RECOMMENDED ACTION:
Adopt Resolution No. 2004-207 approving Amendment No. 2 to agreement for design and
construction engineering support services with Dokken Engineering, Inc., for Rancho Santa Fe Road North, Phases 1 and 2, Project Nos. 31 90,3907,3887, and 3923.
ITEM EXPLANATION:
The Rancho Santa Fe Road project consists of the widening and realignment of approximately 2.2 miles of Rancho Santa Fe Road from La Costa Avenue to Melrose Drive. The project will be constructed in two phases: Phase 1, from La Costa Avenue to San Elijo Road; and Phase 2, from San Elijo Road to Melrose Drive. Benefits of the project include reduced congestion, improved traffic flow, and increased safety for travelers on the road. Additionally, this project will improve a vital link in the North County region’s roadway network.
The City retained Dokken Engineering in 1998 to provide professional engineering services for the design of Rancho Santa Fe Road Phases 1 and 2. Near the end of the design for these road segments Dokken Engineering was retained under a new contract that included a few remaining design tasks and construction engineering support services. The construction engineering services scope of work was based on the estimated construction schedules for both projects and tasks typical of construction projects.
The design and construction work effort required to support the project to date has exceeded the estimate in the original agreement and Amendment No. 1. Among the items involved in the expanded work effort was Dokken Engineering’s coordination for construction support issues for Phase 1 that were at the time of the original agreement, unknown and based on an 18-month construction schedule. The Phase 1 schedule is now estimated to be complete in a total of approximately 22 months. Dokken also spent additional time coordinating closely with Caltrans and the City of Carlsbad to complete the Phase 2 project construction authorization. This authorization was required in order to receive federal funding. Dokken was required to incorporate design changes at the request of other agencies including the Vallecitos Water District, the City of San Marcos, and San Diego Gas & Electric.
FISCAL IMPACT:
Budaet
The cost of the Rancho Santa Fe Road Phase 2 is summarized in the following table. Costs shown are based on actual costs and bids received. Design costs for Phase 2 were incurred in Phase 1.

The costs associated with the Dokken Engineering amendment under consideration is $1 42,035 and is included in the Design and Construction, Inspection, Materials Testing & Public Relations categories as shown in the table above. These funds have already been appropriated.

Fundinq
The Rancho Santa Road project will be funded with a combination of Community Facilities District
No. 1 (CFD #1), proposed Community Facilities District No. 2 (CFD #2), Public Facilities Fee (PFF),
Federal and State grants, and reimbursements from other agencies and developers.
Funding sources are summarized below:
Community Facilities District special taxes and fees will fund most of the costs for Phase 2 of the
project. Sufficient amounts have been collected for the existing appropriations.
ENVIRONMENTAL:
The City Council at their meeting on June 2, 1992 passed Resolution No. 92-152 certifying EIR No.
91-1 for both Phase 1 and Phase 2 of the Rancho Santa Fe Road project. The City Council at their
meeting on April 25, 2000 passed Resolution No. 2000-128 approving Addendum No. 2 to the final
EIR No. 91-1 for Rancho Santa Fe Road. This EIR covers the realignment and widening of
Rancho Santa Fe Road from La Costa Avenue to Melrose Drive.

WHEREAS, the City Council of the City of Carlsbad, California, consider it necessary and

This Amendment No. 2 is entered into and effective as of the G?3(d day of

(the “Agreement”) by and between the City of Carlsbad, a municipal corporation, (“City”), and
Dokken Engineering, Inc., (“Contractor”) (collectively, the “Parties”) for design and construction
support services for Rancho Santa Fe Road, Phases 1 and 2.

RECITALS
A. On September 4, 2003, the Parties executed Amendment No. 1 to the Agreement
to include additional design and field surveying services not anticipated under the original
agreement; and
B. The Parties desire to alter the Agreement’s scope of work to include additional
Phase 2 design efforts to coordinate with other agencies including the Vallecitos Water District,
the City of San Marcos and Caltrans, and additional Phase 1 construction support tasks; and
C. The Parties have negotiated and agreed to a supplemental scope of work and fee
schedule, which is attached to and incorporated by this reference as Exhibit “A”, Scope of
Services and Fee
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor agree as follows:
1. In addition to those services contained in the Agreement, as may have
been amended from time to time, Contractor will provide those services described in Exhibit “A“.
2. City will pay Contractor for all work associated with those services
described in Exhibit “A on a time and materials basis not-to-exceed one hundred forty two
thousand thirty five dollars ($142,035). Contractor will provide City, on a monthly basis, copies of
invoices sufficiently detailed to include hours performed, hourly rates, and related activities and
costs for approval by City.
3. Contractor will complete all work described in Exhibit “A by March 19,
2006.
4. All other provisions of the Agreement, as may have been amended from
time to time, will remain in full force and effect. -
5. All requisite insurance policies to be maintained

Dear Mr. Helming:
Dokken Engineering is requesting the allowable budget for construction support services for
Rancho Santa Fe Road North, Phase 1 (Project 3190) be increased. Unanticipated field
conditions encountered during construction required additional field surveys, design and
redesign services. In addition, the construction schedule has increased from 18 months to 22
months. Construction support task items not previously anticipated but requested by the City of
Carlsbad are listed below. The estimated cost to complete each of the tasks below is shown on
the attached table.

