CITY MGR GENERAL PLAN IMPLEMENTATION STATUS REPORT FOR FISCAL YEAR 2003 - 2004 That the City Council ADOPT Resolution No. Implementation Status Report for Fiscal Year 2003-2004. 2004-361 , ACCEPTING the General Plan ITEM EXPLANATION: This is a report to provide information on the status of the City of Carlsbad General Plan and the progress the City has made in its implementation during Fiscal Year 2003 - 2004. Bac ka rou nd California Government Code Section 65400 requires that all California cities and counties: (b) (I) Provide an annual report to the legislative body, the Office of Planning and Research, and the Department of Housing and Community Development on the status of the plan and progress in its implementation, including the progress in meeting its share of regional housing needs determined pursuant to Section 65584 and local efforts to remove governmental constraints to the maintenance, improvement, and development of housing pursuant to paragraph (3) of subdivision (c) of Section 65583. This report for FY 2003 - 2004 is the fifth annual report to be prepared by the City in response to Government Code Section 65400, and satisfies the requirement for information on the status and progress in implementing the General Plan. The Planning and Housing and Redevelopment Departments have also prepared an annual report that includes the regional share housing information, which satisfies the State requirement that the annual report address the progress of the City in meeting its share of regional housing needs. The 2003/2004 Housing Production Report has been prepared concurrently with this report. Report Contents The focus of this report is on the status of the City of Carlsbad General Plan and the progress in its implementation. This report does not include the progress of the City in meeting its share of regional housing needs. The 2003/2004 Housing Production Report satisfies the annual housing needs report requirement. Taken together, this report and the 200312004 Housing Production Report meet the requirements of Government Code Section 65400. To determine the status of the General Plan and the City's progress in its implementation, each department reviewed the General Plan programs for which they have responsibility in implementing. The departments then provided information on the status of the implementation of each program during FY 2003 - 2004. This information is provided in the attached report, and is divided into two parts consisting of 1) answers to a questionnaire; and 2) a table that lists each General Plan program and its status. The second form of information is a table that lists each of the over 500 programs contained within the nine elements of the General Plan. The implementation status of each program is indicated in the table along with any additional comments. ENVIRONMENTAL: This report is categorically exempt from environmental review as per CEQA Guidelines Section 15306, which states that information collection activities are exempt from the provisions of CEQA. I - 59 4 INTRODU CTl ON This is a report on the status of the City of Carlsbad General Plan and the progress the City has made in its implementation during Fiscal Year 2003 - 2004. It has been prepared in response to the requirements of California Government Code Section 65400, which reads in part as follows: 65400. Implementation of plan Affer the legislative body has adopted all or part of a general plan, the planning agency shall do both of the following: (a) Investigate and make recommendations to the legislative body regarding reasonable and practical means for implementing the general plan or element of the general plan, so that it will serve as an effective guide for orderly growth and development.. . (b) (7) Provide an annual report to the legislative body, the Office of Planning and Research, and the Department of Housing and Community Development on the status of the plan and progress in its implementation, including the progress in meeting its share of regional housing needs determined pursuant to Section 65584 and local efforts to remove governmental constraints to the maintenance, improvement, and development of housing pursuant to paragraph (3) of subdivision (c) of Section 65583. Report Contents The focus of this report is on the status of the City of Carlsbad General Plan and the progress in its implementation. In addition to meeting the State requirements, a second objective of this report is to provide information that will be useful to the City Council, City Manager, and those departments with responsibilities for implementing the General Plan. There are over 500 programs contained in the General Plan, which are intended to implement the General Plan’s goals, objectives and policies. To determine the status of the General Plan and the City’s progress in its implementation, each department reviewed the General Plan programs for which they have responsibility in implementing. The departments then