RECOMMENDED ACTION:
Consider adoption of Resolution No. appropriating additional funds in the
amount of $450,000 to continue emergency repairs to the slope adjacent to Rancho Santa Fe
Road and Agua Duke Court.

ITEM EXPLANATION:
At an emergency meeting of the City Council held on March 18, 2005, the City Council adopted
Resolution No. 2005-089authorizing emergency repairs to the slope adjacent to Rancho Santa
Fe Road and Agua Duke Court, pursuant to Government Code sections 865-867. Emergency
work commenced immediately and repairs are ongoing to secure this location.
FISCAL IMPACT:
At its March 18, 2005 emergency meeting, the City Council authorized $500,000 to be
appropriated from the Council Contingency Fund for payment of repair activities. To date, staff
estimates that about $250,000 to $300,000 have been spent on emergency work. To fully cover
all costs for repair work, staff estimates that another $450,000 will be needed.
Total actual costs are unknown at this time. However, staff will present to the City Council a full
accounting of all costs including all labor, equipment, material and contract services when work
is completed.
ENVIRONMENTAL IMPACT:
Emergency projects are statutorily exempt from CEQA pursuant to CEQA Guidelines section
15269.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA APPROPRIATING ADDITIONAL
FUNDS IN THE AMOUNT OF $450,000 TO CONTINUE
EMERGENCY REPAIRS TO THE SLOPE ADJACENT TO
RANCHO SANTA FE ROAD AND AGUA DULCE COURT
WHEREAS, on March 18, 2005, the City Council of the City of Carlsbad declared
abatement of impending peril and authorized immediate expenditure of public money to safeguard
ife, health or property; and
WHEREAS, the City Council authorized $500,000 to be appropriated from the Council
Sontingency Fund for payment of emergency repair activities to the slope adjacent to Rancho
3anta Fe Road and Agua Duke Court; and
WHEREAS, staff has determined that an additional $450,000 will be needed to complete
dI emergency repairs.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, as
:oIIows:
1. That the above recitations are true and correct.
2. That the City Manager is hereby authorized to appropriate Four Hundred Fifty
Thousand Dollars ($450,000) from the City Council Contingency Fund to cover the
costs of future emergency repair work.

3. This resolution shall take effect immediately upon its adoption.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad City
