ENG RECOMMENDED ACTION: - TITLE: AUTHORIZATION OF APPROVAL OF PLANS AND TO DEPT. ADVERTISE FOR BIDS FOR COASTAL RAIL TRAIL PHASE I AND APPROPRIATION OF FUNDS PROJECT NO. 3455 Adopt Resolution No. 2004-221 Clerk to advertise for bids for Coastal Rail Trail Phase I and appropriate funds, Project No. 3455. approving plans and specifications and authorizing the City ITEM EXPLANATION: The Coastal Rail Trail is a multi-modal trail extending from San Luis Rey River in Oceanside to the Santa Fe Depot in San Diego. The trail is located within the railroad right-of-way and on City streets. North County Transit District (NCTD) controls the railroad right-of-way in Carlsbad. This project is funded by Federal, State and Local (County) funds. As the regional planning organization, San Diego Association of Governments (SANDAG), administers these funds. SANDAG has a Use It Or Lose It Policy that governs portions of the Federal funds for the Coastal Rail Trail. To insure that all funds authorized for the Coastal Rail Trail are used in the timelines required by SANDAG and to allow NCTD time to develop Design Guidelines for the trail, Carlsbad, Oceanside and Encinitas chose to phase the project. Phase I of the Coastal Rail Trail includes signing and striping from the southern City limit north to the Poinsettia Coaster Station and construction of a Class I bike trail within NCTD’s right of Way between Tamarack Avenue and Oak Avenue. Phase I includes a variance from the NCTD Guidelines to: 0 0 0 Include an existing drainage ditch within the proposed Coastal Rail Trail easement thus requiring a two foot variance from NCTD’s operating Right of Way; Establishment of trees within the easement; Placement of benches within the easement; Establishment of a one-way trail portion to slow users approaching Tamarack Avenue. During the development of the Design Guidelines, the trail in Carlsbad was divided into two phases to accommodate the funding constraints. The first phase is either on City streets or more than fifty feet from the centerline of the existing tracks, The design of Phase I has been completed. ENVIRONMENTAL REVIEW: On April 17, 2001, the City Council approved a Mitigated Negative Declaration for the project. The Mitigated Negative Declaration was prepared in accordance with California Environmental Quality Act (CEQA) guidelines and it covers the project from the San Luis Rey River in Oceanside to the southern boundary of Del Mar. The City of San Diego chose not to include its trail portion in the project considered for the Mitigated Negative Declaration determination. As a result of the federal funding for the project, a National Environmental Protection Act (NEPA) federal environmental document is needed. CALTRANS prepared and processed a Categorical Exclusion for actions that do not individually or cumulatively have a significant environmental effect in conformance with NEPA guidelines. The Federal Highway Administration approved the Categorical Exclusion on August 1, 2001. Page 2 of Agenda Bill No. 17,695 On February 18, 2005, the Planning Commission approved Coastal Development Permit Number 03-31 for Coastal Rail Trail Phase I. FISCAL IMPACT: TABLE 1 The total cost for design (both phases) and construction (phase I) of the Coastal Rail Trail is estimated at $4.7 million as shown in Table 1. The project is currently under design; the construction - phase I portion of the project is being advertised with this agenda item. Table 2 shows the funding breakdown for those costs. TABLE 2 To date, $4.5 million has been appropriated as shown in Table 2. The Federal and State funds are drawn on a reimbursement basis; the TransNet funds were received in advance of expenditures. There are additional TransNet funds approved by SANDAG for the project that are allocated in the 2004-05 CIP and will be appropriated upon receipt. In addition, San Diego County has approved a reimbursement grant for Air Pollution Control District (APCD) matching fund totaling $1 84,176 for the project. Appropriation of these funds is being considered with this agenda bill. EXHIBITS: 1. Location Map. 2. WHEREAS, in 1989, the San Diego Association of Governments (SANDAG) Bicycle Facilities Coordinating Committee commissioned a study and determined it feasible to construct a bike path along the railroad right of way between Oceanside Transit Center and the San Diego Santa Fe Depot for nearly its full length; and WHEREAS, in 1992, the SANDAG Bicycle Facilities Coordinating Committee sponsored an lntermodal Surface Transportation Enhancement Act (ISTEA) grant for the development of a feasibility study evaluating the alignment alternatives and resulting impacts from the possible construction of a Class I bike path parallel to and within the existing north/south railroad right of way; and WHEREAS, the Coastal Rail Trail project is a 42 mile multi-modal bicycle and pedestrian facility envisioned to be constructed in the existing railroad right of way between the Oceanside Transit Center and the San Diego Santa Fe Depot; and WHEREAS, the City of Carlsbad was designated as the lead agency in the 1994-01 Regional Transportation Improvement Program (RTIP) for the development of a feasibility study for the Coastal Rail Trail; and WHEREAS, on November 5, 1996, the City of Carlsbad entered into a Memorandum of Understanding with the cities of Del Mar, Encinitas, Oceanside, San Diego and Solana Beach along with the San Diego County Transit District (currently North County Transit District) and the Metropolitan Transit Development Boards for coordinated planning and design of a multi-modal, non-motorized transportation facility; and WHEREAS, on April 17, 2001, the City Council approved the Coastal Rail Trail Project Study Report developed by Transtech Engineers, dated October 2000, for the project from the Oceanside Transit Center and the San Diego Santa Fe Depot; and WHEREAS, City of Carlsbad as lead agency adopted a Mitigated Negative Declaration for the Coastal Rail Trail in the cities of Del Mar, Solana Beach, Encinitas, Carlsbad and Oceanside [Cities) ; and 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, on August 1, 2001, Caltrans and the Federal Highway Administration (FHWA) determined that the Coastal Rail Trail project does not individually or cumulatively have significant environmental impact and processed a Categorical Exclusion (CE) as defined by the National Environmental Protection Act (NEPA); and WHEREAS, the Cities each authorized individual contracts for the design of the plans, specifications and estimates for their portion of the Coastal Rail Trail; and WHEREAS, on September 18, 2001, the City Council authorized entering into an agreement with Dokken Engineering to perform design engineering services for Phases I and II for the portion of the Costal Rail Trail in Carlsbad; and WHEREAS, the City Council of the City of Carlsbad, California, has determined it is in the public interest to construct the multi-modal pathway located partially in North County Transit District (NCTD) right-of-way and on City streets for the project; and WHEREAS, the plans and specifications for furnishing of all labor, materials, tools, equipment, transportation, and other expenses necessary or incidental to said project have been prepared and are on file in the Engineering Department of the City of Carlsbad and are incorporated by reference herein; and WHEREAS, said project was included in the 2004/2005 Capital Improvement Program; and WHEREAS, the City is proceeding with the Phase I construction of the project; and WHEREAS, all Federal and State funds for design (Phases I and II) and construction :Phase I) have been appropriated; and WHEREAS, the remaining TransNet funds approved for the project will be appropriated Jpon receipt; and WHEREAS, Air Pollution Control District (APCD) grant funds have been approved and are lot yet appropriated. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, =alifornia, as follows: 1.