provided information on the status of the implementation of each program during FY 2003-2004. This information is provided in two forms, which consist of: 1) answers to a questionnaire; and 2) a table that lists each General Plan program and its status. i General Plan Implementation Status Report for FY 2003-2004 Introduction The purpose of the questionnaire (Part I) was to highlight major work that had been conducted during FY 2003-2004 that implemented the goals and objectives of the General Plan, and to determine what changes might be necessary to better meet the needs of the City. The questionnaire consisted of four questions as follows: I. Highlight the major worWprogress in your depattment/division during fiscal year 2003-2004 (July I, 2003 through June 30, 2004) that was derived from goals and objectives of the General Plan. 2. Highlight major worWprogress in your departmenVdivision anticipated to be done during this fiscal year (2004-2005) that is derived from the goals and objectives of the General Plan. 3. Do you have any recommended changes to the General Plan, such as additional programs or modifications to existing programs to help implement the goals and objectives of the Plan? 4. How can the General Plan better meet your departmenf’s/division’s needs and the needs of the community? The second form of information (Part II) is a table that lists each of the over 500 programs contained within the nine elements of the General Plan. The table reflects the implementation status of each program along with any additional comments. The implementation status is referenced as follows: (C) “Completed” = One-time project for which all work has been completed ( 0) “0 n g o i n g ” = Completed program but one that requires recurring activity (I) “In Progress” = Staff work is well under way and program will be implemented soon (including any necessary hearings) (P) “Pending” = Program for which preliminary work needs to be initiated, or program is in early stages of work (D) “Delete” = Program that may no longer be necessary or relevant due to another program, changed circumstances, or policy change Staff Effort Many staff members assisted with the review and assimilation of information for the preparation of this report. Each department assigned a liaison to review and comment on the status of the General Plan programs. Any comments or questions may be directed to the project manager, Jennifer Coon, Associate Planner. iii 8 PART I DEPARTMENT HIGHLIGHTS AND COMMENTS The following information consists of responses to four questions asked of each City of Carlsbad department with responsibility in implementing one or more goals, objectives, policies or programs of the Carlsbad General Plan. A. QUESTION1 Highlight the major work/progress in your departmentldivision during Fiscal Year 2003-2004 (July 7, 2003 through June 30, 2004) that was derived from goals and objectives of the General Plan. Department Response: Arts 1. Arts education in conjunction with the Cannon Art Gallery was provided to 7,000 children and adults. 8 uilding Des a rtm e n t 2. Completed the City’s Unreinforced Masonry Building Program. All structures identified as “unreinforced masonry buildings’’ have been strengthened. Finance Department 3. Worked on Open Space Maintenance Goal to assess cost of maintaining city- owned lands, which are part of the Habitat Management Plan. Determined the amount of additional land acquisition is required in the County Core area. Worked with a consultant to update the Habitat Mitigation Fee (still proposed), which will fund the acquisition of the additional required acreage in the County Core area. Report will be presented to City Council in 2005. Fire Department 4. A full-scale, real time emergency operations exercise was conducted in May 2004 to test the City’s Emergency Plan. In response to the exercise, the EOC was activated at Level II, which included utilizing Major Service Area leaders and their immediate staff. As a result of the exercise, recommendations have been made for updates to the City’s Emergency Plan.. 5. Participated with the San Diego Sheriffs Department and other North County Fire Agencies to develop a mapping system that includes evacuation routes and response plans throughout the North County, and standardizing wildland incident preplans and structure response preplans. The Sheriffs office will incorporate the Zone-wide evacuation plans into their mapping system. I General Plan Implementation Status Report for FY 2003 - 2004 Department Highlights and Comments 6. In addition to enforcing the minimum standards adopted in the City’s Building Code Ordinance and the use of automatic fire sprinklers, when residences are proposed to be constructed adjacent to a Fire SuppressionMlildland Interface Zone, the Fire Department has required exterior “passive fire protection”, which includes additional non-combustible exterior features (e.g., boxed-in eaves, dual pane glass and strategically located vents to the exterior of buildings). 