ADOPTION OF THE 2004 CALIFORNIA ELECTRICAL CODE CITY ATTY.
CITY MGR
RECOMMENDED ACTION:
It is recommended that the City Council Introduce Ordinance No. NS-758 ,
amending Title 18, Chapter 18.12 of the Carlsbad Municipal Code and set a date for a
public hearin to adopt by reference the 2004 Edition of the California Electrical Code. on July 5,200!!.
ITEM EXPLANATION:
Staff is proposing to adopt the latest edition of the model electrical code. This model
code is adopted by the State Building Standards Commission, and local jurisdictions are
required to enforce these regulations as the minimum standards for construction
throughout the State. The effective date for this Code cycle is August 1, 2005. This
Council action will bring the City into compliance with the State requirements.
Staff is proposing that the 2004 Edition of the California Electrical Code be adopted into
the Carlsbad Municipal Code. No fee increases for electrical permits are proposed by
this Council action.
FISCAL IMPACT:
No fee modifications are proposed by this ordinance.
ENVIRONMENTAL:
The Planning Director has determined that these activities are categorically exempt from
CEQA review pursuant to Section 15309 of the CEQA Guidelines.

ORDINANCE NO. NS-758
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, AMENDING TITLE 18 CHAPTER 18.12, TO ADOPT BY
REFERENCE THE CALIFORNIA ELECTRICAL CODE (2004 EDITION).
The City Council of the City of Carlsbad, California, does ordain as follows:
SECTION 1: WHEREAS, the City of Carlsbad has a damp marine climate and this has
shown to cause premature deterioration of metal conduit installed on roof surfaces. The local
climate can also cause flexible metal conduit to rust prematurely and thereby increase
impedance to ground when the conduit is the sole means of grounding. The locally alkaline soil
conditions can cause premature deterioration of a rebar Ufer ground. The City finds that certain
modifications to the California Electric Code are necessary to assure safe electrical systems
installed throughout the City.
SECTION 2: That Title 18, chapter 18.12 of the Carlsbad Municipal Code Section
18.1 2.01 0 is amended to read as follows:
18.1 2.01 0 Adoption. The California Electrical Code 2004 Edition, copyrighted by the
National Fire Protection Association, is adopted by reference as the city electrical code.
SECTION 3: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.230 is amended to read as follows:
18.1 2.230 Article 21 5.5 amended- Diaqrams of feeders. Article 21 5.5 of the California
Electrical Code is amended by the addition of the following:
“All horizontal feeders in multiple-occupancy, combustible frame dwellings shall be
installed underground or outside the building unless otherwise approved by the administrative
authority. A duplex is not considered a multiple-occupancy in this instance.”
SECTION 4: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.1 2.240 is amended to read as follows:
18.12.240 Article 225.10 amended- Wirinq on buildinqs. Article 225.10 of the California
Electrical Code is amended by the addition of the following:
The installation of outside wiring on roof surfaces shall not be allowed. The installation
of outside wiring on surface of building shall have approval of the administrative authority.
SECTION 5: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.241 is deleted.

SECTION 6: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.245 is amended to read as follows:
18.1 2.245 Article 250.52131 - Concrete encased electrode amended. Article 250.52(3) -
of the California Electrical Code is amended to read:
The primary grounding method shall be that which is referred to as the “Ufer Ground” consisting
of 20 feet or more of Copper Conductor ##4 (minimum) or larger sized from N.E.C. Table 250-66,
“Grounding Electrode Conductor for AC Systems.” The copper conductor shall be placed three
inches up from the bottom and a three-inch clearance from the sides of the concrete footing and
supported by a Reinforcing Bar #4 or larger completely encased in concrete. When below
ground, the copper grounding conductor shall be encased in concrete or in rigid nonmetallic
conduit from six inches inside the concrete footing to the service equipment. The copper
electrode conductor shall be continuous and unbroken to its termination at the service
connection .
For single-family residential use only (up to and including 200 amp service), the concrete
encased electrode (rebar) may be used subject to the following requirements:
1. The Rebar ##4, 1/2” diameter or larger, to which the grounding electrode conductor is
connected must be a minimum of 20 feet long, unbroken.
2. The total developed length of rebar placed three inches up from the bottom of the foundation
must be no less than 20 feet. Where splices are necessary to obtain the required 20 feet, they
must be made so that the two bars overlap by no less than 15 inches and are secured by at
least two steel tie wires. The splice shall occur at the opposite end from the extended location.
3. The rebar may only extend out of the slab in a dry location.
4. The rebar must extend out of the slab at least six inches and not more than 18 inches, and
the point of connection of the grounding electrode connector must be accessible.
Aluminum or copper-clad aluminum electrode conductor shall not be used in concrete,
outside or in any other corrosive environment.
SECTION 7: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.1 2.246 is deleted.
SECTION 8: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.247 Article 250.1 18 amended-- Types of equipment grounding conductors. Article
18.12.247 is amended to read as follows:
250.1 18 of the California Electrical Code is amended to read:
The equipment grounding conductor run with, or enclosing the circuit conductors shall be one or
more, or a combination of the following:
1. A copper or other corrosion resistant conductor. This conductor shall be solid or stranded,
insulated, covered or bare, and in the form of a wire or a busbar of any shape.
2. Rigid metal conduit.
3. Intermediate metal conduit.
4. Electrical metallic conduit.
5. Cable trays as permitted in Section 392.3 (c) and 392.7
6. Cable bus framework as permitted in Section 370.3

