Staff has reviewed the bids and determined that the apparent low bid submitted by DPC was
non-responsive due to the fact that those bid documents indicated that the amount of work to
be completed by subcontractors exceeded 50% of DPC’s bid price, which is in violation of the City’s Contract requirements. The documents submitted by Zondiros Corp. for the project have been reviewed and analyzed by staff and found to be in order; therefore, the
lowest responsive bidder is Zondiros Corp. with a bid of $88,742.
The Engineer’s Estimate for construction of the Children’s Garden remodel was $58,006. Due to higher than expected costs resulting from the limited access to the site and the relatively small quantity of work, the bids exceeded the Engineer‘s estimate. No questions were received from prospective bidders that would indicate that re-advertising the project would result in lower bids; therefore, staff recommends increasing the project funding and awarding the contract to the lowest responsive bidder, Zondiros Corp..
ENVIRONMENTAL REVIEW:
This project is categorically exempt from the environmental review process under Section 15304
Class 4 (b) of the Public Resources Code (California Environmental Quality Act).
FISCAL IMPACT:
Staffs project cost breakdown is as follows:

Funds in the amount of $72,765 have been previously appropriated from the Gifts & Bequests
and Friends’ Donations Special Revenue Funds. Due to current economic conditions, construction costs have increased significantly since funds were originally budgeted for this
project. Sufficient funds are not currently available in the Special Revenue Funds for construction
of these improvements; therefore, staff recommends additional funding in the amount of $50,000
to come from the Library’s current operating budget in the General Fund. The Library previously
planned for additive alternates to the construction documents and earmarked operating budget
funds for this purpose, which funds will now be used to cover costs of the main project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE CARLSBAD
CITY LIBRARY CHILDREN’S GARDEN PROJECT, CONTRACT
NO. 425-4.
WHEREAS, the City Council of the City of Carlsbad, California, has determined it
necessary, desirable and in the public interest to remodel the Carlsbad City Library Children’s
Garden; and
WHEREAS, five (5) sealed bids were received on March 8, 2005 for the project; and
WHEREAS, the lowest responsive, responsible bid for the project was submitted by
Zondiros Corp. in the amount of $88,742.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

That the above recitations are true and correct.
That the bid submitted by Zondiros Corp. in the amount of $88,742, is
hereby accepted and the Mayor is hereby authorized to execute a contract on behalf of the City
for the remodel of the Carlsbad City Library Children’s Garden.
3. That the City Manager is hereby authorized to approve construction change orders
up to $22,186.
4. That the award of this contract is contingent upon the bidder submitting the lowest
responsive bid, executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
