Adopt Resolution No. 2004-249 authorizing a refund to Monterey Bay Clothing Company, LLC of
$5,887.05 in business license tax.

ITEM EXPLANATION:
Monterey Bay Clothing Company, LLC ceased conducting business in the City of Carlsbad after the
company paid its business license tax for the year. They have requested a refund for the period of
time after they stopped conducting business in Carlsbad.
The Finance Department 1) confirmed the date Monterey Bay Clothing Company, LLC ceased
conducting business in the City; 2) audited the refund request by reviewing Monterey Bay Clothing
Company, LLC's financial statements for the period of the business license tax payment and
confirming the refund amount; and 3) verified that the new company (Monterey Bay Clothing
Company, Inc.) had applied and paid for a business license with the City.
Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in excess of
$500. Therefore, staff is recommending approval of a refund to Monterey Bay Clothing Company,
LLC for $5,887.05.
FISCAL IMPACT:
The refund will result in a $5,887.05 refund. As the new owner has paid its business license tax,
there is no further fiscal impact.

A RESOLUTION OF THE CITY OF CARLSBAD,
CALIFORNIA, REFUNDING BUSINESS TAX
PAYMENT TO MONTEREY BAY CLOTHING
COMPANY, LLC
WHEREAS, Monterey Bay Clothing Company, LLC ceased doing business in the City of
Carlsbad and the company has requested a refund for the period of time after they stopped
conducting business in the City; and
WHEREAS, the Finance Department confirmed the date Monterey Bay Clothing
Company, LLC ceased doing business in the City, and audited and verified the refund amount.
NOW, THEREFORE, BE IT RESOLVED,
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That a refund of business license tax of $5,887.05 to Monterey Bay
Clothing Company, LLC is authorized.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 27th day of July , 2004 by the following vote, to wit:
