A PORTION OF ESTRELLA DE MAR ROAD AND CITY ATTY.

RECOMMENDED ACTION:
Adopt Resolution No. 2004-355
Road and Corte Quinta Mar, and setting a public hearing for December 14,2004.
declaring the intention to vacate a portion of Estrella de Mar
ITEM EXPLANATION:
An application has been filed by KSL La Costa Resort Corporation to vacate a portion of the Estrella
de Mar Road and Corte Quinta Mar rights-of-way.
On September 21, 2004, the City Council adopted Resolution No. 2004-304 approving the tentative
map for La Costa Resort and Spa, CT 03-01. The tentative map identified the proposed Estrella de
Mar Road and Corte Quinta Mar vacations to accommodate redevelopment of the resort property.
The developer of the La Costa Resort and Spa, KSL La Costa Resort Corporation, is currently
processing a final map for the resort property, including a portion of Estrella de Mar and
Corte Quinta Mar. The final map, grading, and improvement plans for the proposed development will
be complete and secured prior to recording a resolution vacating the rights-of-way.
Utility Companies have been notified of the proposed vacations; no objections have been received.
FISCAL IMPACT:
Approval of these vacations will result in .93 acres of land to be returned to the tax rolls.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, DECLARING THE INTENTION TO
VACATE A PORTION OF ESTRELLA DE MAR ROAD AND
CORTE QUINTA MAR AND SETTING A PUBLIC HEARING.
WHEREAS, KSL La Costa Resort Corporation has submitted an application to vacate a
portion of Estrella de Mar Road and Corte Quinta Mar: and
WHEREAS, the City Council did on September 21 , 2004, adopt Resolution No. 2004-304
approving a tentative map, CT 03-01, for the La Costa Resort and Spa property; and
WHEREAS, the tentative map of Carlsbad Tract CT 03-01 contemplated the vacation of a
portion of Estrella de Mar and Corte Quinta Mar; and
WHEREAS, a final map for CT 03-01 is currently being processed and all necessary
improvements will be completed or secured prior to recordation of a resolution of vacation; and
WHEREAS, the City Engineer has determined that this portion of Estrella de Mar and
Corte Quinta Mar are not needed for present or future street purposes; and
WHEREAS, the proposed vacation is in accordance with the Growth Management Policies
and is consistent with the General Plan of the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

That the above recitations are true and correct.
It is Council's said intention to vacate, for public street purposes, a portion of
Estrella de Mar and Corte Quinta Mar as described in Exhibit "A" and shown for the sake of clarity
on Exhibit "8".
3. It also shall be Council's said intention to conduct the proceedings for this street
vacation under the California Streets and Highways Code, Division 9, Part 3, Chapter 3.
4. A public hearing shall be held at the City Council Chambers at 1200 Carlsbad
Village Drive, Carlsbad, California, at 6:OO p.m., on December 14, 2004.

5. That the City Clerk is instructed to publish this resolution of intention in the local
newspaper and the City Engineer is instructed to post such notices along the site in accordance
with the California Streets and Highways Code.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 9th day of November , 2004 by the following vote, to wit:
AYES: Council Members Lewis, Finnila, Hall and Packard.
