PWlGS NO. FAC 04-06, PROJECT NO. 39241 RECOMMENDED ACTION: Adopt Resolution No. 2004-295 accepting the bid of $233,264.50 and awarding the contract to Tri-Group Construction and Development Inc. and authorizing the agreement to perform Facilities and Parks Concrete Replacement, Contract No. FAC 04-06, Project No. 39241, and approving appropriation of additional funds. ITEM EXPLANATION: The City of Carlsbad Public Works Major Service Area (MSA) is responsible for the maintenance of parks and buildings throughout the City. Maintenance responsibilities include the repair and replacement of concrete improvements that have cracked, broken or uplifted due to age, tree root intrusion and initial construction defects. Replacement of these concrete improvements is needed to increase safety, prevent further deterioration from water intrusion and to provide top quality improvements for our facilities and parks. The contracting of these services is necessary as staffing is not sufficient to perform large-scale repairs of this nature. On March 9, 2004, City Council approved contract documents and special provisions, and authorized the City Clerk to advertise for bids for this project. A Notice Inviting Bids was published and bid packages were issued to 5 contractors. No bids for this project were received. In accordance with Municipal Code 3.28.1 10 Staff contacted seven contractors and negotiated proposals to perform the work. Proposals were received from three. Tri-Group Construction HMS Contracting 0 Demcon Contracting $233,264.50 $31 2,780.00 $346,662.52 Tri-Group Construction submitted the lowest responsive bid. Therefore, staff recommends the contract be awarded to Tri-Group Construction and Development Inc, the lowest responsive bidder, in the amount of $233,264.50. The contractor’s references are satisfactory. Contract documents are on file in the General Services of Public Works office. ENVIRONMENTAL REVIEW: A Coastal Development Permit (CDP-04-04) has been prepared and approved by the Planning Director on March 29, 2004 for work areas within the Coastal Zone. The remainder of this project has been determined to be exempt from environmental review per CEQA - Class 1 (c), Minor alteration of existing facility. Staff is requesting an additional $64,265 from the Infrastructure Replacement Fund to complete the project. EXHIBITS: 1. THE EXECUTION OF CONTRACT NO. FAC 04-06, PROJECT NO. WHEREAS, the City Council adopted Resolution No. 2004-079 approving contract documents, special provisions and specifications, and authorized the City Clerk to advertise for bids for Facilities and Parks Concrete Replacement, hereinafter referred to as the “Project;” and WHEREAS, no bids were received, and WHEREAS, in accordance with Municipal Code 3.28.110 staff has negotiated an agreement with Tri-Group Construction and Development Inc. to perform the work; and WHEREAS, the negotiated amount of the agreement with Tri-Group Construction and Development Inc. is $233,265.50; and WHEREAS, insufficient funds are available for this project in the Capital Improvement Project budget; and WHEREAS, additional funds in the amount of $64,265 needs to be appropriated to complete this project. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That the Finance Director is authorized to make an additional appropriation in the amount of $64,265 from the Infrastructure Replacement Fund to perform Facilities and Parks Concrete Replacement. 3. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute a contract for Contract No. FAC 04-06, Project No. 39241, Facilities and Parks Concrete Replacement with Tri-Group Construction and Development Inc. 5. That the award of this contract is contingent upon Tri-Group Construction and Development Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution. The City Manager may grant reasonable extensions of time.
