APPROPRIATION OF FUNDS
RECOMMENDED ACTION:
Adopt Resolution No. 2005-758 approving the City of Carlsbad’s application to the
California Integrated Waste Management Board (CIWMB) Used Oil Block Grant Program and
authorizing the Public Works Director or designee (Public Works Manager Administration and
Environmental Programs) as signature authority for all related grant documents, i.e. correspondence
and reports and appropriation of funds.
ITEM EXPLANATION:
The California Oil Recycling Enhancement Act authorizes the collection of four cents for every quart
of lubrication oil sold, transferred, or imported into California. A portion of these funds is available to
local governments in the form of non-competitive block grants for establishing used oil collection
programs, which encourage recycling of used oil. The annual grant award to Carlsbad is $24,154
for the term between July 1, 2005 through June 30, 2008. These grant funds will be expended on a
reimbursement basis to eliminate the interesttracking requirement for advanced payments.
With the City Council’s approval, the current (2005-2008) block grant is slated to address continued
public education, enhance the quality and quantity of the permanent collection facilities available to
residents and identify new activities that can strengthen the level of services provided to the City’s
residents. Staff used previous block grant funds from the California Integrated Waste Management
Board to develop an outreach campaign, strengthen the infrastructure of current collection facilities,
and purchase storm drain markings.
Staff recommends the approval of the California Integrated Waste Management Board Used Oil
Grant application for the term 20052008 for funds to be expended on a reimbursement basis.
ENVIRONMENTAL REVIEW:
The approval of the Used Oil Grant application is exempt from the requirements of CEQA pursuant
to Section 15268 of the State CEQA Guidelines.
FISCAL IMPACT:
Per the reimbursement requirements of the Used Oil Grant program, funds must be expended prior
to reimbursement. Therefore, staff is requesting the appropriation of funds from the Solid Waste
fund in advance of reimbursement in the annual operating budget for the Used Oil Grant program

Environmental Justice
Entities that receive grant fbnding from CIWMB for this grant program must comply with the following principles of
Environmental Justice. Environmental Justice is defined in Government Code Section 65040.12tc) as: “. ..the fair
treatment of people of all races, cultures, and incomes with respect to the development, adoption, implementation, and
znforcement of environmental laws, regulations, and policies.” Public Resources Code Sections 72000ta) & 7200 1
broadly require all California Environmental Protection Agency boards, departments, and offices to conduct their
“programs, policies, and activities that substantially affect human health or the environment in a manner that ensures the
fair treatment of people of all races, cultures, and income levels, including minority populations and low-income
populations of the state.”

RESOLUTION NO. 2005-158
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVAL OF USED OIL BLOCK
GRANT APPLICATION AND APPROPRIATION OF FUNDS.
WHEREAS, grant funding has been established by the California Recycling Act and is
available to cities and counties through the California Integrated Waste Management Board for
establishing and maintaining local used oil collection programs that encourage recycling or
appropriate disposal of used oil; and
WHEREAS, the City of Carlsbad is desirous of applying for these funds; and
WHEREAS, the program requires that the application be approved and a signature
authority be appointed by resolution; and
WHEREAS, if awarded, the applicant will enter into a Grant Agreement with the California
Integrated Waste Management Board for implementation of a used oil collection program; and
WHEREAS, the grant funds will be paid on a reimbursement basis
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. The submittal of the 2005-2008 Used Oil Block Grant application is approved.
3. The Public Works Director, Public Works Administration and Environmental
Programs Manager or designee are appointed as the signature authorities for the project.

4. The Finance Director is authorized to appropriate funds from the Solid Waste fund
in the operating budget for the Used Oil Grant program.
