RECOMMENDED ACTION:
Adopt Resolution No. ’2005-004 authorizing the City Engineer to execute Right of Way
Certifications for Federal and State Aid projects as required by the California Department of
Transportation.
ITEM EXPLANATION:
The California Department of Transportation (Caltrans) provides assistance to Local Agencies for
Capital Projects that receive Federal and State Aid funds. As part of their Local Assistance function,
they process and approve the necessary certifications that are required to receive Federal and/or
State funds.
For Federal and State Aid projects that include work outside the City right of way, a “Right of Way
Certification” is required. The Right of Way Certification confirms that the City has acquired the necessary right of way, or has the right to access and use the right of way/property necessary to
proceed with construction. Caltrans policies require the Certification to be executed by an authorized
official. To facilitate the timely execution of these Certifications, staff is recommending that the City Council authorize the City Engineer to execute all such Certifications as required by Caltrans.
FISCAL IMPACT:
Authorizing the City Engineer to execute Right of Way Certifications will reduce administration costs
by streamlining the approval and project management process.

RESOLUTION NO. 2o05-004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, AUTHORIZING THE CITY ENGINEER TO
EXECUTE RIGHT OF WAY CERTIFICATIONS FOR FEDERAL
AND STATE AID PROJECTS AS REQUIRED BY THE
CALIFORNIA DEPARTMENT OF TRANSPORTATION.
WHEREAS, prior to proceeding with construction of Federal and State Aid projects, the
California Department of Transportation (Caltrans) must issue an Authorization to Proceed with
Construction notice; and
WHEREAS, the Caltrans policies require that prior to issuing an Authorization to Proceed
with Construction notice for projects that are outside of the City right of way that an authorized
agency official execute a Right of Way Certification; and
WHEREAS, the City Council finds it would be more efficient, cost effective, and in the best
interest of the City to identify the City Engineer as the authorized agency official to execute all
such Right of Way Certifications.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. The City Engineer is authorized to execute all Right of Way Certifications as
required by Caltrans.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 11th day of JANUARY , 2005 by the following vote, to wit:
AYES: Council Members Hall, Kulchin, Packard, Sigafoose
