AMENDING SECTION 21.05.030 OF THE CARLSBAD CITY MUNICIPAL CODE BY AN AMENDMENT TO THE ZONING

RECOMMENDED ACTION:
Adopt Ordinance No. NS-748 amending Section 21.05.030 of the Carlsbad Municipal Code
granting a Zone Change, ZC 04-01, from Limited Control (L-C) to One-Family Residential
(R-I) on a 5.09 acre site located on the east side of Black Rail Road, south of Songbird
Avenue and north of Ocean Crest Avenue in Local Facilities Management Zone 20.
ITEM EXPLANATION:
Ordinance No. NS-748 was introduced and first read at the City Council meeting held on
March 22, 2005. The second reading allows the City Council to adopt the ordinance, which
would then become effective in thirty days. The City Clerk will have the ordinance published
within fifteen days, if adopted.
FISCAL IMPACT:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, AMENDING SECTION
21.05.030 OF THE CARLSBAD MUNICIPAL CODE BY AN
AMENDMENT TO THE ZONING MAP TO GRANT A ZONE
CHANGE, ZC 04-01, FROM LIMITED CONTROL (L-C) TO
ONE-FAMILY RESIDENTIAL (R-I) ON A 5.09 ACRE SITE
GENERALLY LOCATED ON THE EAST SIDE OF BLACK
RAIL ROAD, SOUTH OF SONGBIRD AVENUE AND
NORTH OF OCEAN CREST AVENUE IN THE MELLO II
SEGMENT OF THE LOCAL COASTAL PROGRAM AND
LOCAL FACILITIES MANAGEMENT ZONE 20.

The City Council of the City of Carlsbad, California does ordain as follows:
SECTION I: That Section 21.050.30 of the Carlsbad Municipal Code, being the
zoning map, is amended as shown on the map marked Exhibit “ZC 04-01” dated February 2,
2005, attached hereto and made a part hereof
SECTION II: That the findings and conditions of the Planning Commission as
set forth in Planning Commission Resolution No. 5829 constitute the findings and conditions of
the City Council.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption, and the City Clerk shall certify to the adoption of this ordinance and cause it to be
published at least once in a newspaper of general circulation within fifteen days after its
adoption. (Notwithstanding the preceding, this ordinance shall not be effective within the City’s
Coastal Zone until approved by the California Coastal Commission.)
INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City
Council held on the 22nd day of MARCH , 2005, and thereafter
