RECOMMENDED ACTION:
Adopt Ordinance No. NS-717 to add Section 18.16.080 to the Carlsbad Municipal Code to require installation of bypass tee for recycled water shut down testing on new building construction.
ITEM EXPLANATION:
Ordinance No. NS-717 was introduced and first read at the City Council meeting held on September 21, 2004. The second reading allows the City Council to adopt the ordinance, which would then become effective in thirty days. The City Clerk will have the ordinance published within fifteen days, if adopted.
ENVIRONMENTAL IMPACT:
This activity is not subject to CEQA in accordance with the general rule that there is no possibility of environmental impact per Section 15061 (b) (3).
FISCAL IMPACT:
The City will not incur additional costs. There will be a reduction in the City’s overtime to perform the shut
down test. Additionally, the property owner will experience less administrative cost in coordinating with the City to perform the shutdown test. The Costs to the builder will vary depending on the pipe size. Material costs are estimated to be typically less than $300 for each assembly. Labor costs for new installations should be minimal because the plumber during construction will be performing similar work at the same time to assemble the piping for the building.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 18, CHAPTER
18.16.080, BY THE ADDITION OF SECTION 609.11 TO THE
CARLSBAD MUNICIPAL CODE TO AMEND BY REFERENCE THE
UNIFORM PLUMBING CODE, 2001 EDITION TO REQUIRE
INSTALLATION OF BYPASS TEE FOR RECYCLED WATER SHUT
DOWN TEST.
The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION 1 : The City Council finds that unique circumstances require certain amendments to
the Uniform Plumbing Code. The amendments set forth in this ordinance are reasonably
necessary because of the local climate, which includes low rainfall and periods of drought. It
has become necessary to expand the use of recycled water throughout the city in order to
conserve potable water. Cross-connection testing is required by State law as well as by
California Regional Water Quality Control Board, San Diego Region Order Number 2001 -352,
which is the Master Reclamation Permit for the Carlsbad Municipal Water District.
SECTION 2: That Title 18, Chapter 18.16 of the Carlsbad Municipal Code is amended by
the addition of Section18.16.080 to read as follows:
18.1 6.80 Section 609.12 is added to the Uniform Plumbing Code to read:
On the effective date of this Ordinance, all new buildings where recycled water will be used for
irrigation shall install on the building supply pipe a bypass tee for recycled water cross-connection
shut down testing. The bypass tee shall be constructed of copper and the size shall match the
building supply pipe size approved for the building. The bypass tee shall be connected to the
building supply pipe above ground and before the pressure regulator at a point just before it
enters the building. Both end connections to the building supply pipe shall be made using a union.
A bronze full port straight ball valve with handle shall be installed on the inlet side of the bypass
tee for the building supply pipe, and sized to match the inlet tee. A bronze full port straight ball
valve with tee-head and padlock wing shall be installed on the side inlet tee, which shall be
threaded with a male hose thread adapter to match the building supply pipe size. The work shall
be in conformance with Engineering Standard Drawing W35. All shut down tests using the bypass

tee shall be conducted with a backflow prevention device to reduce potential for contamination of
the potable water system.
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and
the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be
published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen
(15) days after its adoption.

ITEM EXPLANATION:
Continuing limited water resources in California have made it necessary for local agencies to implement the use of recycled water as a conservation measure. Discharge Order No. 2001-352, which was adopted by the California Regional Water Quality Control Board, San Diego Region, governs the delivery of recycled water to customers in Carlsbad. Section C2 (b) of the Discharge Order requires that the City conduct a complete cross connection shut down test prior to providing recycled water to a new use site and annually thereafter. The test is performed by a certified cross-connection control specialist with oversight and monitoring provided by the County Department of Environmental Health. The purpose of the shut down test is to ensure that there are no discoverable cross connections between the potable water system and the recycled water system.
The mandatory procedure for the shut down test includes a requirement that the potable water system be shut down at its point of connection. As a result, the water customer is not being supplied potable water during the testing time period, which is a minimum of four hours.
Staff has been coordinating scheduling to accommodate the needs of each recycled water use customer to perform these tests, but in some situations, such as apartment buildings and commercial facilities such as restaurants and grocery stores, the coordination effort can be extensive and disruptive to the water customer. To resolve this situation, other recycled water purveyors have developed a modification to the customer's onsite plumbing system that enables the potable water supply to be maintained to the building while the shut down testing work is being performed. The modification includes installing a tee on the above ground water main before the pipe enters the building. The tee includes two valves that enable the cross-connection control specialist to temporarily bypass the building's main pipeline by connecting a hose from the public water system to the building. The cross connection control specialist can then shut off the potable water from the meter to the building without interrupting the potable water supply. The final assembly with valves is referred to as a "bypass tee".
Staff recommends that effective November -, 2004, all new buildings constructed in the City shall be required to install a bypass tee for recycled water shut down testing. The size of the tee and associated ball valves shall match the size of the incoming main line piping designed for the building. The bypass tee shall be located above ground before the water main branches into the building's distribution system. The bypass tee shall be threaded to fit a 1-1/2" fire hose fitting.

AND SETTING THE PUBLIC HEARING TO CONSIDER ADOPTION

WHEREAS, the City Council of the City of Carlsbad, California, is considering to require

WHEREAS, the City Council may adopt Ordinance No. NS-717 to require new
wiiding construction to install a bypass tee for recycled water testing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
