RECOMMENDED ACTION:
CITY MGR-
Adopt Resolution No. 2005-081 rejecting the bid of $245,100 from Precise Construction
Management and accepting the bid of $254,399 and awarding the contract to Blair Rasmussen
Construction to replace the public restroom at Holiday Park Contract No. PKS 03-07 Project No.
38971, and approving appropriation of additional funds.
ITEM EXPLANATION:
Staff has identified several issues with the existing restroom located on the west side of Holiday
Park. This facility is over 25 years old and cannot be modified to meet current ADA standards.
The current restroom has structural issues and needs to be replaced with a new ADA compliant
restroom facility.
On April 20, 2004, City Council approved contract documents and special provisions, and
authorized the City Clerk to advertise for bids for this project. No bids were received.
Subsequently staff placed the project out to re-bid. Six bids were received, opened, witnessed and
recorded on February 9, 2005. The bid amounts ranged from $245,100 to $422,500. The bids
were reviewed by the Public Works Department and were as follows:
Precise Construction Management $245,100.00
Blair Rasmussen Construction $254,339.00
Templeton Engineering $255,500.00
Benold Construction $279,400.00 Zondiros Corporation $326,000.00
Precision Concrete $422,500.00
Precise Construction Management submitted the lowest bid in the amount of $245,100. However
the bid submitted by Precise Construction Management does not meet the contractual requirement
that the Bidder perform more than fifty percent (50%) of the work with his own forces. Precise
Construction Management indicated on the Designation of Subcontractor and Amount of
Subcontractor’s Bid Items form, a total of seventy-three percent (73%) of the total work as
subcontracts. Therefore, staff recommends the bid from Precise Construction Management be
declared non-responsive in accordance with the contract documents.
Blair Rasmussen Construction submitted the lowest responsive bid. Therefore, staff recommends
the contract be awarded to Blair Rasmussen Construction, the lowest responsive bidder, in the
amount of $254,339. The contractor’s registration and bonds are in order and references are
satisfactory. Contract documents are on file in the General Services offices of Public Works.

ENVIRONMENTAL REVIEW:
A Negative Declaration has been prepared in accordance with requirements of CEQA and has
been approved by the Planning Commission on March 3, 2004 (Resolution No. 5574).
A Conditional Use Permit Amendment CUP-04-03 has been prepared and approved by the
Planning Commission on March 3, 2004 (Resolution No. 5575).

The total estimated construction cost for this project, shown in the table above, including design and
utility company construction and inspection fees is $305,808; appropriations to date are $1 62,200.
Staff is requesting an additional $143,608 from the Infrastructure Replacement Fund to complete the
project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RESPONSIVE AND AWARDING THE CONTRACT FOR HOLIDAY
CARLSBAD, CALIFORNIA, REJECTING THE LOW BID AS NON-
PARK RESTROOM REPLACEMENT (RE-BID) AND APPROPRIATION OF ADDITIONAL FUNDS - CONTRACT NO. PKS 03-07 PROJECT NO. 38971.
WHEREAS, the City Council adopted Resolution No. 2004-1 23 approving
contract documents, special provisions and specifications, and authorized the City Clerk to
advertise for bids to replace an existing restroom in Holiday Park, hereinafter referred to as the
“Project;” and
WHEREAS, the bids were received, opened, witnessed and recorded on February 9,
2005; and
WHEREAS, bids have been received by the City of Carlsbad, California to replace an
existing restroom in Holiday Park; and
WHEREAS, the lowest bid received was submitted by Precise Construction
Management in the amount of $245,100; and
WHEREAS, the City of Carlsbad requires that the all bids evidence that the bidder’s own
organization will perform more than fifty percent of the work and that any bid that does not do so
will be rejected as non-responsive; and
WHEREAS, the bid submitted by Precise Construction Management in the amount of
$245,100 stated that seventy-three (73) percent of the work would be performed by
subcontractors and therefore is non-responsive; and
WHEREAS, the lowest responsive bid received was submitted by Blair Rasmussen
Construction in the amount of $254,339; and
WHEREAS, insufficient funds are available for this project in the Capital Improvement
Project budget; and
WHEREAS, additional funds in the amount of $143,608 needs to be appropriated to
complete this project.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad as
follows:
1. That the above recitations are true and correct.
2. That the Finance Director is authorized to make an additional appropriation in the
amount of $143,608 from the Infrastructure Replacement Fund to replace an existing restroom
in Holiday Park.
3. The bid of $245,100 by Precise Construction Management be declared non-
responsive and be rejected.
4. The bid of $254,339 by Blair Rasmussen Construction to replace an existing
restroom in Holiday Park, and a contingency account of $35,000 is hereby accepted.
5. That the Mayor of the City of Carlsbad is hereby authorized and directed to execute
a contract for Contract No. PKS 03-07 Project No. 38971 Holiday Park Restroom Replacement
with Blair Rasmussen Construction.
6. That the award of this contract is contingent upon Blair Rasmussen Construction
executing the required contract and submitting the required bonds and insurance policies, as
described in the contract, within twenty (20) days of adoption of this resolution. The City
Manager may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 22nd day of MARCH , 2005, by the following vote, to wit:
