RECOMMENDED ACTION:
Adopt Resolution No. 2004-299 accepting the bid of $107,407 and awarding the contract
to Design Space Modular Buildings to purchase and install a new modular building at the
Parks Yard - Contract No. PKS04-02.
ITEM EXPLANATION:
The existing trailer in the Parks Yard is 30 years old and in poor condition. Currently, the
roof leaks and water seeps through the wall when it rains, which could cause potential water
damages to computer and AV equipment inside. The trailer is rusting and the paint inside is
bubbling due to the weather elements. A new trailer is needed to improve working conditions
and avoid unnecessary damages to equipment. On February 4, 2004, the City’s Planning
Commission adopted Resolution No. 5559 and 5560 approving CUP 03-31 and Site
Development Plan SDP 03-20 for this project. Attached, as Exhibit 2 is the staff report and
resolutions from the Planning Commission.
The Capital Outlay budget approved in the Parks Operations 2003-04 budget for this project
is $49,795. Original cost estimates were obtained for a basic unfinished modular unit.
Architectural assistance was required to design the interior and exterior layout of the unit to
meet all necessary requirements. The issues addressed ADA accessibility, security,
bathroom accommodations, HVAC, utilities as well as adequate office space for the Parks
and Trees supervisors and lead personnel. Space is also available for a plan table and
storage, bookcase for catalogues, equipment manuals and reference material. In addition,
there is the cost for set up and delivery that were not included in the original cost estimate.
Subsequently, the bids were significantly higher than staff anticipated. Staff did explore the
feasibility of rental units, but none were found that would address all the needs of the
division.
On July 1, 2004, a mandatory pre-bid meeting and tour of the project site was held at the
Parks Yard. Eleven contractors attended the mandatory pre-bid meeting. Three bids were
received, opened, witnessed and recorded on July 13, 2004. The bids were reviewed by the
staff of Purchasing and the General Services of Public Works and were as follows:

Design Space Modular Buildings submitted the lowest bid. Therefore, staff recommends the
contract be awarded to Design Space Modular Buildings, the lowest responsive bidder, in the
amount of $107,407. The contractor’s registration and bonds are in order and references are
satisfactory. Contract documents are on file in the General Services of Public Works office.

This project has been determined to be exempt from environmental review per CEQA-
Section 1530.2, Minor alteration of existing facility.
FISCAL IMPACT:
The total project cost is estimated at $129,000, which includes the project cost plus a
contingency. Due to the timing of the project, the $49,795 budgeted for this project in the
Parks Maintenance budget in 2003-04 was not carried forward to the 2004-05 budget. Staff
is requesting that $49,795 be appropriated from the General Fund reserves to complete the
funding for this project.

THE EXECUTION OF CONTRACT NO. PKS04-02 TO PURCHASE
WHEREAS, bids have been received by the City of Carlsbad, California to purchase and
install a new modular building at the Parks Yard; and
WHEREAS, the lowest responsive bid received was submitted by Design Space
Modular Buildings in the amount of $1 07,407; and,
WHEREAS, the total cost of this project is $129,000 including contingency funds; and
WHEREAS, insufficient funds are available for this project in the Parks Capital Outlay
budget; and
WHEREAS, additional funds in the amount of $49,795 needs to be appropriated to
complete this project.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad as
follows:
1. That the above recitations are true and correct.
2. That the Finance Director is authorized to make an additional appropriation in the
amount of $49,795 from the General Fund Reserves to purchase and install a new modular
building at the Parks Yard
3. The bid of $107,407 by Design Space Modular Buildings and a contingency account
of $21,593 is hereby accepted.
4. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute
a contract for and on behalf of the City of Carlsbad.

executing the required contract and submitting the required bonds and insurance policies, as
described in the contract, within twenty (20) days of adoption of this resolution. The City
Manager may grant reasonable extensions of time.