All flexible metal conduits, Type AC cables, Type MC cables, mineral insulated metal sheathed
cables, and non-metallic conduit systems shall have equipment ground conductors run with the
circuit conductors.
Exception No. 1: Flexible metal conduit and flexible metallic tubing shall be permitted for
grounding if all the following conditions are met:
a. The length in any ground return path does not exceed 6 feet (1.83 m).
b. The circuit conductors contained therein are protected by overcurrent devices rated at 20
amperes or less.
c. The conduit or tubing is terminated in fittings listed for grounding.
Exception No. 2: Liquidtight flexible metal conduit shall be permitted as a grounding means in
the 11/4-inch and smaller trade sizes if the total length of any ground return path is 6 feet
(1.82m) or less, the conduit is terminated in fittings listed for grounding, and the circuit
conductors contained therein are protected by overcurrent devices rated at 20 amperes or less
for 3/8-inch and 112-inch trade sizes and 60 amperes or less for 314-inch through 1114-inch
trade sizes.
Exception No. 3: For direct-current circuits only, the equipment grounding conductor shall be
permitted to be run separately from the circuit conductors.
SECTION 9: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.250 is amended to read as follows:
18.1 2.250 Article 362.1 012) amended-Electrical nonmetallic tubing. Article 362.1 0(2) of
the California Electrical Code is amended to read:
The use of electrical nonmetallic tubing and fittings shall be permitted concealed within
walls and floors, where the walls and floors provide a thermal barrier of material which has at
least a 15-minute finish rating as identified in listings of fire-rated assemblies and there is a
continuous ground cable from the main panel throughout the system.
SECTION IO: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.1 2.251 is amended to read as follows:
18.12.251 Article 320.12 amended - Uses not permitted. Article 320.12 of the California
Electrical Code is amended to read:
Type A.C. cable shall not be used in Group A, B, E, H, I, M and S occupancies as
defined in the Uniform Building Code; (Non-residential buildings).
Exception to Non-residential Buildings Only: A complete factory designed and
assembled A.C. Cable Electrical System for lighting or movable walls and U.L. approved may
be used with approval of the Building Official.
SECTION 11: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.252 is amended to read as follows:
18.12.252 Article 330.108 amended- Grounding. Article 330.108 of the California
Electrical Code is amended to read:

Type MC cable shall provide an equipment grounding conductor run with the circuit
conductors.
SECTION 12: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.255 is amended to read as follows:
18.12.255 Article 334.1 0 amended- Nonmetallic-sheathed cable. Article 334.1 0 of the
California Electrical Code is amended to read:
Uses Permitted or Not Permitted. Type NM and Type NMC cables shall be permitted to
be used in one and two-family dwellings or multi-family dwellings and, with approval of the
administrative authority, other structures not exceeding three floors above grade as defined in
the California Building Code.
SECTION 13: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.260 is amended to read as follows:
18.1 2.260 Article 348.60 amended- Flexible metal conduit. Article 348.60 of the
California Electrical Code is amended to read:
Grounding. Flexible metal conduit shall be permitted as a grounding means where both
the conduit and the fittings are approved for grounding. Where an equipment bonding jumper is
required around flexible metal conduit, it shall be installed in accordance with Section 250.1 02.
EXCEPTIONS: 1. Flexible metal conduit shall not be permitted as a grounding means at any
place for an outlet.
2. Flexible metal conduit shall be permitted as a grounding means if the total length in
any ground return path is 6 feet (1.83 m) or less; the conduit is terminated in fittings approved
for grounding, and the circuit conductors contained therein are protected by overcurrent devices
rated at 20 amperes or less and cannot be extended as an outlet.
SECTION 14: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.12.265 is deleted.
SECTION 15: That Title 18, Chapter 18.12 of the Carlsbad Municipal Code Section
18.1 2.270 is deleted.
EFFECTIVE DATE: This ordinance shall be effective on August I, 2005, and the City
Clerk shall certify to the adoption of this ordinance and cause it to be published in a newspaper
of general circulation within the city within fifteen days after its adoption.
