RECREATION APPROPRIATE ADDITIONAL FUNDS A CITY DE PT- ATTY D*% CITY MGR- RECOMMENDED ACTION : It is recommended the City Council ADOPT RESOLUTION NO. 2004-224 accepting bids and awarding a construction contract to Griffith Company for the construction of Hidden Canyon Community Park, Contract No. 38561-A; and appropriate additional funds to the project account. ITEM EXPLANATION : On April 6, 2004, the City Council approved the plans and specifications and authorized the advertisement of bids for the construction of Hidden Canyon Community Park, City Project No. 38561-A. This 22-acre park site is located at Vancouver Street in the vicinity of Carlsbad Village Drive and Concord Drive (Exhibit 2). The park includes the following elements: (Exhibit 3) Asphalt paved parking lot at Vancouver Street (16 spaces) Privacy screen walls to screen new parking lot from 2 adjacent residences Tot lots with modular play structures and a swing Picnic areas with picnic tables and grills Viewlseating areas with benches Restroom and equipment storage facility Internal path system connecting to the City-wide trail system; (trail connection from the lower site to the Dog Park has been completed utilizing volunteers) Extensive landscaping and unassigned open green space areas Expansion of the gravel parking lot at the Dog Park (1 1 additional spaces) Public art component (approved by Council 6/24/03) City Council approved the plans and specifications and authorized staff to bid the project at the April 6, 2004 meeting. On June 9, 2004, the City received sealed bids for this project. National City, CA $1,645,000 Staff has reviewed the bids, checked contractors qualifications, and is recommending Griffith Company as the lowest responsive bidder. I AB# 17,698 PAGE 2 Construction Contingency (I 5%) Construction Management, Inspection and Testing (1 0%) Construction Phase Desian Surmort, and Biological Survev (allowance) ENVIRONMENTAL REVIEW: $21 2,162 $141,441 $21,000 A Mitigated Negative Declaration was issued by the Planning Department and the Planning Commission approved a Conditional Use Permit (C.U.P. 02-23/HDP) on April 2, 2003 for the park Master Plan, which includes all work listed above. FISCAL IMPACT: The current appropriation of funds for the project is not adequate to cover the costs of construction for the low bid received. A summary of the project funding is shown in the table below. Summary of Project Funding I Total Desian and Develorsment I $97.749 I I Contract Amount 1 $ 1.414.414 I I Estimated Project Cost I $1,886,766 I Appropriations to-date I $1,758,000 When Council authorized going to bid in April ’04, the engineer’s estimate for the project was $1,316,000 (vs. current low bid of $1,414,414; a difference of $98,414). The estimate was based on bids received for the identical project back in September ’03 (bids were rejected at that time due to the inability to complete grading prior to the gnacatcher breeding season restriction). To arrive at the engineer’s estimate presented to Council in April, staff added a 10% inflationary factor to the average bid price from September ‘03. Analyzing the low bid received vs. last years, the actual increase was 18% over 8 months for the identical project. This reflects the dramatic construction increases taking place over the past several months due to material shortages and record level prices for structural steel, framing lumber and plywood as well as relatively high increases in labor costs. In addition the construction industry is still very active and not conducive to low bid prices. As is evident from the above, the total estimated project cost is under-funded by $128,766 and additional funding would need to be appropriated to construct the project in accordance with work outlined in the base bid construction. Adequate funds are available in the NE Quadrant Park-in-lieu Fund (PIL-NE Fund) account to cover the additional appropriation. Staff recommends an additional appropriation in the amount of $128,766 from the Park-in-lieu Fund to the Hidden Canyon Community Park account. The additional appropriation of funds for this project means there will be less money in the future to pay for the other park project in that quadrant which utilizes the PIL NE Fund. An option for Council to consider would be the elimination of one or both of the “deductive alternates” included in the bid; the restroom which was bid at $145,000, and the 2-5 year old’s totlot bid at $40,000 (there is also a separate 6-12 year old’s totlot that was not a deductive alternate). Because of the anticipated use by children and their parents however, staff does not recommend eliminating the restroom. AB# 17,698 PAGE 3 On going maintenance and operation costs are estimated at $80,000 per year for this park after construction is completed. EXHIBITS: 1. WHEREAS, on April 6, 2004 the City Council of the City of Carlsbad, California, approved the plans and specifications and authorized the advertisement of competitive bids for the construction of Hidden Canyon Community Park, hereafter referred to as the “Project;” and WHEREAS, on June 9, 2004, the City received sealed bids for said Project which were opened in public; and WHEREAS, the lowest responsive, responsible bid was submitted by The Griffith Company Incorporated in the amount of $1,4 14,4 14 and WHEREAS, additional funds in the amount of $128,766 are required to successfully complete the project; and WHEREAS, adequate funds are available in the NE Quadrant Park-in-Lieu Fee account to cover the additional appropriation in the amount of $128,766. WHEREAS, it is necessary, desirable, and in the public interest to proceed with the award of the construction contract for said Project at this time. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the City Council does hereby authorize the Finance Director to appropriate additional funds for the project in the amount of $128,766. 3. That the City Council does hereby award a contract for the Project to the lowest responsive, responsible bidder, GriMith Company in the amount of $1,414,414 and the Mayor is authorized to execute said contract on behalf of City. That the City Manager is hereby given the authority to approve construction change orders; singly or in aggregate, up to the amount of the specified contingency.