11. INTRODUCTION
The proposal involves the replacement of an existing 576 square foot modular building with a
1,440 square foot modular building within the Parks Department maintenance yard, located west
of City Hall. The proposed modular building can be installed without the removal of any parking
or vehicular circulation areas and a minimum of site work. A Conditional Use Permit is needed
for the placement of a public building and a Site Development Plan is required for development
in the Qualified Development Overlay zone on the property. The proposal meets all applicable
regulations and staff has no issues with the project.
111. PROJECT DESCRIPTION AND BACKGROUND
The Public Works - Parks Department is requesting approval of a Conditional Use Permit and
Site Development Plan to allow the replacement of an existing modular building with a new
modular building at their maintenance yard site. The property is located at the northwest comer
of Carlsbad Village Drive and Pi0 Pih Drive and currently contains a small Parks office
building, a workshophreak room building, a storage building, two existing modular buildings
used for office and storage, and associated staff and visitor parking, storage yard and
landscaping. The site is used for Parks Department maintenance staff, equipment, and vehicles.
The subject property is designated Governmental Facilities (G) in the City's General Plan Land
Use Element and is zoned Residential-Professional with a Qualified Development Overlay (R-P-
Q). To the west of the site-is Interstate 5. North of the project site is additional storage area for
the Parks Department and east of the site is the Carlsbad City Hall. To the south of the site is a
gasoline station.

According to the Parks Department staff, the existing 12 foot b) 48-fOOt mocL:;LT OuiiLiing [hd.
currently houses the office space, restrooms and showers for the Parks Department maintenance
staff is in a state of disrepair and needs replacement. The proposed modular building would
measure 24 feet by 60 feet and would contain desk space for Parks Department maintenance
employees, a plan room for the storage and review of construction documents. and restrooms
with showers. As shown on Exhibit "A," dated February 4,2004, the modular building Lvould be
located in the western portion of the site, away from the Carlsbad Village Drive and Pi0 Pic0
Drive frontages. The placement of the new structure would necessitate the removal of the nvc
existing modular buildings and some decking. The new modular building would be accessed by
a ramp and stairs and would meet all State accessibility requirements. As shown on Exhibit "B."
dated February 4,2004, the modular building would measure approximately 14 feet in height and
would include skirting to shield the steel framing and utility connections from view.
While the total amount of ofice space is increasing, the expansion is purely to serve the existing
staff and no new staffing is proposed. Therefore no increase in traffic generation or parking
demand would occur. Since the project involves the replacement of an existing modular
building, all public facilities, such as water, sewer, and electricity, are already available on the
site.
The Parks Maintenance Building project is subject to the following regulations:

IV. ANALYSIS
The recommendation for approval of this project was developed by analyzing the project's
consistency with the applicable policies and regulations listed above. The following analysis
section discusses compliance with each of these regulations/polices utilizing both text and tables.
A. Generai Plan
Tie Parks Maintenance Building project Is consistent with the applicable policies and programs
of the Generai Plan. Particularly relevant to the office expansion project are the Land Use and
Public Safety Elements. Table 1 below indicates how the project complies with these particular
elements of the General Plan.

B. Residential Professional Zone
The Parks Department site is zoned Residential Professional and is therefore subject to the
provisions of Chapter 21.18 of the Zoning Ordinance. With regard to permitted uses, Section
2i.42.O 10(2)(I) of the Zoning Ordinance states that public buildings are conditionally allowed in
al! zones (except Community Facilities) with the approval of a Conditional Use Permit. Section
C below discusses the project's compliance with the provisions of the Conditional Use
Ordinance. With regard to development standards, Table 2 below describes the project's
conformance with the provisions of the Residential Professional zone.

C. Qualified Development Overlay Zone
The Parks Department site has a Qualified Development Overlay (Q) zoning designation and is
therefore subject to the provisions of Chapter 21.06 of the Zoning Ordinance. The intent of the Q
Overiay is to supplement the underlying zoning and provide a regulatory mechanism for the
Planning Commission andlor City Council to impose special conditions or requirements on the
proposed development in order to improve compatibility with its site and surroundings. This
mechanism takes the form of a Site Development Plan. The four findings required for a Site
Development Plan are the same as those required for a Conditional Use Permit. Since the Parks
Maintenance Building project is a conditional use in the Residential Professional zone and both a
Conditional Use Permit and Site Development Plan are being requested, the analysis of
consistency with the Conditional Use Ordinance can serve as the analysis of consistency with the
Q Overlay zone. This analysis is contained in Section D below.
D. Conditional Use Ordinance
According to Section 21.42.010(2)(X), public buildings are allowed in all zones except
Community Facilities (C-F) and Limited Control (L-C) with approval of a Conditional Use
Permit. Four findings must be made in order to approve a Conditional Use Permit. These
findings, elaborated in Planning Commission Resolution No. 5559 attached, deal mostly with the
project’s consistency with the General Plan, desirability for the community, and compatibility
with its site and surroundings.
The proposed modular building replacedent is desirable for the community in that the existing
modular building is in disrepair and reduces the ability to provide maintenance functions to the
City parks and selected roadway medians and parkways. The proposed modular building would
be placed on the western side of the property, away from Carlsbad Village Drive and Pi0 Pic0
Drive and, as discussed above, the project site is completely surrounded by roadways. Since no
new uses would be included in the proposed modular building, the existing compatibility of the
Parks maintenance operations with the surroundings would continue. All proposed
improvements can fit within the existing site without the need for significant improvements or
modifications and the proposed modular building would meet all applicable development
standards. Given the internal location of the proposed modular building, no additional
landscaping or walls are needed to screen the site visually or adjust the use to its surroundings. $

