TITLE: ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE
EL CAMINO REAL TRAFFIC SIGNAL IMPROVEMENTS
AT HOSP WAY, MARRON ROAD & PLAZA DRIVE,
PROJECT NO. 3899-1 AND APPROPRIATION OF FUNDS

RECOMMENDED ACTION:
Adopt Resolution No. 2005-043 accepting bids and awarding a contract for the
construction of the El Camino Traffic Signal Improvements at Hosp Way, Marron Road and Plaza
Drive, Project No. 3899-1 and appropriation of funds.
ITEM EXPLANATION:
On October 26, 2004, the City Council approved the plans and specifications for the El Camino Real
Traffic Signal Improvements at Hosp Way, Marron Road and Plaza Drive, and directed the City
Clerk to advertise for construction bids. At the request of staff in the Design Division and
Engineering Inspection, an addendum to the project was issued on October 29, 2004 for approximately 145' of AC pavement overlay on Marron Road, west of El Camino Real. This work
was originally part of the 2004/05 Pavement Overlay Project (3667-9). In order to minimize traffic
impacts to the intersection of El Camino Real and Marron Road, the pavement overlay in the vicinity of this intersection was removed from the Pavement Overlay Project and added to this project via
addendum. On December 7, 2004, only one sealed bid was received, as follows:
Since only one bid was received, contractors that received a bid package but did not submit a formal
bid were contacted and queried by staff. Four of the five contractors contacted informed staff that
their busy workload was the primary reason a bid was not submitted and that the project scope
including the addendum was not a deterrent. Therefore, it is staffs opinion that changing the
project's scope of work or re-bidding the project would not guarantee additional bids or more
favorable bids.
The Engineer's Estimate for construction was $823,528 (including the pavement overlay on Marron
Road). The low bid submitted by the contractor, which is more than the Engineer's Estimate, reflects
the rise in construction costs since funds were originally appropriated. According to data gathered
by the Engineering News-Record (ENR), in 2004, the Southern California region experienced the
greatest yearly increase in construction costs since 1982. Due to the added complexity associated
with the removal of existing traffic signal equipment after new traffic signals are installed and the
additional traffic control effort necessary to minimize disruption to existing signal operations during
construction, the cost of this work is more than a brand new traffic signal installation. The higher
costs can also be attributed to the significant amount of pavement work in a congested traffic
corridor. For these reasons, staff believes that the bid amount submitted by HMS Construction is
acceptable and staff recommends award to the sole bidder.
The lowest responsible bidder is HMS Construction, Inc. at $996,647.15. The documents submitted
by HMS Construction, Inc., for the project have been reviewed and analyzed by staff and found to be in order. Staff, therefore, recommends the award of the construction contract to HMS Construction,
Inc.
ENVIRONMENTAL REVIEW:
This project is a Class 1 categorical exemption (minor alteration of existing structure or facilities) and
is, therefore, exempt from the environmental review process under provisions of the California
Environmental Quality Act (CEQA), Section 15301(c). A Notice of Exemption has been issued by
the Planning Director.

To date, TransNet funds totaling $1.2 million have been appropriated to the project. Due to current
economic conditions, construction costs for traffic signal installation have increased significantly
since funds were originally budgeted for this project. The project cost is now estimated at approximately $1.31 million and an additional appropriation of $1 11,000 is required to complete the
project.
There are sufficient TransNet funds available for the additional appropriations and the project is eligible to receive those funds based on the latest SANDAG transportation improvement program
allocation.

RESOLUTION NO. 2005-043
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE EL CAMINO
REAL TRAFFIC SIGNAL IMPROVEMENTS AT HOSP WAY,
APPROPRIATION OF FUNDS.
MARRON ROAD AND PLAZA DRIVE, PROJECT NO. 3899-1 AND
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable and in the public interest to construct the El Camino Real Traffic Signal
Improvements at Hosp Way, Marron Road and Plaza Drive; and
WHEREAS, one (1) sealed bid was received on December 7, 2004 for the project; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by HMS
Construction, Inc., in the amount of $996,647.15; and
WHEREAS, additional funds in the amount of $111,000 need to be appropriated in order
to construct the El Camino Real Traffic Signal Improvements at Hosp Way, Marron Road and
Plaza Drive, Project No. 3899-1 ; and
WHEREAS, there are sufficient TransNet funds available for the additional appropriation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the low bid submitted by HMS Construction, Inc., in the amount of
$996,647.15, is hereby accepted and the Mayor is hereby authorized to execute a contract on
behalf of the City for the construction of the El Camino Real Traffic Signal Improvements at Hosp
Way, Marron Road and Plaza Drive.
3. That the Finance Director is hereby authorized to appropriate $1 11,000 from the
Transnet Local Fund for completion of this project.

5. That the award of this contract is contingent upon the bidder submitting the lowest
responsive bid executing the required contract and submitting the required bonds and insurance
oolicies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
