quitclaiming two public drainage easements over Lot 1 and two
ITEM EXPLANATION:
To accommodate development of La Costa Glen North Retirement Community (SDP 98-01A) at the west
end of Levante Street, the applicant, Continuing Life Communities LLC, is requesting that two public
drainage easements and two covenants for easements be quitclaimed.
The La Costa Glen North Retirement Community property lies within the Green Valley Master Plan.
The subject storm drain easements and covenants for drainage easements were granted with the
processing of the Green Valley Master Plan final map. Although the map identified these easements as
being necessary for the development of the lots, subsequent approvals and redesign has rendered the
easements no longer necessary.
The two public drainage easements (PR 04-58) currently exist over Lot 1. These easements were granted
for storm drains to carry public water from Rush Rose Street to the retention basin located on Lot 1.
Rush Rose Street was vacated on January 15, 2002 per City Council Resolution No. 2002-019 thereby
eliminating the need for any public storm drain systems or easements over Lot 1.
The two covenants for drainage easements (PR 04-57) traversing Lots 8 and 9 are for private storm
drains that carry runoff from the hillsides west of the La Costa Glen North Retirement Community property
to a retention basin east of the proposed development. The current project proposes relocation of a
portion of these existing storm drains. The existing storm drains will be removed and newly aligned storm
drains will be installed. Therefore, the easements for the abandoned alignment are no longer needed.
New easement dedications will not be processed since blanket covenants for drainage easements over
all of Lot 8 and 9 were recorded on July 10,2000 per Doc No. 2000-0362588.
Staff has reviewed the easements and supports the proposed quitclaim of the existing easements and
covenants for easements.
FISCAL IMPACT:
The item has no fiscal impact to the City. The easements were granted to the City for a no fee cost
acquisition and the City will quitclaim the easement for a no fee cost return to the property owner.
The owner has paid the standard fee for processing this quitclaim.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A QUITCLAIM OF
TWO PUBLIC DRAINAGE EASEMENTS OVER LOT 1 AND
TWO COVENANTS FOR DRAINAGE EASEMENTS OVER
LOTS 8 AND 9 OF MAP 13997, CARLSBAD TRACT NO. 92-08.
WHEREAS, Continuing Life Communities LLC, a California limited liability company,
ias submitted a request to quitclaim two covenants for drainage easements originally dedicated
)er Document Nos. 2000-0362596 and 2000-0362597, dated July 10, 2000, and two drainage
zasements as originally dedicated to the City per Carlsbad Tract No. 92-08, Green Valley,
Map No. 13997; and
WHEREAS, said easements are no longer utilized for the purpose for which it was granted
and is not now, nor is it contemplated to be, needed for drainage purposes; and
WHEREAS, the City Council of the City of Carlsbad has determined it to be in the public
nterest to quitclaim said easements; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
=alifornia, as follows:

That the quitclaim deed conveying drainage easements over a portion of Lots 1, 8,
and 9, Map No. 13997 of Carlsbad Tract No. 92-08, to Continuing Life Communities LLC,