While the total amount of office space is increasing, there would be no increase in staftin:
therefore the proposed modular building replacement would not generate any additional traffic
trips. Given the above, the Parks Maintenance Building is consistent with the proyisions of the
Conditional Use Ordinance.
E. Growth Management Ordinance
The Parks Maintenance Building project is a non-residential project. therefore many of the
Growth Management performance standards do not apply. Table 3 details the project's
compliance with those applicable standards.
Given the above, the Parks Maintenance Building project is consistent with the Growth
Management Ordinance.
F. Zone 1 Local Facilities Management Plan
The Parks Department site is located within Local Facilities Management Plan (LFMP) Zone 1.
No special development requirements, such as roadway construction or other infrastructure
requirements, apply to this modular tiuilding replacement. The LFMP does require that all
facilities and services necessary to serve the proposal be in place concurrent with, or prior to,
need. Since the site is already developed and the proposal represents a minor expansion to the
overali development, all services and facilities needed to serve the site and uses are already in
place. Therefore, the proposed project is consistent with the Zone 1 LFMP.
v. ENVIRONMENTAL REVIEW
The proposed project involves the removal of a 576 square foot modular building and the
installation of a 1,440 square foot modular building. New construction or conversions of small
structures, such as buildings not greater than 2,500 square feet, are exempt from further 4

environmental review pursuant to Section 15303 of the State CEQA Guidelines. In making this
determination, the Planning Director has found that the exceptions lisred in Section 15300.2 of
the state CEQA Guidelines do not apply to this project. A Notice of Exemption wili be filed
spon final project determination.

that the State Secretary for Resources has found do not have a significant impact on the
environment, and it is therefore categorically exempt fkom the requirement for the
preparation of environmental documents pursuant to Section 15303 of the State CEQA
Guidelines. In making this determination, the Planning Director has found that the
exceptions Listed in Section 15300.2 of the state CEQA Guidelines do not apply to this
project.
The Planning Commission has reviewed each of the exactions imposed on the Developer
contained in this resolution, and hereby finds, in this case, that the exactions are imposed
to mitigate impacts caused by or reasonably related to the project, and the extent and the
degree of the exaction is in rough proportionality to the impact caused by the project.

Staff is authorized and directed to make, or require the Developer to make, all comctio~
and modifications to the Conditional Use Permit documents, as nectssary to make thm
internally consistent and in conformity with the final action on the project. Development
shall occur substantially as shown on the approved Exhibits. Any proposed development
different from this approval, shall require an amendment to this approval.
Developer shall comply with dl applicable provisions of federal, stat% and local laws and
regulations in effect at the time of building pennit issuance.
If any condition for construction of any public improvements or facilities, or the payment
of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project ate
challenged, this approval shall be suspended as provided in Government Code Section
66020. If any such condition is determined to be invalid this approval shall be invalid
unless the City Council determines that the project without the condition complies with
all requirements of law.
Developer shall submit to Planning Department a reproducible 24” x 36” mytar copy of
the Site Plan reflecting the conditions approved by the final decision making body.
This project shall comply with all conditions and mitigation measures, which are required
as part of the Zone 1 Local Facilities Management Plan and any amendments made to that
Plan prior to the issuance of building permits.
Building permits will not be issued far this project unless the local agency providing
water and sewer services to the project provides Written certification to the City that
adequate water service and sewer facilities, respectively, are available to the project at the
time of the application for the building permit, and that water and sewer capacity and
facilities will continue to be available until the time of occupancy.
This Conditional Use Permit shall be reviewed by the Planning Director annually to
determine if all conditions of this pennit have been met and that the use does not have a
substantial negative effect on surrounding properties or the public health and welfare. If
the Planning Director determines that the use has such substantial negative effects, the

