City Council hold a public hearing regarding the proposed use of US Department of Justice Edward Byme Memorial Justice Assistance Grant funds. 2. City Council adopt Resolution No. accepting the Justice Assistance Grant funds and appropriating the funds to support various police department functions. 2005-1 13 m: PUBLIC HEARING FOR JUSTICE ASSISTANCE GRANT FUNDING AND APPROPRIATION OF FUNDS ITEM EXPLANATION : The Edward Byrne Memorial Justice Assistance Grant (JAG) Program allows states and local governments to support a broad range of activities to prevent and control crime and to improve the criminal justice system. JAG replaces the Byrne Formula and Local Law Enforcement Block Grant (LLEBG) programs with a single funding mechanism that simplifies the grant administration process. The JAG Purpose Areas include 1) Law enforcement programs; 2) Prosecution and court programs; 3) Prevention and education programs; 4) Corrections and programs; 5) Drug treatment programs; and 6) Planning, evaluation, and technology improvement programs. Carlsbad’s 2005 one-time award based on the City’s share of FBI Part 1 Violent Crimes as a propoition of the state’s total is $21,690. These federal funds must be used to supplement existing funds for program activities and cannot replace or supplant local funds. The Police Department proposes that the grant be used to fund I) Interview room equipment upgrades ($15,000); and 2) Disposable spike strips for suspect tire deflation ($6,690). A public hearing must be held regarding the proposed use of the funds and must be held prior to the obligation of the funds. Staff is recommending that the City Council accept public testimony on the proposed expenditures as explained above. If the proposed expenditures are acceptable, staff then recommends that the City Council approve the attached resolution accepting the funding and appropriating funds to the projects noted above. FISCAL IMPACT: The total program cost is $21,690, fully funded by the Justice Assistance Grant. EXHIBITS: 1. Carlsbad’s 2005 one-time award based on the City’s share of FBI Part 1 Violent Crimes as a proportion of the state’s total is $21,690. These one-time funds can be used only to enhance and not replace law enforcement budgets and must be spent within two years from the receipt of the grant. A public hearing must be held regarding the proposed use of the funds and must be held prior to the obligation of the funds. The police department is requesting that the following appropriations be made: 1) Interview room equipment upgrades ($15,000); and 2) Disposable spike strips for suspect tire deflation ($6,690). These proposed expenditures comply with the requirements of the grant.