Dear Mr. Helming:
Dokken Engineering is requesting an amendment (Amendment No. 2) to the agreement dated
March 20,2003 between the City of Carlsbad and Dokken Engineering for engineering design
services. The amendment is being requested to perform additional engineering design services not
previously anticipated and not included within the original agreement. This letter supercedes our
previous letter RE: Request for Agreement Amendment No. 2, dated February 3,2004.
Below describes the various task items requested to be included within Amendment No. 2. The
attached table, dated February 3,2004, summarizes the task items and the estimated hours to
complete the required tasks, and the costs associated with each task.
Task 1: Coordinate Plans and Specs with VWD Corrosion Consultant.
The original agreement did not include coordination with the VWD-contracted corrosion
engineering consultant DeCarlo and Associates. Dokken Engineering performed the following:

Revisions were a result of slower than anticipated progress by San Marcos on their Rancho Santa
Fe Road improvements. Dokken Engineering performed the following:

Caltrans Coordination.
Repetitive revisions to the PS&E, evolving property acquisition status by Carlsbad, and
inconsistent requirements by Caltrans, resulted in numerous Caltrans meetings and submittals
required to receive Right-of-way Certification and Authorization to Construct. Previous
agreement with Dokken Engineering provided compensation for Caltrans coordination based
upon expected effort per previous federally funded projects. However, efforts required for
Caltrans coordination exceeded anticipated efforts. Dokken Engineering performed the following:

Reports from Chicago Title to support Right-of-way acquisition by the City of Carlsbad. Aguirre
& Associates performed the following:

Task 11: Prepare Plans and Specifications for Phase 2 Clearing Construction Change Order.
Plans and specifications were prepared for the clearing of the Phase 2 project site. Plans and
specifications were used by the Phase I Contractor to clear the Phase 2 site by construction
change order. Dokken Engineering performed the following:
Prepared plans and specifications showing clearing limits and construction
Revised Phase 2 specifications to indicated project site would be cleared
details for clearing the Phase 2 project site

Task 12: Prepare SWPPP Document for Phase 2 Clearing CCO.
A Storm Water Pollution Prevention Plan (SWPPP) was developed for use by the Phase 1
Contractor for the clearing of the Phase 2 project site. Dokken Engineering performed the

Task 13: Design Curb Profile at northwest quadrant RSF RoadMelrose Drive intersection,
Revise Sheets, and Mark-up San Marcos Plans.
Review of improvement plans for Rancho Santa Fe Road by the City of San Marcos showed the
planned curb prot’lles at the north-west quadrant of Rancho Santa Fe Road/Melrose Drive
intersection provided adverse superelevation and steep grades. Dokken Engineering acquired
current improvements plans from San Marcos’ consultants, reviewed the plans, and developed
revised curb profiles to improve superelevation and grades. Dokken Engineering performed the
following:
Met with the City of Carlsbad to discuss improvement plans by the City of
Coordinated with City of San Marcos’ consultants to acquire hardcopy and
San Marcos
electronic design files of current improvement plans for Rancho Santa Fe
Road
Analyzed improvement plans, developed recommendations for revised plans
and provided red-line improvement plans to Carlsbad
revised City of San Marcos’ improvement plans
Revised City of Carlsbad’s Rancho Santa Fe Road improvement plans to match
Task 14: Revise 24” RCW line Plan and Profile due to Phase 1 Changes.
Construction changes in Phase 1 of the project revised the terminus of the 24” recycled waterline.
The terminus of the 24” recycled waterline was revised to minimize conflicts with the existing
recycled waterline. Dokken Engineering performed the following:
Revised the Phase 2 plans by adjusting the plan and profile of the 24”
recycled waterline per the Phase 1 construction changes
Task 15: Provide Additional Mylar Sheets.
Various plan revisions were performed after the initial mylar submittal to Carlsbad was
completed. Plan revisions completed after the initial mylar submittal required effort to plot sheets
and direct expenses for mylar media. Dokken Engineering performed the following:
Plotted various plan sheets on mylar and provided mylar media for plotting
Task 16: Assist in Special Provisions Formatting per Carlsbad Purchasing’s Request.
Carlsbad’s Purchasing Department requested the contract Special Provisions be provided in a
single-sided format. Dokken Engineering provided assistance on an expedited schedule to
reformat contract Spccial Provisions and the hardcopy inserts to satisfy requests by the
Purchasing Department. Dokken Engineering performed the following:
