ENG I THE CALTRANS TRAFFIC MANUAL - TITLE: ADOPT THE FEDERAL HIGHWAY ADMINISTRATION’S (FHWA) MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES (MUTCD) 2003 EDITION AS AMENDED BY THE RECOMMENDED ACTION: Introduce Ordinance No. NS-755 to amend Title 10 of the Carlsbad Municipal Code by the addition of Chapter 10.08.080 to adopt by reference the Federal Highway Administration’s (FHWA) Manual on Uniform Traffic Control Devices (MUTCD) 2003 Edition as amended by the MUTCD 2003 California Supplement to replace the Caltrans Traffic Manual. ITEM EX P LANATION : On May 20, 2004, the California Department of Transportation (Caltrans) adopted the Federal Highway Administration’s (FHWA) Manual on Uniform Traffic Control Devices (MUTCD) 2003 Edition as amended by the MUTCD 2003 California Supplement. Caltrans initiated this action pursuant to the provisions of the California Vehicle Code Section 21 400. Additionally, this action was recommended by the California Traffic Control Devices Committee (CTCDC). The action taken by Caltrans will prescribe uniform standards and specifications for all official traffic control devices in California by virtue of the MUTCD being used throughout the United States. Adoption of the MUTCD 2003 Edition and the MUTCD 2003 California Supplement will lead the State of California to conform with official traffic control devices used nationwide. Residents and visitors in California will benefit from this uniformity that will enhance transportation mobility, safety and efficiency. The MUTCD 2003 Edition and the MUTCD 2003 California Supplement supercedes and replaces all the traffic control topics, including the traffic signals portion, contained in the 1996 Caltrans Traffic Manual, as amended, and all previous editions thereof. Adoption of the MUTCD and California Supplement will result in some changes in traffic control devices in California. Most of these devices may remain in place until the end of their useful service life. However, the CTCDC has recommended that certain devices be replaced according to specified compliance dates between 2010 and 201 5 corresponding to the identified device. This matter was presented to the Traffic Safety Commission at their February 7, 2005 meeting as an information item. The Commission was informed that staff has been using the Federal Highway Administration’s (FHWA) Manual on Uniform Traffic Control Devices 2003 Edition as amended by the MUTCD 2003 California Supplement since May 20, 2004 when Caltrans adopted the MUTCD 2003 Edition and the MUTCD 2003 California Supplement as a replacement to the Caltrans Traffic Manual. The Commission received the report and took no action. ENVIRONMENTAL REVIEW: The installation/replacement of an official traffic control device is a project that is a Class 1 categorical exemption (minor alteration of existing structure or facility) and is, therefore, exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA), Section 15301 (c). Page 2 of Agenda Bill No. 18,114 FISCAL IMPACT: For applicable devices in Carlsbad, the signs that are required to be changed will be phased in over the next several years to be compliant by the due date. The cost for this sign replacement program will be in the annual Public Works budget for regular installation/replacement of traffic control devices that occurs yearly. EXHIBITS: 1. The Department of Transportation shall, after consultation with local agencies and public hearings, adopt rules and regulations prescribing uniform standards and specifications for all official traffic control devices placed pursuant to this code, including, but not limited to, stop signs, yield right-of-way signs, speed restriction signs, railroad warning approach signs, street name signs, lines and markings on the roadway, and stock crossing signs placed pursuant to Section 21364. The Department of Transportation shall, after notice and public hearing, determine and publicize the specifications for uniform types of warning signs, lights, and devices to be placed upon a highway by any person engaged in performing work which interferes with or endangers the safe movement of traffic upon that highway. Only those signs, lights, and devices as are provided for in this section shall be placed upon a highway to warn traffic of work which is being performed on the highway. or after January 1, 1984, shall conform to the uniform standards and specifications required by this section. Any control devices or markings installed upon traffic barriers on 21401. (a) Except as provided in Section 21374, only those official traffic control devices that conform to the uniform standards and specifications promulgated by the Department of Transportation shall be placed upon a street or highway. (b) Any traffic signal controller that is newly installed or upgraded by the Department of Transportation shall be of a standard traffic signal communication protocol capable of two-way communications. A local authority may follow this requirement. action made optional for a local authority in subdivision (b), the Legislature encourages local agencies to continue taking the action formerly mandated by this section. However nothing in this subdivision may be construed to impose any liability on a local agency that does not continue to take the formerly mandated action. NS-755 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10 OF THE CARLSBAD MUNICIPAL CODE, BY THE ADDITION OF CHAPTER 10.08.080 TO ADOPT BY REFERENCE THE FEDERAL HIGHWAY ADMINISTRATION’S (FHWA) MANUAL ON UNIFORM TRAFFIC CONTROL DEVICES (MUTCD) 2003 EDITION AS AMENDED BY THE MUTCD 2003 CALIFORNIA SUPPLEMENT TO REPLACE THE CALTRANS TRAFFIC MANUAL. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1 : That Title 10, Chapter 10.1 2 of the Carlsbad Municipal Code is amended by he addition of Section 10.08.080 to read as follows: “1 0.08.080 Manual on Uniform Traffic Control Devices.