7. Approximately 1,020 dead or diseased trees were removed from Hosp Grove, in a joint effort with the California Division of Forestry. Housing and Redevelomnent 8. Staff worked with community and business leaders on a feasibility study to construct a temporary farm worker shelter. The study was presented to the City Council in December 2003. Through this effort, a public/private partnership was developed to work towards constructing a shelter. The partnership efforts are ongoing. Parks and Recreation 9. IO. 11. 12. 13. 14. 15. 16. Completed the master plan and bid process for Hidden Canyon Park. Acquired CUSD’s interest in the former administrative building adjacent to the Senior Center. Redesigned and awarded bid for construction of Aviara Park. Ground breaking ceremonies held in March 2004. Processed design plans and specifications for Pine Avenue and Alga Norte Parks. Initiated on-line registration for recreation and aquatic programs. Implemented the sportsmanship program for all City sponsored recreation programs and requirements for outside organizations using Carlsbad sport fields and facilities. Completed a five-year budget forecast of recreation programming for current and future facilities. Assumed ownership and maintenance responsibilities for an additional four miles of Citywide trail system. 2 General Plan Implementation Status Report for FY 2003 - 2004 Department Highlights and Comments 17. Received a grant and several awards for the completion of Leo Carrillo Ranch Historic Park. 18. Completed redesign of future golf course. Planninq 19. 20. 21. 22. 23. Staff continued working on the General Plan/Zoning Consistency Program (a multi-yeadmulti-part goal), which is aimed at achieving consistency between the General Plan and Zoning Ordinance. The focus of staffs work during FY 03-04 included the following: a. Prepared all documents and initiated the public hearing process for amendments to the residential policies and regulations in the General Plan and Zoning Ordinance. b. Continued work on drafting a new C-L (Commercial Local) zone to implement the Local Shopping Center land use designation. c. Continued work on drafting amendments to the T-R land use designation and C-T zone. d. Initiated the drafting a new General Commercial land use designation, and amendments to the C-I and C-2 zones. During FY 03-04 much work was accomplished toward obtaining the final approval of, and drafting the implementation documents for the Habitat Management Plan. The Fish and Wildlife Service published the Notice of Availability and Final Comment Period for the HMP in June 2004. The Open Space Management Plan for the HMP was drafted and reviewed by the wildlife agencies and interested groups. Also, the implementation agreement for the HMP, and revisions to the habitat mitigation in-lieu fee were drafted. In August 2003, the Coastal Commission voted to approve the Municipal Golf Course. In December 2003, the City Council accepted the Coastal Commissions conditions and suggested modifications, and gave staff direction to proceed with pursuing financing options for development of the golf course. Staff coordinated and held a Planning Commission workshop to review the Architectural Guidelines. Pursuant to Planning Commission comments and direction at the workshop, staff initiated amendments to the Architectural Guidelines. The amendments were recommended for approval by the Planning Commission on July 21, 2004. Completed an amendment to the Zoning Ordinance to allow “temporary farm worker housing” in all zones (except residential), subject to the approval of a conditional use permit. 3 General Plan Implementation Status Report for FY 2003 - 2004 Department Highlights and Comments 24. 25. 26. Staff initiated the public hearing process for an amendment to the Circulation Element of the General Plan to incorporate the citywide trails program and provide standards for trails to be constructed in lieu of sidewalks on Circulation Element roadways. On June 2, 2004, the Planning Commission voted to recommend approval of the proposed amendment; and on July 27, 2004 the City Council approved the amendment. Staff completed an amendment to the City Council Policy on Wireless Communication Facilities to establish criteria for the placement of such facilities within the public right-of-way. Staff coordinated the review (i.e. land use, design, habitat preservation, facilities management, environmental review, etc.) of several large development proposals. The following is a summary of some of the major projects that were reviewed during FY 2003/2004: Master Plans/Specific Plans 0 Staff continued the review process on a 57-acre master planned development that includes retail, commercial and residential uses (La Costa Town Square - Mag Property). 