ITEM EXPLANATION:
The City Council provides an opportunity for citizens and organizations to have an item
placed on a City Council Agenda by submitting a letter to the City Manager. Attached is a
letter (Exhibit I) from Bill Arnold, President, Rancho Carlsbad Owners' Association,
requesting the opportunity to make a presentation to the City Council regarding the City of
Carlsbad flood control program for the Rancho Carlsbad Area.

Dear Mr. P atchett :
On behalf of our Owners’ Association, I am requesting that we be placed on the agenda at the
next scheduled meeting of City Council, March 15,2005.
The purpose for this request is to allow our Association to address the full Council in open forum
of our frustration in getting city government to give priority attention and timely implementation
of the city’s flood control program for Rancho Carlsbad. We are fully cognizant of the many
outside governmental agencies hurdles that this plan must overcome. What I am speaking about,
are those sections of the plan that are within the control of the City and the inordinate time it
takes to get things accomplished.
City Council needs to be made aware of our concerns, set priorities and remove us as promptly as
possible from the devastating effects of a major flood. This years excessive rainfall has re-
awaken us to this flooding potential. Fortunately, mother nature has been kind to us, so far, but
in several of these storms an hour’s more of heavy rain would have caused the creeks flowing
through our community to breach and threaten the property and lives of our residents.
In the City Council’s values statement you make reference to providing a “safe community”,
“top quality service”, and “timely response”. The City has an obligation to protect the citizens
of its community and in our view, it is failing to meet that obligation.

Re: Rancho Carlsbad flood control
At the 4/19/05 council meeting we understand you will be presented, by your staff, alternatives
to resolving the immediate issue at hand, construction of an 84" drain pipe for the Calavera
Creek storm water.
One of the city's concerns appears to be the financing of this cost and whether or not drainage
fees would be available for that purpose should the city do the work. .
The City has a legal obligation to its citizens for a safe community and is our specific situation it
could even be construed as a contractual one.
The overriding consideration should be how best to solve the problem in a timely manner.
Financing it should be a distant second.

Re: Lake Calavera Dam repairs
The City of Carlsbad, Ca. has submitted to you a permit request to begin work on the water level
controls at this dam.
We are a senior gated community of 504 homes about one mile downstream of this dam where
the Calavera creek water flows through our community.
A portion of our community lays in the 100 year flood zone and the City of Carlsbad has
designed a flood control plan to remove us from the flood plain through a series of detention
basins combined with stream dredging. Lake Calavera will also aid in flood water control once
these repairs are made. At the present time, the controls are inoperative and during high water
periods, such as this past winter, the lake water goes over the spillway and aggravates an already
serious high water problem.
Recently we admonished the City for the long delay in implementing portions of this flood
control plan. We view this flooding problem so seriously that we recently entered ourselves as
Intervenor Defendant in a U.S. District Court suit against you by the plaintiff, Preserve Calavera,
that pertains to the construction of one of these detention basins. The case is 04CV2301 BEN
(JFS). (See attached).
Preserve Calavera is the same group questioning the City’s repair plans for the dam, wanting
further studies that will only result in more delay.
We respectfully request that you issue the required permit(s) so that work can proceed and be
completed by next winter’s rainy season.
