIC SIGNAL AT CARLSBAD VILLAGE DRIVE AND GLASGOW DRIVE, PROJECT NO. 3917-1 7 CITY ATTY. CITY MGRa RECOMMENDED ACTION: Adopt Resolution No. 2004-201 accepting bids and awarding a contract for the construction of the traffic signal at Carlsbad Village Drive and Glasgow Drive, Project No. 3917-1 and appropriation of funds. ITEM EXPLANATION: On April 6, 2004, the City Council approved the plans and specifications for the traffic signal at Carlsbad Village Drive and Glasgow Drive, and directed the City Clerk to advertise for construction bids. On May 26, 2004, the following five (5) sealed bids were received: The Engineer’s Estimate for construction of the traffic signal was $1 55,000. The lowest responsible bidder is HMS Construction, Inc. at $146,775. The documents submitted by HMS Construction, Inc., for the project have been reviewed and analyzed by staff and found to be in order. Staff, therefore, recommends the award of the traffic signal construction contract to HMS Construction, Inc. ENVIRONMENTAL REVIEW: This project is a Class 1 Categorical Exemption and is therefore exempt from the environmental review process under provisions of the California Environmental Quality Act (CEQA), Section 15301 (9. A Notice of Exemption will be issued by the Planning Director. FISCAL IMPACT: The project cost breakdown is as follows: From nearby construction projects, the Carlsbad Engineering Department Inspection Division has recently determined that the soil material in the vicinity of the project contains a high amount of rock material. Consequently, the lowest responsible bidder may or may not be aware of the soil conditions and it is anticipated that the contractor may request a change order for unknown physical conditions as permitted in the approved contract documents. In general, 15% is provided for construction contingencies. In anticipation of the possible increase in contractor costs, the construction contingency amount has been increased to 25%. The contingency funds will only be utilized if authorized by the construction inspector, as is customary. Funding for this project was approved in the 2003/2004 Capital Improvement Program and there are sufficient funds available in the General Capital Construction Fund for construction. WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary, desirable and in the public interest to construct the traffic signal at Carlsbad Village Drive and Glasgow Drive; and WHEREAS, five (5) sealed bids were received on May 26, 2004 for the project; and WHEREAS, the lowest responsive, responsible bid for the project was submitted by HMS Construction, Inc., in the amount of $146,775; and WHEREAS, there are sufficient appropriations available to complete construction of the traffic signal. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. 2. That the above recitations are true and correct. That the low bid submitted by HMS Construction, Inc., in the amount of $146,775, IS hereby accepted and the Mayor is hereby authorized to execute a contract on behalf of the City for the construction of the traffic signal at Carlsbad Village Drive and Glasgow Drive. 3. That the award of this contract is contingent upon the bidder submitting the lowest esponsive bid executing the required contract and submitting the required bonds and insurance )olicies, as described in the contract, within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable extensions of time.