0 Staff continued the review process on the Robertson Ranch Master Plan. 0 Staff continued participating in the development of the Ponto Area Specific Plan (assisting in the preparation and review of the draft plan). Residential Projects 0 Several residential subdivisions were approved, including 8 subdivisions in the Bressi Ranch, Calavera Hills and Villages of La Costa Master Plan areas, which consist of a combined total of 1,023 single-family lots, 100 affordable condominium units, open space and recreation lots. 0 A 78-unit condominium project (Bluffs) was amroved, which includes 10 units that will be affordable to very low income households; and a 58- unit condominium project (La Costa Condominiums) was amroved, which includes 9 units that will be affordable to low income households. An expansion of the La Costa Glen retirement community was approved, which includes 311 independent living units, 23 attached villas, 29 garden villas, a commons building and a recreation building. 4 General Plan Implementation Status Report for FY 2003 - 2004 Department Highlights and Comments 0 Staff continued to review several other large residential projects, including Cantarini Ranch and Holly Springs, which consist of a combined total of 148 residential lots, an 80-unit multi-family site and open space. 0 Applications were submitted and the planning review process was initiated on several residential projects, including 369 single-family lots (4 tentative maps) in the Villages of La Costa area, and 4 condominium projects with a combined total of 171 units. Planned Industrial Proiects 0 The Bressi Ranch Industrial subdivision was approved, consisting of 40 industrial lots. Com me rcia I Pro iect s 0 Los Coches Village neighborhood shopping center was approved, which includes 30,000 square feet of grocery, 26,000 square feet of retail, 10,000 square feet for a bank, and 23,000 square feet of medical office located at the southeast corner of Camino De Los Coches and Rancho Santa Fe Road. 0 Staff continued reviewing an application for the Carlsbad Ranch Resort - a full service destination resort, proposed to including hotel and timeshare units, restaurants, recreation areas, and meeting facilities, to be located on the west side of Hidden Valley Road between Cannon Road and Palomar Airport Road. 0 An application was submitted and staff initiated the review of the Poinsettia Transit Village - a mixed-use, transit oriented development proposed to include 78 residential units, 16,200 square feet of commercial use and a 2,800 square foot daycare facility, to be located west of Avenida Encinas between Poinsettia Lane and Palomar Airport Road. 0 An application was submitted and staff initiated the review of the Plaza at Sunny Creek - a proposal to develop a 17.8 acre shopping center with grocery, drugstore, retail, commercial and restaurant uses, to be located on the northeast side of El Camino Real between College Blvd, and Sunny Creek Rd. 5 General Plan Implementation Status Report for FY 2003 - 2004 Department Highlights and Comments Communitv and Public Facilities/Utilities 0 Several community and public facilities projects were approved, including the Twin D Recycled Water Pump Station, Calavera Recycled Water Pump Station, North Green Valley Interceptor Sewer, and Northwest Quadrant Community Park. 0 A coastal development permit to construct a one-mile segment (Tamarack Avenue to Oak Avenue) of the Coastal Rail Trail was approved. 0 Staff continued the review process on several applications for community facilities and public utilities projects, including the Carlsbad Seawater Desalination Plant. 0 Staff initiated the review of the Alga Norte Community Park. Implemented an IndustriallCommerciaI Inspection Program for industrial, commercial, residential and municipal sectors in order to bring them into compliance with the NPDES Urban Storm Water Permit and local ordinances. Completed design and permitting for the Coastal Rail Trail. Obtained adoption of the Stormwater Financing Fee Study report recommending methods of financing the Stormwater Protection Program. Implemented tools to record, track, monitor, and report “Requests for Action” effectiveness. Continued the implementation of the Carlsbad Storm Water Protection Program Outcome and Performance Measurement System in accordance with requirements of the NPDES Order 2001-01 to assess the effectiveness of the Jurisdictional Urban Runoff Managements Plan (JURMP). Implemented a multi-year public education, outreach and training activities program in order to meet the requirements of the Carlsbad JURMP. Continued with the on-going planning and development of financing programs for the following missing links of major arterial roadways: 0 Melrose Drive from Palomar Airport Road to City limits 0 Faraday Avenue from El Camino Real to City Limits 0 Cannon Road from College Blvd. to City limits Obtained environmental approvals for the following major arterial roadway projects: 0 Melrose Drive from Palomar Airport Road to City limits 0 Faraday Avenue from Orion Way to Melrose Drive Completed design and