RECOMMENDED ACTION:
Adopt Resolution No.2005-209authorizing a refund of business license tax to JP Morgan Chase Bank
NA of $1,225.00; Continuity Products of $725; Savvier, LP of $7,216.83 and Stellar Properties, LLC
of $1,103.1 1
ITEM EXPLANATION:
JP Morgan Chase Bank, Continuity Products, Savvier, LP, and Stellar Properties, LLC, made
payments for business license taxes. They have made errors in calculating the amount due for
business license taxes. They have requested a refund for this overpayment.
The Finance Department has verified the amount of the overpayment.
Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in excess
of $500. Therefore, staff is recommending approval of refunds to JP Morgan Chase Bank NA of
$1,225.00; Continuity Products of $725; Savvier, LP of $7,216.83 and Stellar Properties, LLC of
$1 ,I 03.1 1.
FISCAL IMPACT:
The payments will result in $1 0,269.94 refunds. No true fiscal impact as the payment was in error.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, REFUNDING
BUSINESS TAX PAYMENT TO JP MORGAN
CHASE BANK NA; SAWIER, LP; STELLAR
PROPERTIES, LLC AND CONTINUITY
PRODUCTS.
WHEREAS, JP Morgan Chase Bank NA, Sawier, LP, Stellar Properties, LLC and
Continuity Products overpaid their business license taxes to the City of Carlsbad; and
WHEREAS, the Finance Department confirmed the overpayment by JP Morgan Chase
Bank NA, Sawier, LP, Stellar Properties, LLC and Continuity Products and verified the refund
amount.
NOW, THEREFORE, BE IT RESOLVED,
SECTION 1. That the above recitals are all true and correct.
SECTION 2. That a refund of business license tax of $1,225.00 to JP Morgan Chase
Bank NA, $7,216.83 to Sawier, LP, $1,103.11 to Stellar Properties, LLC and $725 to Continuity
Products is authorized.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 28th day of JUNE , 2005 by the following vote, to wit:
