awarding the contract for the Highland Drive Storm Drain
ITEM EXPLANATION:
The Highland Drive Storm Drain begins at Hosp Park and extends southeast to Highland Drive. It was installed by a developer in 1963 and includes two catch basins at the north end of Highland Drive, approximately 370-feet of 24-inch diameter corrugated metal pipe (CMP), and an outlet structure.
Over time, the CMP has failed to contain the storm flows resulting in severe erosion on private property and the destruction of lower pipe segments. The erosion has resulted in the need to replace the entire storm drain. Plans and specifications have been prepared to replace the storm drain with a 24-inch diameter high-density polyethylene pipe installed using horizontal directional drilling (tunneling). In addition, the catch basins will be replaced with larger catch basins designed to collect the 100-year storm runoff and an energy dissipator to be installed at the outlet within Hosp Park. The catch basin improvements will also require re-constructing the end of Highland Drive.
Grading of the private property where the existing storm drain caused erosion is being performed
through a separate reimbursement agreement with Jim Dunn, which was approved on August 3, 2004.
On June 22, 2004, the City Council approved the plans and specifications for the Highland ,Drive Storm Drain project and directed the City Clerk to advertise for construction bids. On July 29, 2004, three (3) bids were received. The lowest responsive bidder was HMS Construction, Inc.

The Engineer’s Estimate for Construction of the Highland Drive Storm Drain is $360,000.
Staff recommends that Council award the contract to HMS Construction for the Highland Drive
Storm Drain Replacement project as the lowest responsive and responsible bidder.
ENVIRONMENTAL REVIEW:
On May 19, 2004, the Planning Commission approved a Mitigated Negative Declaration, a Mitigation
Monitoring and Reporting Program, and a Coastal Development Permit No. CDP 03-41 for this
project.

RESOLUTION NO. 2004-268
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AWARDING THE CONTRACT FOR
THE HIGHLAND DRIVE STORM DRAIN REPLACEMENT,
PROJECT NO. 3905
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable, and in the public interest to construct the Highland Drive Storm Drain
Replacement; and
WHEREAS, the plans and specifications have been approved by the City Council of the
City of Carlsbad, California on June 22, 2004 and are on file in the Engineering Department of the
City of Carlsbad and are incorporated by reference herein; and
WHEREAS, three (3) sealed bids were received on July 29, 2004, for the project; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by HMS
Construction, Inc, in the amount of $333,795; and
WHEREAS, said project was included in the 200312004 Capital Improvement Program;
and
WHEREAS, the Planned Local Drainage Area "A, Funds includes sufficient funds to
construct this project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

That the above recitations are true and correct.
That the low bid submitted by HMS Construction, Inc., in the amount of $333,795 is
hereby accepted and the Mayor is hereby authorized to execute the contract on behalf of the City
for the construction of the Highland Drive Storm Drain Replacement.

3. That the City Manager is hereby authorized to approve construction change orders
up to $36,000.
4. That the award of this contract is contingent upon the bidder submitting the lowest
responsive bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution. The
City Manager may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 10th day of Auqust , 2004 by the following vote, to wit:
