TITLE: ACCEPTING BIDS AND AWARDING CONTRACT FOR
CONSTRUCTION OF THE INDUSTRIAL PARK PIPELINES FOR
THE ENCINA BASIN WATER RECLAMATION PROGRAM,
AND APPROPRIATION OF FUNDS
PHASE II PROJECT, PROJECT NOS. 3887-C, 3667, AND 3930
Board of Directors of Carlsbad Municipal Water District (CMWD) Adopt Resolution
No. 1232 accepting bids and awarding a contract for the construction of the Industrial Park
Pipelines, Project Nos. 3887-C, 3667, and 3930 and appropriation of funds.

ITEM EXPLANATION:
This construction contract includes three separate components. First, is the Industrial Park
Pipelines, Project No. 3887-C, which is part of the Encina Basin Water Reclamation Program,
Phase II Project (Phase 11). The Industrial Park pipelines will enable the recycled water processed at the Carlsbad Water Recycling Facility (CW RF) and the Meadowlark Water Reclamation Facility,
to reach recycled water customers within the industrial park areas surrounding Palomar Airport,
which includes:

Also included is a pipeline in Calavera Hills that will primarily supply recycled water to Calavera
Park.
The second component, Project No. 3667, is a full width pavement overlay on Faraday Avenue,
Rutherford Road, Aston Avenue, Farnsworth Court, Balfour Court, Pascal Court, Priestly Drive,
La Place Court, Geiger Court, Landau Court, Pasteur Court, Darwin Court, and Camino Vida Roble.
The pavement overlay is part of the City’s Pavement Management Program.
The third component, Project No. 3930, installs approximately 9,000 feet of 4-inch diameter conduit
with three smaller conduits inside, each capable of holding 24 fiber optic cables. This was requested
by the Information Technology Department to allow the City to insert fiber optic cables between the
Faraday Building, the Farmer’s Building, and the Safety Center in the future without trenching in the
streets.
On June 8, 2004, the plans and specifications for Project Nos. 3887-C, 3667, and 3930 were
approved to advertise for construction bids. On October 7, 2004, the following five (5) sealed bids
were received:

All the bids submitted exceed the Engineer’s Estimate; however, an extensive review of the bids received, as well as the specifications and plans, and discussions with contractors and material
suppliers indicate that costs have increased significantly in the last six to nine months and continue to increase. Therefore, requesting new bids will not result in lower construction bids.

Orion Construction submitted the lowest bid amount; however, it was an incomplete bid, and they subsequently submitted a written request with documentation indicating they had made a
mathematical error in preparing their construction bid. Orion Construction requested that they be
relieved of their bid based on the mathematical error. Staff reviewed the documents submitted by
Orion Construction in support of their request for bid relief, and determined that they satisfied the
requirements described in Section 5103 of the Public Contract Code, for removal of their bid from further consideration.
The documents submitted by the second low bidder, 1. Fletcher Creamer, have been reviewed and
analyzed by engineering staff and were found to be in order. The Engineering staff recommends the
award of the construction contract for Project Nos. 3887-C, 3667, and 3930 to J. Fletcher Creamer in
the amount of $8,775,466.
ENVIRONMENTAL REVIEW:
A Mitigated Negative Declaration (MND) was prepared for the Phase I1 project. The Carlsbad City Council approved the MND on January 25,2000 under Case No. EIA 99-09, Resolution No.
2000-37. The United States Department of the Interior completed its review of the Phase I1 project
for compliance with the National Environmental Policy Act (NEPA) and formally approved the NEPA on March 1, 2002. The conduit for fiber optic cable is to be installed in the same trench as
the recycled water pipeline. The Pavement Overlay project is categorically exempt from the
environmental review process under Section 15301 Class 1 (C) of the California Environmental Quality Act.
FISCAL IMPACT:
The total project cost for the three component items, which includes recycled water pipelines,
pavement overlays, and a fiber optic cable conduit, is approximately $10.1 million, as shown below.
Each component includes construction contingencies, design costs and inspection costs, and is to
be paid from separate funds described below:

The project cost of $236,360 for the fiber optic cable conduit is shown in Table 4. To construct this
conduit will require an additional appropriation of $1 42,760 from the General Capital Construction
Fund.

Industrial Park Recycled Water Pipelines (Proiect No. 3887)
The recycled pipelines portion of the total project is estimated to cost approximately $7.8 million as
shown in Table 5. This is the last of twelve pipeline projects included in the Recycled Phase II Program. This project is funded from a total appropriation for all twelve pipeline projects in the amount of $20,650,200. To fund this project will require an increase in the total pipeline appropriation of $1,202,321 as shown in Tables 6 and 7.

