TITLE: AWARD OF CONTRACT FOR
THE CONSTRUCTION OF
2004/05 PAVEMENT OVERLAY PROJECT
PROJECT NO. 3667-9
RECOMMENDED ACTION:
Adopt Resolution No. 2004-222
Inc. for the construction of the 2004105 Pavement Overlay Project No. 3667-9.
accepting bids and awarding the contract to Silvia Construction
ITEM EXPLANATION:
The 2004/05 Pavement Overlay Project is part of the City’s ongoing Pavement Management Program. This maintenance and repair project will improve various roadways throughout the City.
The roadways were selected based on the age and existing condition of the roadway surface.
In addition to roadway surface maintenance, the project includes concrete repairs to sidewalks,
driveway aprons, and curbs. These concrete repairs will occur along the roadways that are being resurfaced. By completing these items of work at the same time, the public right-of-way will be
improved by a single construction project which will reduce the construction impacts on the adjacent
residents. The construction is expected to occur in the late summer or early fall of 2004.
The engineer’s construction cost estimate for this project was $3,170,000. On June 14, 2004,
six sealed bids were received for the construction of this project as shown on the following table:
With a bid of $2,924,901.35, Silvia Construction Inc. is the lowest responsive and responsible
bidder. All bid documents submitted by Silvia Construction Inc. have been reviewed by staff and
found to be in order.
ENVIRONMENTAL COMPLIANCE:
This project is categorically exempt from the environmental review process under Section 15301
Class 1 (C) of the California Environmental Quality Act.

FISCAL IMPACT:
The construction costs associated with this project are summarized in the following table.

The total available funds shown in the table includes TransNet Local Funds and Gas Tax Funds
which have been appropriated for the City’s Pavement Management Program.

RESOLUTION NO. 2004-222
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE 2004105
PAVEMENT OVERLAY PROJECT NO. 3667-9.
WHEREAS, on April 27,2004, the City Council of the City of Carlsbad approved plans for
the construction of the 2004105 Pavement Overlay Project No. 3667-9; and
WHEREAS, six (6) sealed bids were received on June 14, 2004 by the City of Carlsbad for
the construction of said project; and
WHEREAS, the lowest responsive and responsible bid to construct said project was
submitted by Silvia Construction Inc. in the amount of $2,924,901.35; and
WHEREAS, there are sufficient funds available to complete the project; and
WHEREAS, subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the
City Manager to approve change orders in the amount equal to the contingency set at the time of
bid opening.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

That the above recitations are true and correct.
That the low bid of $2,924,901.35 submitted by Silvia Construction Inc. for the
construction of the 2004J05 Pavement Overlay Project No. 3667-9 is accepted and the Mayor is
hereby authorized to execute a contract with Silvia Construction Inc. for Project No. 3667-9.

4. That the award of this contract is contingent upon the bidder submitting the lowest
-esponsible bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 6th day of July , 2004 by the following vote, to wit:
