G@ CiTY MGR- Project application(s) Administrative Reviewed by and Approvals Final at Planning Commission LFMP 87-05(E) LFMP 87-20(C) On February 16, 2005, the Planning Commission recommended (5-0 Baker and Segall Absent) approval of the proposed boundary adjustments between Local Facilities Management Zones 5 and 20 located east of Hidden Valley Road and south of Palomar Airport Road. This City initiated application is to adjust the boundaries between Local Facilities Management Zones (LFMP) 5 and 20. The development of the Emerald Ridge East residential project combined properties that were within two different LFM Zones. The subdivision combined lots and then subdivided the lots within both Zones 5 and 20. This application is to correct the discrepancy as a result of the subdivision. To be Reviewed - Final at Council X X ENVIRONMENTAL: The project has been reviewed pursuant to the California Environmental Quality Act (CEQA) and has been found to be exempt. The project, which consists of adjusting the LFM Zone boundary between LFM Zones 5 and 20, does not have the possibility of causing a significant effect on the environment and is therefore exempt pursuant to the general rule Section 15061 (b)(3) of the CEQA Guidelines. CASE NAME: EMERALD RlDGE EAST LFMP AMENDMENT CASE NO.: LFMP 87-05(E)/LFMP 87-20(C) WHEREAS, City of Carlsbad has filed a verified application with the City of Carlsbad whxh has been referred to the Planning Commission; and WHEREAS, said application constitutes a request for a Local Facilities Management Plan Amendment for Zones 5 and 20 (dated April 24,2004, on file in the Planning Department) and incorporated by thls reference (collectively referred to as the “Local Facilities Management Plan Amendments”), as provided in Section 21.90.125 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 16th day of February 2005, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Local Facilities Management Plan Amendment for Zones 5 and 20. That the Local Facilities Management Plan amendments for Zones 5 and 20 are consistent with Chapter 21.90 of the Carlsbad Municipal Code (Growth Management), and with the Citywide Facilities and Improvement Plan, in that the properties within the boundary adjustment are already developed or are open space and no impacts to public facilities will result. INTRODUCTION This application is to adjust the boundaries between Local Facilities Management Zones (LFMZ) 5 and 20. The development of the Emerald Ridge East residential project, located south of Palomar Airport Road and east of Hidden Valley Road, combined properties that were within two different LFM Zones. The subdivision combined lots and then subdivided the lots within both Zones 5 and 20. This application is to correct the discrepancy as a result of the subdivision. 111. PROJECT DESCRIPTION AND BACKGROUND The Emerald Ridge East residential project is located south of Palomar Airport Road and east of Hidden Valley Road. The original project was a major residential Tract Map (CT 95-05) subdivision of separate parcels of land within both LFM Zones 5 and 20. The parcels of land were aggregated onto one whole lot and resubdivided. The project resulted in six residential lots and one common open space lot being split by the LFM Zones 5 and 20 boundary. Please refer to Exhibit “X.” The project was recommended for approval by the Planning Commission in June of 1996 and approved by the City Council in August of 1996. This application is to correct the boundary between LFM Zones 5 and 20 so that the entire Emerald Ridge East project is within LFM Zone 20. The discrepancy was discovered during the review of the General Plan and Zoning consistency in the immediate area. IV. ANALYSIS The proposal is to adjust the boundaries between LFM Zones 5 and 20 as of the result of a residential subdivision, which was developed within both Zones 5 and 20. The resultant LFMP 87-05(E) and LFMP 87-20(C) - EMERALD RIDGE EAST LFMP AMENDMENT February 16,2005 adjustment would remove properties bisected by both LFM Zones and place them within Zone 20. The properties to be adjusted are a total of six individually owned residential lots, which are developed with single-family homes, and one commonly owned open space lot. Two of the residential lots are entirely within Zone 20 and four of the residential lots and one open space lot were split between Zones 5 and 20. The lots are located on the northern terminus of Topmast Drive and Ebb Tide Street. A majority of the Emerald Ridge East project is within Zone 20. Because the project is already developed and services are provided to the residential lots, and that the Open Space lot does not have the potential for any fiu-ther development, there are no impacts to facilities or services as a result of the boundary adjustment. V. ENVIRONMENTAL REVIEW The project has been reviewed pursuant to the California Environmental Quality Act (CEQA) and has been found to be exempt. CDP 04-48 - CARLSBAD BOULEVARD U-TURN IMPROVEMENTS - Request for a Coastal Development Permit to allow the installation of a northbound left turn pocket and minor grading and paving in the street right-of-way for Carlsbad Boulevard on property generally located within the Carlsbad Boulevard right-of-way at its intersection with Breakwater 'Road in Local Facilities Management Zone 22. Mr. Neu stated that agenda Items 1, 2 and 3 are normally heard in a public hearing context; however, the projects are minor and routine in nature with no outstanding issues and Staff recommends approval. He recommended that the public hearing be opened and closed, and that the Commission proceed with a vote as a consent Item, including the errata sheets, if any. If the Commission or someone from the public wishes to pull an Item, Staff would be available to respond to questions.