Planning Director shall recommend that the Planning Cornmission, after providing the
permittee the opportunity to be heard, add additional conditions to reduce or eliminate the
substantial negative effects.
This Conditional Use Permit is granted for a period of ten (10) years brn February 4,
2004 through February 3,2014. This permit may be revoked at any time after a public
hearing, if it is found that tbe use has a substantial detrimental tffcct on sumunding land
uses and the public's health and weifare, or the conditions imposed bcreiu have not been met. This permit my be extended for a reasonable period of time not to exceed ten (10)
years upon written application of the permittee made no less than 90 days prior to &e
expiration date. The Planning Commission may not grant such extension, unless it finds
that there are no substantial negative effects on surrounding land uses or the public's
health and welfiire. If a substantial negative eff't on mutuiing land uses or the
public's health and welfare is found, the extension shall be denied or grauted with
conditions which will eliminate or substantially reduce such effects. There is no limit to
the number of extensions the Planning Commission may grant.
This approval is granted subject to the approval of SDP 03-20 and is subject to all
conditions contained in Planning Commission Resolution No. 5560 for that other
approval incorporated herein by reference.
This approval shall become null and void if building permits are not issued for this
project within 18 months from the date of project approval.
Developer shall report, in writing, to the Planning Director within 30 days, any address
change fiom that which is shown on the permit application.
Prior to the issuance of the building permit, Developer shall submit to the City a Notice
of Restriction to be filed in the office of the County Recorder, subject to the satisfiction
of the Planning Director, notifjlng all interested parties and successors in interest that the
City of Carlsbad has issued a Conditional Use Permit and Site Development Plan by
Resolutions No. 5559 and 5560 on the property. Said Notice of Restriction shall note the
property descfiption, location of the file containing complete project details and all
conditions of approval as well as any conditions or restrictions specified for inclusion in
the Notice of Restriction. The Planning Director has the authority to execute and recod
an amendment to the notice, which modifies or terminates said notice upon a showing of
good cause by the Developer or successor in interest.

14. Developer shall comply with the City's requirements of the National Pollutant Discharge
Elimination System (NPDES) permit. Developer shall provide improvements constructed
pursuant to best management practices as referenced in the "California Storm Water Best
Management Practices Handbook" to reduce surface pollutants to an acceptable level prior
to discharge to sensitive areas. Plans for such improvements shall be submitted to and
subject to the approval of the City Engineer. Said plans shall include but not be limited to

That the requested use is properly related to the site, surroundings and cnviromd
settings, is consistent with the various elements and objectives of the General Plan, will
not .be detximental to existing uses or to uses specifically @tted in the area in which
the proposed use is to be located, and will not adversely impact the site, mundjng~ or
traffic circulation, in that the existing modular building is in disrepdr and reduces the
ability to provide maintenance functions to the City parks and selected roadway
medians and parkways; the modular building is designed to the seismic safety
standards of the State Department of Housing and Community Development; and
the proposed modular building would not generate any additional traffic.
That the site for the intended use is adequate in size and shape to accommodate the use, in
that all proposed improvements can fit within the existing site without the need for
significant improvements or modiflcafions and the proposed modular building
would meet all applicable development standards.
That all yards, setbacks, walls, fences, landscaping, and oth& features necessary to adjust
the requested use to existing or permitted fkture uses in the neighborhood will be
provided and maintained, in that the Internal location of the modular building
substantially screens it from views due to existing landscaping and buildings, and
thereby negates the need for any additional features to adjust the use to existing and
permitted future uses and the proposed modular building conforms to the required
setbacks.
That the street systems serving the proposed use is adequate to properly handle all Wc
generated by the proposed use, in that no additional traffic would be generated by the
proposed modular building.

Note: Unless otherwise specified herein, all conditions shall be satisfied prior to issuance of a
building permit.

vested rights are gained by Developer or a successor in interest by the City’s approval of
this Site Development Plan.
Staff is authorized and directed to make, or require the Developer to make, all corrections
and modifications to the Site Development Plan documents, as necessary to make them
internally consistent and in conformity with the final action on the project. Development
shall occur substantially as shown on the approved Exhibits. Any proposed development
diffexent &urn this approval, shall require m amendment to this approval.
Developer shall comply With all applicable pmvkions of federal, state, and local laws and
regulations in effect at the time of building permit issuance.
If any condition for construction of any public improvements or Mlities, or the payment
of any fees in-lieu thereof, imposed by this approval or imposed by law on this Project arc
challenged, this approval shall be suspended as provided in Government Code Section
66020. If any such condition is determined to be invalid this approval shall be invalid
unless the City Council detennines that the project without the condition complies with
all requirements of law.
This approval is granted subject to the approval of CUP 03-31 and is subject to all
conditions contained in Planning Commission Resolution No. 5559 for that other
approval incorporated herein by reference.
