Adopt Resolution No. 2005-219 accepting bids and awarding the contract to Hazard
Construction for the construction of the 2005 Pavement Overlay Project No. 3667-1 1.
ITEM EXPLANATION:
The 2005 Pavement Overlay Project is part of the City’s ongoing Pavement Management Program.
This street maintenance project will extend the life of various roadways in the southeast quadrant of
the City by applying a rubberized asphalt concrete layer over the existing pavement. The roadways
were selected based on the age and existing condition of the roadway surface.
In addition to roadway surface maintenance, the project includes concrete repairs to sidewalks, driveway aprons, and curbs. These concrete repairs will occur along roadways that are being
overlaid.
The engineer’s construction cost estimate for the base bid project was $2.4 million. On June 14,
2005, four sealed bids were received for the construction of this project as shown on the following
table.
The bids exceeded the engineer’s estimate because the bid price for rubberized asphalt concrete
was $10 higher per ton than last year’s bid price. This could be the result of higher oil prices, so it is
doubtful that re-bidding the project would result in a cost savings for the City. All bid documents
submitted by Hazard Construction have been reviewed by staff and found to be in order.
ENVIRONMENTAL COMPLIANCE:
This project is categorically exempt from the environmental review process under Section 15301
Class I (C) for the operation and maintenance of existing streets and highways of the California
Environmental Quality Act.

Funding availability:
The City has been awarded a $50,000 Tire Recycling Grant from the California Integrated Waste
Management Board. The funds from this grant will be reimbursed to the City after the money has
been spent.
There is currently $4.1 million of TransNet Local, Gas Tax, and grant funding available for Pavement
Management projects. To date, $1.1 million has been committed for the 2005 Slurry Seal Project.
There are sufficient appropriations available to fund the 2005 Pavement Overlay Project No. 3667-1 1.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE 2005
PAVEMENT MANAGEMENT PROJECT NO. 3667-1 1.
WHEREAS, on April 5, 2005, the City Council of the City of Carlsbad approved plans for
the construction of the 2005 Pavement Overlay Project No. 3667-1 1 ; and
WHEREAS, four (4) sealed bids were received on June 14, 2005 by the City of Carlsbad
for the construction of said project; and
WHEREAS, the lowest responsive and responsible bid to construct said project was
submitted by Hazard Construction in the amount of $2,558,555.50; and
WHEREAS, there are sufficient funds available to complete the project; and
WHEREAS, subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the
City Manager to approve change orders in the amount equal to the contingency set at the time of
bid opening.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:

That the above recitations are true and correct.
That the low bid of $2,558,555.50 submitted by Hazard Construction for the
construction of the 2005 Pavement Overlay Project No. 3667-11 is accepted and the Mayor is
hereby authorized to execute a contract with Hazard Construction for Project No. 3667-1 1.

4. That the award of this contract is contingent upon the bidder submitting the lowest
responsible bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