Table 6 summarizes the total cost of all the pipeline contracts comprising Phase II under Project No.
3887, including the Industrial Parks pipelines (3887C). All the costs shown are for projects which
have received bids for construction; therefore, the basis for all contingencies and inspection costs
has been established. The total appropriation to date is $20.65 million while total project costs are
estimated at $21.85 million, resulting in the need for an additional appropriation in the amount $1.2
million to fund the Industrial Parks Pipelines. This is the last of the pipeline projects to be awarded.

Summary of Phase II Proiect Costs

At this time, construction bids have been received on all but two of the 22 construction contracts that
comprise the Phase II project. The remaining two projects include Mahr Reservoir Improvements
and the Supervisory Control and Data Acquisition (SCADA) system. Based on the actual
construction bids and the final engineer's estimates on the remaining two projects, staff has
determined the total appropriation required in each assigned fund category to complete Phase II.
The total appropriation increase is shown in Table 7 and totals $3,163,844.

With regard to capital costs, Phase II is estimated at $49.7 million, and is being funded through five sources.
The first source is a grant in the amount of $2,168,993 from the Environmental Protection
Agency (EPA), which has been received.
The second source is a grant authorized under Bureau of Reclamation (BUREC) policy Title
XVI of P.L. 102-575, as amended by P.L. 104-266 for the North San Diego County Area
(NSDCA) Water Recycling Project. The BUREC “Assistance Agreement” with CMWD for
NSDCA funding is based on receiving 25 percent of $36,890,000 or $9,222,500.
The third and fourth sources are from the California State Water Resources Control Board
(SWRCB), which approved a $5 million grant and a low-interest loan up to $32 million. Staff is
estimating that the SWRCB loan will be approximately $27 million. Repayment of the loan will
be from operating revenues and connection fees.
The fifth source is the Recycled Water Fund, where $6.3 million is the estimated total
contribution.
In conclusion, the current appropriation for Phase II is $46,512,424. To fund the Phase II project
cost of $49,676,268, staff is recommending that the Recycled Water Fund appropriation be
increased by $3,163,844. In addition, staff is recommending that the Fiber Optic Cable appropriation be increased by $142,760 to fund the total project cost of $236,360.

AWARDING THE CONSTRUCTION OF THE INDUSTRIAL PARK
PIPELINES, FOR THE ENCINA BASIN WATER RECLAMATION
AND 3930 AND APPROPRIATION OF FUNDS.
PROGRAM, PHASE II PROJECT, PROJECT NOS. 3887-C, 3667,
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has
determined it necessary, desirable, and in the public interest to construct the Industrial Park
Pipelines for the Encina Basin Water Reclamation Program, Phase II Project, Project No. 3887-C;
and
WHEREAS, the Board of Directors of the Carlsbad Municipal Water District has
determined it necessary, desirable, and in the public interest to incorporate a pavement overlay
project, Project No. 3667, and a fiber optic cable conduit installation, Project No. 3930, into the
Industrial Park Pipeline project, Project No. 3887-C; and
WHEREAS, the estimated project cost for the Industrial Park recycled water pipelines is
$7,803,351 and the Industrial Park recycled water pipelines are part of the Encina Basin Water
Reclamation Program, Phase II Project with a total cost of $49.7 million; and
WHEREAS, the appropriations totaling $4631 2,424 for the Encina Basin Water
Reclamation Program, Phase II Project are insufficient to complete the entire project; and
WHEREAS, an additional appropriation of $3,163,844 from the Recycled Water Fund is
required to complete all of the Encina Basin Water Reclamation Program, Phase II Project.
WHEREAS, the City Council of the City of Carlsbad, California, has agreed to reimburse
the Carlsbad Municipal Water District the actual cost for pavement overlay, Project No. 3667,
and the placement of fiber optic cable conduit, Project No. 3930, as part of the construction of the
Industrial Park Pipeline Project, Project No. 3887-C; and
WHEREAS, the low bidder made a mathematical error in preparing his bid, and has
requested to be relieved of their bid.
NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of Carlsbad Municipal
Water District (CMWD) of the City of Carlsbad, California, as follows:

2. That the bid submitted by Orion Construction is relieved from further consideration.
3. That the bid submitted by J. Fletcher Creamer, in the amount of $8,775,466, for the
nstruction of the Industrial Park Pipelines, Project Nos. 38874, 3667, and 3930 is hereby
cepted and the Executive Manager is authorized and directed to execute a contract therefore.
4. That the Executive Manager is authorized to approve construction change orders

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
