ESTABLISH AN ALL-WAY STOP AT THE INTERSECTION OF AVENIDA ENCINAS AND PORTAGE WAY/MARLIN LANE RECOMMENDED ACTION: Introduce Ordinance No. NS-713 with Portage Way/Marlin Lane. to require stops on Avenida Encinas at its intersection ITEM EXPLANATION: At the City Council meeting of July 20, 2004, the Council heard the citizen appeal of a Traffic Safety Commission recommendation to not establish an all-way stop at the intersection of Avenida Encinas and Portage Way/Marlin Lane. Both Portage Way and Marlin Lane are private streets and each street is controlled by a stop sign posted at its intersection with Avenida Encinas. The City Council determined, by a 4-1 vote, that it was necessary to assign the right of way to vehicles and pedestrians by establishing an all-way stop at the intersection of Avenida Encinas with Portage Way/Marlin Lane. This action requires the installation of stop signs on Avenida Encinas at the subject intersection. Warning signs that indicate “stop ahead” will be installed in advance of the all-way stop intersection. The City Council directed staff to supplement the “stop ahead” signs with a flashing beacon at both “stop ahead” sign locations. FISCAL IMPACT: Installing stop signs, “stop ahead” signs, painted crosswalks, and painted pavement legends will cost about $1,500. The two solar-powered flashing beacons will cost about $1 5,000 total to furnish and install. EXHIBITS: 1. Location Map. 2. Ordinance! NS-713 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE IO, CHAPTER 10.28, OF THE CARLSBAD MUNICIPAL TO REQUIRE STOPS ON AVENIDA ENCINAS AT ITS INTERSECTION WITH PORTAGE WAY1 MARLIN LANE. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1 : That Title 10, Chapter 10.28, of the Carlsbad Municipal Code is amended by the addition of Section 10.28.700 to read as follows: “1 0.28.700 Marlin Lane. Drivers shall stop where the following described street intersects Marlin Lane: Avenida Encinas.” SECTION 2: That Title 10, Chapter 10.28, of the Carlsbad Municipal Code is amended by the addition of Section 10.28.71 0 to read as follows: “10.28.71 0 Portacre Way. Drivers shall stop where the following described street intersects Portage Way: Avenida Encinas.” SECTION 3: That Title 10, Chapter 10.28, of the Carlsbad Municipal Code is amended by the addition of Section 10.28.720 to read as follows: “1 0.28.720 Avenida Encinas. Drivers shall stop where the following described streets intersect Avenida Encinas: Portage Way Marlin Lane.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (1 5) days after its adoption.