obtained environmental approvals for Rancho Santa Fe Road Phase II. Initiated construction of the following roadway projects: 0 El Fuerte south of Palomar Airport Road 0 Poinsettia Lane from east of El Camino Real Completed construction of the following roadway projects: 0 College Blvd. from Cannon Road to Carlsbad Village Drive 0 Cannon Road from El Camino Real to College Blvd. 0 Poinsettia Lane from Blackrail Road to Zone 19 boundary (referred to as Reach “C”) 0 Rancho Santa Fe Road realignment and widening, Phase I Coordinated the review of several large development projects for compliance with public workdengineering standards (i.e. circulation, grading, drainage, storm water quality, growth management, public facilities, etc). QUESTION2 Highlight major work/progress in your departmentldivision anticipated to be done during this fiscal year (2003-2004) that is derived from the goals and objectives of the General Plan. Department Response: - Arts 1. Installation of public artwork at Aviara Community Park. 2. Award $24,000 in community arts grants to groups and organizations that provide arts programming to the Carlsbad community. Fire Department 3. Continue the Fire Department’s pursuit of operational readiness and response by maximizing regional opportunities in North County; specifically through regional training, streamlining and cohesive emergency response, as well as exploring region-wide financial efficiencies. 4. Continue to improve response capabilities to Weapons of Mass Destruction (WMD) incidents. Utilizing Unified Disaster Council grant funding, additional hazardous material clothing, detection and mitigation a I7 General Plan Implementation Status Report for FY 2003 - 2004 Department Highlights and Comments equipment and tools will be purchased to assist in the rescue of victims trapped as a result of WMD or other disasters. 5. Participate and provide critical performance feedback in a February 2005 County-wide WMD real time drill. Specialized County safety teams, including Search & Rescue, the Metropolitan Medical Strike Team and hazardous materials teams will participate along with many public safety agencies from throughout the County in this exercise. 6. Continue to build on established operational relationships with the Coast Guard, State Lifeguards and local lifeguard agencies in the management of water-related disasters. 7. Continue to remove dead and diseased trees from Hosp Grove, in a joint effort with the California Division of Forestry. Approximately 1,080 trees remain in need of abatement. Housing and Redevelopment 8. It is anticipated that FY 2004-2005 will see the largest production of affordable housing units in the history of the lnclusionary Housing Program. 421 rental units (Calavera - 106, Villages of La Costa - 180, Pacific View/Kelly Ranch - 82, Manzanita - 24, and the Summit - 29) and 135 for- sale units are anticipated to be completed (Village by the Sea - 11, Laguna Point - 3, Rose Bay - 24 and Bressi Ranch - 100). Continue working on the General Plan/Zoning Consistency Program, and initiate amendments to the Zoning Ordinance and General Plan as a result of necessary amendments identified by the Program. Anticipated amendments include the following: a. Complete an amendment to the residential policies and regulations in the General Plan and Zoning Ordinance to ensure consistency between the two documents. b. Complete an amendment to the Zoning Ordinance to create a new C-L zone classification to implement the “L” (Local Shopping Center) land use designation. c. Complete an amendment to the General Plan to create a new “general commercial” land use designation, and an amendment to the C-I and C-2 Zones in the Zoning Ordinance. d. Complete an amendment to the T-R land use designation and C-T zone to clarify the purpose and intent of the designations and expand the list of permitted uses in the C-T zone. e. Initiate an amendment to the industrial land use designation and zones to achieve consistency. Staff will work on a 5-year comprehensive update to the Housing Element. Initiate a program to develop community outreach procedures and tools to facilitate the early involvement of residents in infill development projects in their neighborhood and for mediating resolutions. Department Response: Housing and Redevelopment 1. Amend Land Use Element, Village Program C.2, to reflect that the Redevelopment Plan has been adopted, but the Land Use Plan for the Barrio has not. Planning 2, Much statistical information in the General Plan is out of date and should be updated. For example, all references to population and housing data from the 1990 Census should be updated to reflect data from the 2000 Census. Much of the land use inventory is also out of date. 3. In addition, there are several General Plan Programs that should be updated to reflect current information or should be deleted. Some Programs reference documents or information that is no longer relevant or valid.
