RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. APPROVING the third amend-
ment in 2004 to the Land Use Element and Open Space and Conservation Element of the General
Plan for the projects commonly known as Holly Springs (GPA 00-06) and Cantarini Ranch (GPA 01-
09).

ITEM EXPLANATION:
State law allows a jurisdiction to amend a mandatory element of the General Plan no more than four
times per year. The mandatory elements are Land Use, Circulation, Housing, Open Space, Noise,
Safety, and Conservation. Each amendment to a mandatory element, however, may include more
than one change to that element.
The following two General Plan Amendment applications propose changes to the Land Use Element
and the Open Space and Conservation Element. The City Council has approved in concept each of
the applications at a duly noticed public hearing on the meeting date noted below. Staff has grouped
the applications together so they comprise the third General Plan Amendment of 2004, referred to as
“GPA Batch No. 3.” The recommended action would formally adopt all of the changes, which will
enable consistency between the General Plan and zoning and the permits required for the projects
associated with each application.
Holly Springs (GPA 00-06) - On December 7, 2004, the City Council approved in concept the
General Plan amendment for the Holly Springs project. The Holly Springs project, generally located
east of College Boulevard and south of future Cannon Road, includes 43 single-family custom home
lots surrounded by approximately 61 acres of open space. The Amendment would adjust the
Residential Low Medium Density (RLM) and Open Space (OS) land use designations on the project
site. In its action, the City Council directed the formal approval of this amendment as part of GPA
Batch No. 3 (as shown in City Council Resolution No. 2004-388 1.
Cantarini Ranch (GPA 01-09) - On December 7, 2004, the City Council approved in concept the
General Plan Amendment for the Cantarini Ranch project. This project features 105 single-family
lots and an 80-unit mixed-rate apartment on property adjacent and south of the Holly Springs project.
The Amendment would adjust and change the land use designations on the project site from
Residential Low-Medium Density (RLM) and Open Space (OS) to Residential Low-Medium Density
(RLM), Residential Medium-High Density (RMH) and Open Space (OS). In approving the project,
the City Council directed the formal approval of this amendment as part of GPA Batch No. 3 (as
shown in City Council Resolution No. 2004-387 1.
Staff anticipated GPA 04-16 (North Coast Calvary Chapel) would also be a part of this third
amendment to the General Plan. However, its Council review will not occur in time to be a part of
this amendment.

ENVIRONMENTAL:
Holly Springs (GPA 00-06) and Cantarini Ranch (GPA 01-09) - An Environmental Impact Report
(EIR) was prepared for the two projects in accordance with the California Environmental Quality Act
(CEQA), the CEQA Guidelines and the Environmental Protection Procedures (Title 19) of the
Carlsbad Municipal Code. The EIR addresses the environmental impact associated with all
discretionary applications for the proposed projects.
The analysis contained in the EIR concluded that all significant impacts would be mitigated to
below a level of significance with the exception of cumulative impacts to air quality. The
cumulative impacts arise from the marginal contribution the proposed projects will make, when
combined with the impacts from existing and other future projects, to pre-existing conditions that
currently fail to meet applicable standards.
Under CEQA, before a project which is determined to have significant, unmitigated environmental
effects can be approved, the public agency must consider and adopt a “Statement of Overriding
Considerations” pursuant to CEQA Guidelines 15043 and 15093. As part of its approval of the Holly
Springs and Cantarini Ranch projects on December 7, 2004, the City Council adopted the necessary
Statement of Overriding Considerations.
Third amendment to the General Plan - This amendment to the General Plan is considered a project
and therefore subject to CEQA. Since the amendment consists of two projects, the impacts of each
need to be considered cumulatively. This cumulative analysis was performed as part of the EIR
prepared and adopted for both projects. Therefore, the cumulative impacts resulting from this
second General Plan Amendment have been addressed adequately.
FISCAL IMPACT:
Holly Springs (GPA 00-06) and Cantarini Ranch (GPA 01-09) - For both projects, all required
improvements needed to serve this project would be funded by the developer. The Facility
Financing section of the amended Zone 15 Local Facilities Management Plan lists the financing
techniques proposed to guarantee the public facilities needed to serve development within Zone 15.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE THIRD GENERAL
PLAN AMENDMENT BATCH OF 2004 CONSISTING OF TWO
CHANGES TO THE GENERAL PLAN FOR PROJECTS
COMMONLY KNOWN AS HOLLY SPRINGS (GPA 00-06), AND
CANTARlNl RANCH (GPA 01-09).
APPLICANT: CITY OF CARLSBAD
CASE NO.: THIRD GENERAL PLAN AMENDMENT OF 2004
WHEREAS, pursuant to Government Code Section 65358 and pursuant to the
provisions of the Carlsbad Municipal Code, the Planning Commission, on October 20, 2004,
held a duly noticed public hearing for GPA 00-06 and GPA 01-09 as prescribed by law to
consider the proposed changes to the General Plan; and
WHEREAS, the Planning Commission adopted resolutions No. 5751 and 5757,
recommending approval in concept of the proposed changes to the General Plan; and
WHEREAS, the City Council on December 7, 2004, held a duly noticed public
hearing to consider the Planning Commission’s recommendations and to hear all persons
interested in the proposed changes to the General Plan and the related environmental review;
and
WHEREAS, the City Council of the City of Carlsbad wishes to consolidate the
changes to the General Plan as proposed by GPA 00-06 and GPA 01-09 into a single
amendment constituting the third General Plan Amendment of 2004.
NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Carlsbad,
California, does hereby resolve as follows:
1. That the above recitations are true and correct.
2. That this is the third of four annual permitted amendments to a mandatory
element of the General plan consisting of the following two changes:
a. That the Land Use Element and Open Space and Conservation Element of
the General Plan for the project commonly known as Holly Springs is
amended as shown on attached Exhibit GPA 00-06 and as provided in City
Council Resolution No. 2004-388
b. That the Land Use Element and Open Space and Conservation Element of
the General Plan for the project commonly known as Cantarini Ranch are
amended as shown on attached Exhibit GPA 01-09 and as provided in City
Council Resolution No. 2004-387

EFFECTIVE DATE: This resolution shall be effective upon its adoption, except
as to the General Plan Amendment, which shall be effective thirty (30) days following its
adoption.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Carlsbad on the 14th day Of Dewr , 2004, by the following vote, to wit:
